November 2006 China Human Rights and Subscribe Rule of Law Update View PDF Version United States Congressional-Executive Commission on China Senator Chuck Hagel, Chairman | Representative Jim Leach, Co-Chairman Message From the Chairmen Reform of the Death Penalty Review Process The Commission commends the recent positive steps that China's leaders have taken to help minimize wrongful executions and provide greater procedural due process to criminal defendants. In September, the Supreme People's Court and Supreme People's Procuratorate issued reform measures that establish concrete guidelines for death penalty appeals. On October 31, the Chinese government passed an amendment that requires all death sentences to be reviewed by the Supreme People’s Court. The new amendment brings the primary law governing China's judiciary into conformity with other laws governing the criminal process and incorporates into law policy goals that the Supreme People's Court established in October 2005, when it issued a new five-year reform program for the Chinese judiciary. As a next positive step, the Commission urges the Supreme People’s Court to give full effect to its October 2005 commitments, by issuing a judicial interpretation to settle unresolved issues in the death penalty review process and to clarify its own procedures for review. ONE THE SUPREME COURT AND THE MAKING OF PUBLIC POLICY IN CONTEMPORARY CHINA Eric C. Ip Post-Mao China saw profound social, economic and legal changes. This paper analyzes an often neglected aspect of these transformations: the evolution of the Supreme People’s Court (SPC) into an increasingly influential political actor in national law and policy-making. The SPC has self-consciously redefined its mandate to manage state-sponsored legal reforms by performing an expansive range of new functions such as issuing abstract rules, tightening control over lower courts and crafting out a constitutional jurisprudence of its own at the expense of other powerful state actors. It is more assertive than ever its own vision of how law should develop in the contemporary People’s Republic of China (PRC)SPC action can be broadly consistent with the Chinese Communist Party (CCP) interests, autonomous and expansive at the same time. However, the SPC’s reform initiatives are inevitably constrained by the vested interests of major bureaucratic players as well as the Party’s insistence on maintaining the Court as an integral administrative agency of its public security system. [Re]viewing the Chinese Landscape: Imaging the Body [In]visible in Shanshuihua 山水畫 Lim Chye Hong 林彩鳳 A thesis submitted to the University of New South Wales in fulfilment of the requirements for the degree of Doctor of Philosophy Chinese Studies School of Languages and Linguistics Faculty of Arts and Social Sciences The University of New South Wales Australia abstract This thesis, titled '[Re]viewing the Chinese Landscape: Imaging the Body [In]visible in Shanshuihua 山水畫,' examines shanshuihua as a 'theoretical object' through the intervention of the present. In doing so, the study uses the body as an emblem for going beyond the surface appearance of a shanshuihua. This new strategy for interpreting shanshuihua proposes a 'Chinese' way of situating bodily consciousness. Thus, this study is not about shanshuihua in a general sense. Instead, it focuses on the emergence and codification of shanshuihua in the tenth and eleventh centuries with particular emphasis on the cultural construction of landscape via the agency of the body. On one level the thesis is a comprehensive study of the ideas of the body in shanshuihua, and on another it is a review of shanshuihua through situating bodily consciousness. The approach is not an abstract search for meaning but, rather, is empirically anchored within a heuristic and phenomenological framework. This framework utilises primary and secondary sources on art history and theory, sinology, medical and intellectual history, ii Chinese philosophy, phenomenology, human geography, cultural studies, and selected landscape texts. This study argues that shanshuihua needs to be understood and read not just as an image but also as a creative transformative process that is inevitably bound up with the body. -

July 19, 2021 Hong Kong Business Advisory U.S. Executive Agencies Publish Advisory Discussing Risks and Considerations for Businesses and Individuals Operating in Hong Kong SUMMARY On July 16, the U.S. Departments of State, the Treasury, Commerce, and Homeland Security (collectively, the “Departments”) issued an advisory (the “Advisory”) highlighting what the Departments consider to be the increasing risks businesses, individuals, and other persons face in operating in the Hong Kong Special Administrative Region (“Hong Kong”) of the People’s Republic of China (“PRC”). In light of recent changes to Hong Kong’s laws and regulations, the Advisory seeks to make such persons aware of “potential reputational, regulatory, financial, and, in certain instances, legal risks associated with their Hong Kong operations.”1 CATEGORIES OF RISKS The Advisory identifies four broad categories of risks: (i) risks for businesses following the imposition of the Law of the People’s Republic of China on Safeguarding National Security in the Hong Kong Special Administrative Region (the “National Security Law”); (ii) data privacy risks; (iii) risks regarding transparency and access to critical business information; and (iv) risks for businesses that engage with, or may engage with, sanctioned Hong Kong or PRC entities or individuals. A. RISKS UNDER THE NATIONAL SECURITY LAW The PRC National People’s Congress Standing Committee passed the National Security Law in June 2020, which established punishable offenses including secession, subversion, terrorist activities, and collusion with a foreign country or external elements to endanger national security.
