Practitioners of alternative medicines have also helped in educating the public on preventative issues and ultimately curative as well. However, a section of the public has raised concerns concerning activities of some practitioners, level of medical training, titles they use, the quality of schools run by some practitioners and the kinds of certificates they issue to trainees. As a practitioner, a staunch advocate of naturopathic medicine and a law student, I am now particular about policies and the legal framework for this industry to help streamline the sector to save the many vulnerable patients and ultimately complement conventional healthcare. This is because no industry is supreme. I believe this would also help to do away with the quack or unqualified practitioners in the system.

The Applicant filed an RTI application dt.20.3.08 with the CPIO, M/o Health & Family Welfare. He requested for information against 7 points with regard to status of Electrohomeopathy including whether the this form of alternative Medicine is recognized or not and whether the Degree/Diploma holder can practice or not. The CPIO replied on 21.4.08 stating that a Standing Committee of Experts was constituted under the Chairmanship of DG, ICMR to consider and give its recommendations on the efficiency/merits of various streams of alternative medicines including electrohomeopathy and also examine feasibility of making legislation as suggested by Hon’ble High Court of Delhi. The Committee developed essential and desirable criteria for grant of recognition of new different streams of alternative medicines within the criteria. The Committee after detailed deliberation did not recommend for recognition of any of these alternative medicines except already recognized traditional systems of medicine viz. Ayurveda, Sidha, Unani, Homeopathy, Yoga and Acupuncture. The Committee, however, recommended that certain practices such as Acupuncture and Hypnotherapy could be allowed to be practiced by registered practitioners or appropriately trained personnel. He also added that recommendations of the Committee were brought to the notice of all the State Govts/UTs for compliance vide letter dt.25.11.03, a copy of which was also enclosed to the Applicant. In my study of Tort, I realized that it has so much to do with what goes on in the health sector, especially with regards to hospital-patient relations. It would seem however that its major concern is with the conventional medical sector. For instance, the case of Bolam v Friern Hospital Management Committee (1957) is the locus classicus when it comes to principles of tortious liability and medical practitioners. In that case, the court enunciated a yardstick (which came to be known as the ―Bolam Test‖) that should be used to ascertain whether or not a hospital/medical practitioner had been negligent in the delivery of his duty to a patient. One wonders however, if the ―Bolam test‟ applies or would apply to alternative medicine practice? If not, what is an appropriate standard for measuring tortious liability among practitioners of alternative medicine? Cases of negligence in the context of alternative medicine are very rare in our law reports and there has not been any such case reported in Ghana to the best of my knowledge.

Most psychiatrists were physicians beholden to their medical training, whose interest in the mind raised questions germane to philosophical inquiry. While they sometimes promoted psychiatry as the most ambitious of the human sciences, their research methods remained materialist. They sought to understand the most traceless and immaterial – and at the same time most human – qualities of the mind and spirit through empirical and positivist experimentation. In many ways, these scientists worked in the umbrage of a long Cartesian shadow, either explicitly or implicitly drawing conclusions about the relationship between mind and matter.
