UPDATE Legislative Update

While Minnesota is still waiting for the ultimate ending of this year’s legislative session, the Legislative Committee was successful in lobbying and participating in efforts to achieve the following:

• ABUSIVE ADA LAWSUIT LEGISLATION The goal of this effort was to prevent the abusive ADA lawsuits affecting local businesses and property owners. A bill was passed that gives property owners 60 days to comply with ADA regulations, which hopefully will deter additional abusive lawsuit filings. The effective date applies only for claims brought since the bill was passed. If sued earlier, complies under the old law. You can read the bill here: HF1542

• PROPERTY TAX RELIEF The goal of this effort is to provide relief for the small businesses who ultimately pay C/I property taxes and make the commercial real estate industry thrive. The tax bill contains two provisions regarding C/I property taxes: excluding the first $100,000 of business property from the statewide tax and freezing the state general levy at the payable 2018 level for taxes payable in 2019 and thereafter.
