Ty Warner, the billionaire creator of Beanie Babies plush toys who got probation, not prison, for evading taxes on money hidden in a Swiss bank account. Warner faced 46 months to 57 months in prison under nonbinding guidelines when he was sentenced Jan. 14 by U.S. District Judge Charles Kocoras in Chicago. Prosecutors, who urged Kocoras to impose some prison time on Warner, Thursday asked the U.S. Court of Appeals in Chicago to review his sentence. Kocoras sentenced Warner, the founder of toymaker Ty Inc. and Ty Warner Hotels & Resorts, to two years of probation and 500 hours of community service. Warner pleaded guilty to evading almost $5.6 million in taxes on more than $24.4 million in undeclared income on accounts that held as much as $107 million. Warner's evasion was the largest of more than 100 filed in a five-year crackdown against taxpayers and enablers who used offshore accounts to cheat the Internal Revenue Service. Prosecutors are concerned that his sentence will affect others around the country, said Bryan Skarlatos, a tax attorney at Kostelanetz & Fink in New York not involved in the case. "The case is important for the Justice Department because it's a very large account and a high-profile defendant, and prosecutors are obviously disappointed that they couldn't get a term of incarceration," said Skarlatos.

Ty Warner Charged With Tax Evasion for Allegedly Hiding Funds in Secret Offshore Account With Swiss Bank UBS CHICAGO — The creator of Beanie Babies and other plush animal toys was charged today with federal tax evasion for allegedly failing to report income he earned in a secret offshore financial account he held with UBS, a global financial services firm headquartered in Switzerland. The defendant, H. TY WARNER, was charged in a felony information filed this morning in U.S. District Court. Warner, 69, of west suburban Oak Brook, is the sole owner of TY Inc., a Westmont-based company that designs and sells plush toy animals including Beanie Babies. Warner, who also owns other business interests, will be arraigned in U.S. District Court on a date yet to be determined. Through his attorney, Warner authorized the government to disclose that he is cooperating with the Internal Revenue Service and will plead guilty to the charge. “Regardless of wealth, everyone must pay taxes on all of their income, not just the amount they choose to report. The charge alleges that Warner went to great lengths to hide from his accountants and the IRS more than $3.1 million in foreign income generated in a secret Swiss account.

    NIRPC Full Commission Meeting NIRPC/Forum Building, Portage, IN October 16, 2014 Minutes Chairman Brian Snedecor called the meeting to order at 9:10 a.m. with the Pledge of Allegiance. At the beginning of the meeting, there was a quorum for an Executive Board meeting. During the Finance & Personnel report, a quorum of the full Commission was achieved, allowing for action on the Executive Director’s contract and the 2015 budget. Commissioners present included Nancy Adams, Geof Benson, Kevin Breitzke, Stan Dobosz, Jeff Dekker, Craig Earley, Don Ensign, Karen Freeman-Wilson, Michael Griffin, Eugene Guernsey, Richard Ludlow, Tom McDermott, Roger Miller, Blair Milo, Rich Mrozinski, Rich Murphy, Diane Noll, Lori Reno, Bob Schaefer, Tom Schmitt, Joe Simonetto, Brian Snedecor, James Snyder, Joe Stahura, Greg Stinson, Jim Ton and Dave Uran. Others present included Robert Alderman, Kelly Disser, Dennis Hiffman, Bob Carnahan, Deb Backhus, Heather Ennis, Kay Nelson, Don Koliboski, Karen Lauerman, Bruce Lindner, Bruce Spires, David Wright, Ron Kurmis, Jim Nowacki, Ray Dumbrys, Jennifer Alander, Julia Surber, Carole Carlson, and Keith Benman. Staff present included Ty Warner, Steve Strains, Angie Hayes, Kathy Luther, Dave Hollenbeck, Mitch Barloga, Belinda Petroskey, Jody Melton, Jack Eskin, Sarah Geinosky, Gabrielle Biciunas and Mary Thorne. Brian Snedecor briefly discussed the importance of members attending NIRPC’s full Commission meeting, adding that it is a struggle to achieve a quorum throughout the year. Some municipalities are not committing to the effort necessary to conduct business effectively. Action required today of the full Commission includes the budget and the Executive Director’s contract. Jim Ton expressed the frustration of the Finance & Personnel Committee in putting in extra time to develop the budget and Executive Director’s contract and being unable to take action.
