The court received a report from the parties and interested nonparties on the status of efforts to significantly expand remote, formal, individualized bail hearings. Administrative Judge Ritchie agreed to work with the Sheriff and other felony judges to hold remote hearings at least four days per week, and to hold at least twelve hearings simultaneously during the time allotted for those hearings. Administrative Judge Ritchie agreed that the felony judges could designate their homes as courtrooms during remote hearings if necessary. In addition, until June 11, 2020, Administrative Judge Ritchie agreed to work with his colleagues to try automatically scheduling formal bail hearings for defendants who are arguably eligible for pretrial release on a personal bondeven if the District Attorney disputes that eligibility under Executive Order GA-13 or other applicable orders or lawsafter potentially eligible defendants are denied personal bonds at initial post arrest proceedings. That said, priority in scheduling prompt hearings, without the need for counsel's or the detainee's motion or request, is given first to those new arrestees and the backlog of detainees arrested before the new procedures were begun, who may be eligible for pretrial release on personal bonds, and those who may be eligible for release because of good-time credits. Prioritized prompt automatically scheduled hearings will be set and held even if there is a dispute as to eligibility for release and even if a personal bond was denied in an informal hearing. This prioritization is intended to reduce the jail population to address the grave public health risks from COVID-19. The plaintiffs had no objection, while recognizing that other arrestees, who may not be facially eligible for pretrial release on personal bonds, are also entitled to prompt formal individualized bail-determination hearings, even if their lawyers have not filed a motion requesting one. The Sheriff agreed to circulate updated lists of all felony pretrial detainees who may be eligible for pretrial release on personal bonds under Executive Order GA-13 and other applicable orders and laws, even if there is a dispute as to eligibility and even if release on a personal bond was previously denied in an informal hearing. These lists will include new arrestees and the backlog of detainees who have not yet had a formal bail determination hearing, even if they had an informal hearing. The lists will also include those who may be eligible for release on good-time credits based on recent state-court decisions. As to those in the good-time category, the list will include what court each defendant is in and whether a motion has been filed seeking his or her release on the basis of good-time credits. The Sheriff will circulate the lists to all parties and those interested nonparties who have requested them, including the Harris County felony district judges, the District Attorney, the Chief Public Defender, the president of the Harris County Criminal Lawyers Association, the Texas Attorney General, and this court. Harris County Felony District Judge Brian Warren agreed to contact prosecutors and defense attorneys to inquire about holding prompt individualized bail- determination hearings for pretrial felony detainees on his docket who may be eligible for pretrial release on personal bonds, even if eligibility is disputed and even if informal hearings have been held. Judge Warren will also advise his fellow felony judges about best practices for holding prompt formal individualized bail-determination hearings for all felony pretrial detainees during the pandemic. The president of the Harris County Criminal Lawyers Association, Mr. Mark Thiessen, agreed to post to the Association's website or listserv the lists of pretrial felony detainees who may be eligible for release on personal bonds, again, even if eligibility is disputed and even if bonds have been denied in earlier informal hearings. Mr. Thiessen will encourage private defense counsel to look for their clients on the lists and request formal bail hearings accordingly. Chief Public Defender Alex Bunin will provide similar support to members of his staff. The court ordered the following: by June 30, 2020, the Sheriff must create an updated list of all felony pretrial detainees facially eligible for release who have not yet received an individualized hearing, and send the list to all parties and interested nonparties. Within 48 hours of receiving that list, the District Attorney's Office and the State-intervenors must review the list and respond with the names of any detainees for whom they have objections to release. Upon receipt of that information, the district judges must promptly release those detainees for whom there are no disputes as to the criteria for release and for whom there are no other reasons for continued detention, such as immigration holds. As to those who are the subject of dispute as to whether the individual pretrial detainee could meet the criteria for release, if there is no dispute, no other hold, and bond is informally denied, the detainee is entitled to an individualized, evidential, counseled, formal bail determination hearing to be set on a prompt basis. But those who are not promptly released are still entitled to a prompt, formal, and evidential bail determination hearing to resolve the dispute or determine if other grounds support or weigh against bail. This includes those not on the 525 person list, who may or may not be clearly eligible for a personal bond, or whose eligibility is disputed, who are entitled to an on the record, counseled, individual bail determination hearing, and a finding as to why the bail conditions cannot be sufficiently fashioned to ward against new criminal conduct or failure to appear. The slow program this past week is apparently due to way the Sheriff sends information on the 525 inmates to the District Attorney and other parties, who all deserve fast attention. Because it was sent in a way that masked the large amount of embedded information, important information about individual detainees in specific courts was not followed up on by the DA. Now that the DA understands how the information will be transmitted in the future, no such delays should be encountered. These steps should reduce the jail population in accordance with the legal limits on releasing pretrial felony detainees, convicted of nothing, yet left in limbo in the jail and exposed to a high risk of catching and spreading the of virus. The spread is, of course, not only to other inmates, but to the guards who come in and out each day to guard, tend to, feed, clean up after, and provide medications to the detainees who are symptomatic or have tested positive. The guards return home each night to their unsuspecting families. And the cycle of contagion continues. Pretrial detention, particularly for a minor, nonviolent offense, is never intended to be a death sentence. Our charge is to make sure that does not happen from the policies specifying and omitting steps that might have avoided dire consequences.
