Baker" If we are to keep our democracy, there must be one commandment: Thou shalt not ration justice. - Learned Handl This Bibliography was compiled for a book by the present author entitled, RATIONING JUSTICE ON ApPEAL - THE PROBLEMS OF THE V.S. COURTS OF APPEALS, published in 1994 by the West Publishing Company. That book is a general inquiry into the question whether the United States Courts of Appeals have broken Judge Hand's commandment already and, if not, whether the Congress and the Courts inevitably will be forced to yield to the growing temptation to ration justice on appeal. After a brief history of the intermediate federal courts, the book describes the received tradition and the federal appellate ideal. The book next explains the "crisis in volume," the consequences from the huge docket growth experienced in the Courts of Appeals since the 1960s and projected to continue for the foreseeable future. -

Sribnick All Rights Reserved May 2007 111 Abstract In the period afterWorld War II, a network of activists attempted to reformthe programs that supported and assisted delinquent, dependent, neglected, abused and abandoned children and their familiesin the United States. This dissertation examines their effortsto reshape child welfare arguing that it was motivated by the "rehabilitative ideal," a belief that the state was ultimately responsible forthe physical and emotional development of every child and a faithin therapeutic services as a way of providing for children and their families. This argument contributes to our understanding of the rise of a therapeutic state, placing this notion within a particular historical period and within the narrative of the changing nature of American liberalism. The rehabilitative ideal and the child welfare network emerged out of a confluence of trends within American liberalism, social welfare agencies, and social work approaches in the period after 1945. This study provides detailed examination of this phenomenon through the lives of Justine Wise Polier, Joseph H. Reid, and Alfred J. Kahn, and the histories of the Citizens' Committee forChildren of New York, the Child Welfare League of America, and the Columbia University School of Social Work. Investigations of the developments in juvenile justice, fostercare and adoption, child protection, and federalassistance to child welfareservices over the 1950s and 1960s demonstrate how the rehabilitative approach shaped child welfare reform. -

Katsoris* At the start of the 2014 to 2015 academic year, Fordham University School of Law will begin classes at a brand new, state-of-the-art building located adjacent to the Lincoln Center for the Performing Arts. This new building will be the eighth location for Fordham Law School in New York City. From its start at Rose Hill in the Bronx, New York, to its various locations in downtown Manhattan, and finally, to its two locations at Lincoln Center, the law school’s education and values have remained constant: legal excellence through public service. This Article examines the law school’s rich history in public service through the lives and work of its storied deans, demonstrating how each has lived up to the law school’s motto In the service of others and concludes with a look into Fordham Law School’s future. -

Records Relating to Criminal Trials, Appeals, and Pardons Information Leaflet #9 INTRODUCTION This leaflet contains summary information on records of New York trial and appellate courts pertaining to criminal prosecutions (felonies and misdemeanors) and appeals, and on records relating to applications for and grants of clemency by the Governor (pardons, commutations, reprieves). Thus the scope of the information here presented covers the continuum of the State's involvement with a criminal, from arraignment, through trial, conviction (or acquittal or dismissal), sentencing, appeal, and pardon (if any). (The leaflet does not discuss records or files of district attorneys or police agencies, which investigate crimes, apprehend suspects, and prepare cases for prosecution.) Records in the State Archives pertaining to criminal appeals and executive clemency are described in considerable detail. Records held by the trial courts or other repositories are discussed in general terms. Many of the records described in this leaflet contain information that is restricted by statute; the restrictions are noted in the appropriate location. New York's criminal justice system is large and complex, and this leaflet aims to assist researchers to locate sets of records or individual cases in that labyrinth. NEW YORK CRIMINAL COURTS County Court (1847+) In all counties outside of New York City the County Court has jurisdiction over felonies and over misdemeanors that may be prosecuted by indictment. (In exceptional circumstances the Supreme Court may accept a criminal case.) Prior to 1896 the criminal term of the County Court was called the Court of Sessions. For varying periods during the later nineteenth century certain city courts had jurisdiction over felony cases. -

KACZOROWSKI, FORDHAM UNIVERSITY LAW SCHOOL: A HISTORY JOHN M. BREEN* & LEE J. STRANG* I. INTRODUCTION In his book, Fordham University Law School: A History,' Robert J. Kaczorowski has authored an informative history of Fordham Law School. This highly readable and well-researched volume describes the ups and downs, the triumphs and failures, and the key people and events at Fordham Law School, where the author has served as a faculty member since 1986. The overall story that Kaczorowski tells is one of an urban law school founded in 1905 to serve the professional aspirations of the children of New York's Catholic immigrants-a school that rose from modest beginnings to be among the nation's finest, but then languished in mediocrity for decades due to the syphoning off of revenues by University administrators. This period of unfulfilled potential came to an end in the 1990s, when Fordham Law School returned to elite status through a fairer allocation of resources, the creation of new programs and institutes, the admission of a highly quali- fied, national student body, and the hiring of a more scholarly and produc- tive faculty. Kaczorowski's history is also a welcome addition to the assortment of books that tell the particular histories of individual American law schools,2 in part because Fordham Law School is part of a Jesuit university, and the * Georgia Reithal Professor of Law, Loyola University Chicago School of Law. -

Honoring Our Own The WWII Veteran Judges of the Eastern District of New York On Dec. 5, 2012, the Eastern District of New York Chapter of the Federal Bar Association held a program at the American Airpower Museum to honor the district’s distinguished World War II veteran judges. It has often been said that the World War II brothers-in-arms are members of the “greatest generation.” Assuredly, it is not an overstatement to say that our World War II veteran judges and their brothers-in-arms walk among the greatest men of any generation. Each of the honorees are briefly biographied in the pages that fol- low, describing how service to our country has affected their lives and careers. Hon. I. Leo Glasser Born in New York City in 1924, Judge Glasser graduated from the City College of New York in 1943 and then served in the U.S. Army in Europe during World War II. During the war, Judge Glasser served as a U.S. Army infantry technician landing in Europe a few weeks after D-Day at the small French town of St. Mere Eglise. His unit pushed east, eventu- ally crossing into Germany in Spring 1945. The horror of battle was constant. Judge Glasser was wounded while moving ammunition crates and was awarded the Bronze Star for bravery during his service in the European theater. In an article published by Newsday, May 27, 2012, Judge Glasser was quoted as saying: “I hope there will come a day when we have no more war and the lion will lie down with the lamb and we can have universal peace.” Upon returning from the war, Judge Glasser obtained a law degree magna cum laude from Brooklyn Law School in 1948, and then immediately began teaching at Brooklyn Law School. -

Marchi, the son of Louis and Alina Marchi, was born on May 20, 1921, in Staten Island, New York. He graduated from Manhattan College with first honors in 1942, later receiving a Juris Doctor from St. John’s University School of Law and Doctor of Judicial Science from Brooklyn Law School in 1953. He engaged in the general practice of law with offices on Staten Island and has lectured extensively to Italian jurists at the request of the State Department. Marchi served in the Coast Guard and Navy during World War II and was on combat duty in the Atlantic and Pacific theatres of war. Marchi also served as a Commander in the Active Reserve after the war, retiring from the service in 1982. John J. Marchi was first elected to the New York State Senate in the 1956 General Election. As a Senator, he quickly rose to influential Senate positions through the chairmanship of many standing and joint committees, including Chairman of the Senate Standing Committee on the City of New York. In 1966, he was elected as a Delegate to the Constitutional Convention and chaired the Senate Judiciary Subcommittee on Constitutional Issues. That same year, Senator Marchi was named Chairman of the New York State Joint Legislative Committee on Interstate Cooperation, the oldest joint legislative committee in the Legislature. Other senior state government leadership positions followed, and this focus on state government relations and the City of New York permeated Senator Marchi’s career for the next few decades. -
