Special to Brooklyn Daily Eagle Though we have honored our senior citizens with the ti- tle “The Greatest Generation,” when it came to those living in nursing homes during this pan- demic, our actual treatment of them was nothing short of ap- palling. Those unlucky enough to be in a nursing home or oth- er congregate care facility during the pandemic found themselves to be nothing more than sitting ducks, cut off from their families and friends, helpless and hope- less. Beginning in late March, and virtually every day in April and May, concerned res- idents frantically called our of- fices begging for help in learn- ing news about their loved ones, as they were completely locked out from any visitation or other contact. And while we attempt- ed to assuage their fears and al- leviate their frustrations, we were no more able to find out what was happening behind the locked doors of our local nursing Joanne Seminara, Bay Ridge homes than they were. It was all community leader too common for families to hear nothing from the nursing home staff or administration until they got a call that their loved one had died — sometimes days or a week after the fact. This tragic situation is unacceptable and calls our own state gov- ernment’s actions in contributing to this atrocity into question. Unbe- knownst to many elected officials, inserted into New York State budget bill was language that gave immunity to nursing homes for their inability to care for residents and all possible negligent acts or omissions, wheth- er related to COVID or not. This, while family members were locked out and loved ones suffered and died alone. Gov. Andrew Cuomo’s executive order that mandated that already overwhelmed nursing homes take in new patients who had tested posi- tive was a death knell for many residents. Granting nursing homes lim- ited immunity during the COVID crisis might have been reasonable, but why should a resident who falls out of bed and fractures her hip because a facility fails to respond to calls for help, or neglects to put up the bed rails, be denied their common right to bring suit? In the meantime, this crisis has made clear that the time for serious nursing home reform has come. While we must appoint an independent investigator to conduct a thorough review of what happened inside nurs- ing homes when no one from the outside could enter, we also need to ex- amine entrenched deficiencies, including inadequate staffing, poor infec- tion control measures, lack of communication to loved ones and enough personal protective equipment and the failure to meaningfully respond to patient complaints. Facilities cannot remain under prepared for the pro- vision of regular day to day care or the next public health crisis. Finally, we must work with the state government to draft and adopt an enhanced Resident Bill of Rights and shore up woefully inadequate oversight and enforcement. Family members need to be educated about nursing home obligations, ranging from communicating with loved ones to mandatory discharge protocols. The families who had a loved one in a home during the pandemic were not prepared to advocate for their loved ones and log complaints and were overwhelmed by the prospect of navigating a home’s bureau- cracy to obtain basic information. Nursing homes wield enormous pow- er over and responsibility for the health, safety, and welfare of their resi- dents. Residents and families have a right to and deserve accountability. We must do better to protect our Greatest Generation from such dis- proportionate suffering and death and enact measures that will restore and maintain the care and dignity they so richly deserve.

There, family members would gather to recount their days, debate issues, celebrate any oc- casion they could think of — and of course, to eat. Along with basic nourishment, the table pro- vided sustenance for the soul, says Muschett-Ow- es. She’s tried to replicate that feeling at her own restaurant, Katie O’s, which she launched six years ago in nearby Prospect Lefferts Gardens, specializing in soul food. And now, she’s trying to give a little of both — soul food, and food for the soul — back to her community, amidst a pandemic that has exposed just how easy it is to go hungry in New York. Photo: Emilio Morenatti/AP Tuesday, July 21, 2020 • BQ Daily Eagle • 13 CLAIMS OF LEGAL MALPRACTICE CONTINUE FOLLOWING APPEAL Appellate Division, Second Department In an effort to recover damages for legal malpractice, Maurice Keshner filed a complaint against the law firm of Hein Waters & Klein, in Queens County Supreme Court, Civil Term. Hein Waters & Klein moved to dismiss the complaint, and Hon. Leonard Livote granted the motion in an order entered July 26, 2017. Subsequently, Justice Livote granted Keshner’s motion for leave to reargue his opposition to the defendants’ motion to dismiss and, upon reargument, vacated the order granting that branch of the defendants’ prior motion and denied the motion. Hein Waters & Klein appealed, and the justices of the Appellate Division, Second Department affirmed the Hon. Leonard Livote determination of the Supreme Court. In Eagle file photo by Rob Abruzzese their decision, the justices explained that the statute of limitations for a complaint alleging legal malpractice is three years. However, they noted that complaints that would otherwise be barred by the statute of limitations are timely if the doctrine of continuous representation applies. The justices explained that the two prerequisites for continuous representation tolling are a claim of misconduct concerning the manner in which professional services were performed and the ongoing provision of professional services with respect to the contested matter or transaction. In this case, the justices concluded that the law firm met their burden of establishing that the legal malpractice claims were untimely. They found that, in opposition, however, Keshner raised a question of fact as to whether the statute of limitations was tolled by the doctrine of continuous representation. The justices noted that the Supreme Court’s determination in the July 26, 2017 order, which granted the branch of the defendants’ motion which was to dismiss the legal malpractice claims as time­barred, was based on a misapprehension of fact. Thus, the justices agreed with the Supreme Court’s subsequent determination granting Keshner’s motion for leave to reargue and, ultimately, denying the defendants’ motion to dismiss. —Keshner v. Hein Waters & Klein, 2018‐12090, July 15, 2020 APPOINTMENT OF A RECEIVER FOR RENTS AND PROFITS APPROVED Appellate Division, Second Department In the Appellate Division, Second Department, defendant Archibald Bennett appealed from an order rendered by Hon. Carmen Velasquez of Queens County Supreme Court, Civil Term. The order granted Shaw Funding, LP’s motion to appoint a receiver for the rents and profits of the mortgaged premises. The complaint stemmed from a note that Bennett and Lorna Spence (the borrowers) executed in favor of David Cantor and Barry Levites, promising to repay a loan in the amount of $350,000 (the 2007 note). The 2007 note was secured by a mortgage, signed only by Spence, encumbering property located in Queens. On May 15, 2009, the borrowers executed a note in favor of Shaw Funding in the amount of $500,000 (the 2009 Hon. Carmen Velasquez note). That same date, the borrowers Eagle file photo by Andy Katz executed a consolidation and extension agreement (CEA), pursuant to which the 2007 note and a loan made by Shaw Funding to the borrowers in the principal sum of $150,000 were consolidated into a single debt, as evidenced by the 2009 note in the principal sum of $500,000. The CEA further provided that the mortgage executed by Spence securing the 2007 note “shall hereafter constitute a valid first mortgage,” securing the principal sum of $500,000. In addition, the borrowers also executed a rider to the CEA, in which the parties agreed that, upon the borrower’s default, Shaw Funding may “cause a receiver of the rents and profits of the mortgaged property to be appointed without notice.” In May 2016, Shaw Funding filed the mortgage foreclosure proceeding against the borrowers, alleging that they had defaulted on the payment obligations under the 2009 note. Shaw Funding moved to appoint a receiver, and Bennett opposed. Hon. Carmen Velasquez granted Shaw Funding’s motion and appointed a receiver for the rents and profits of the mortgaged premises. Upon Bennett’s appeal, the justices of the Second Department affirmed the order of the lower court finding that the Supreme Court providently exercised its discretion in granting Shaw Funding’s motion to appoint a receiver, as the rider to the CEA provided for such an appointment upon the borrower’s default. In their decision, the justices noted that although a court of equity may exercise its discretion to deny an application for the appointment of a receiver, they found that Bennett failed to show that denial was appropriate in this case. —Shaw Funding, LP v.
