Special attention is given to the status and role of the laity, and the implications of subsidiarity with regard to lay authority and decision-making in the church. Chapter One outlines some problems with ecclesial governance today, discusses the current status and role of the laity, and proposes an application of subsidiarity in the church. Chapter Two provides an overview of how the laity has been understood throughout church history to the present day. This chapter also examines alternative understandings of the laity's nature and place in the church, offered by liberation and feminist theologians, and in response to the priest sexual abuse scandal uncovered in the United States. Chapter Three attends to questions of ecclesiology and authority. The author argues that an examination of the nature of both magisterial and lay authority reveal expanded opportunities for laypersons to exercise substantial authority within the church, the theological foundations of which are grounded in a communio ecclesiology and the sensus fidei. Chapter Four provides a history and development of subsidiarity in the Catholic tradition, including a summary of the arguments at the magisterial level both supporting and contesting the validity of the principle's application in the church. The author asserts that, based on an ecclesiology of communio and a renewed understanding of magisterial and lay authority, subsidiarity is a valid principle with regard to ecclesial ix governance, allowing for laypersons to exercise a substantial role in decision-making in the church. The final chapter places subsidiarity in relationship with the principles of justice, human dignity, the common good, and solidarity; suggests concrete practices that the church might adopt in order to reflect subsidiarity in ecclesial governance; and discusses implications for clergy, laity, and church as a whole. x CHAPTER ONE INTRODUCTION The climate of the Catholic church in the United States today has been profoundly shaped by the priest sexual abuse scandal and the dwindling number of active priests. Both of these phenomena have raised important questions regarding ecclesial governance, authority and accountability, and the role of the laity in the church. Christians are witnessing the advent of an emerging ecumenical paradigm, which, because it is not fully realized, is still realizing its full definition. The paradigm operates in a global context rather than a Eurocentric one, and even as it is more global, it is simultaneously more local. It cultivates shared praxis while being less concerned with the comparison of dogmas. Ecclesiology is also entering a new paradigm which shares many features with its ecumenical counterpart, particularly its global perspective and interest in shared praxis ahead of dogmatic questions. Even though ecumenism and ecclesiology share common trajectories, their journeys are unfolding in largely parallel rather than cooperative and mutually-enriching ways. This raises the question: What opportunities might arise from examining the shifts in ecumenism and ecclesiology together? This article examines how new methodological and practical developments in these two fields can form and inform one another. It studies the shift to synodality in the Catholic Church and the turn towards discernment in the ecumenical sphere as manifestations of similar theological commitments and a common interest in cultivating participatory processes. The seismic changes reshaping the religious landscape are transforming the relationship between ecumenism and ecclesiology; yet a strong connection between them endures and illumines paths forward for the church in the third millennium.

For all disinterested observers, it is a well- Tknown fact that at present the relationship between canon law and moral theology is at best disturbed, at worst downright nonexistent. Yet there should be an organic unity between the two. After all, moral theology defines many of the values canon law is promoting, and canon law creates obligations which have far-reaching consequences in the field of morality. Thus mutual understanding and a well-balanced relationship should be in the interest of both parties. The origins of this present-day alienation are found in the past history of the two sciences. To listen to the moralists, their theology has suffered badly at the hands of the canonists: they tried to make it into a thinly disguised branch of jurisprudence.1 To listen to the canonists, the nature of their rules and regulations has been misunderstood by the moralists: they tended to make them into divine precepts with appropriate sanc­ tions, including eternal damnation.2 All such accusations are, of course, simplifications. Nonetheless, among the unfair generalizations there is a grain of truth. It begins with a brief historical account of sin and penance in Christian history, indicating the long tradition of performing penitential acts in response to the identification of one’s self as a sinner. The dissertation then considers the Thomistic account of sin and the response of penance, which is understood both as a sacrament (which destroys the sin) and as a virtue (the acts of which constitute the matter of the sacrament but also extend to include non-sacramental acts). This serves to provide a framework for understanding the way Catholics in the United States identified sin and sought to amend for it by use of the sacrament of penance as well as non-sacramental penitential acts of the virtue of penance.

Four communicative disjunctions are ways in which, “the Catholic Church today is … out of phase with the world it wants to speak to.”1 Unless and until the influence of Pope Francis permeates the Church at all levels and in all contexts his charismatic leadership cannot be said to have changed this condition altogether. He surely has set a direction away from the clerical culture among bishops that abetted sweeping clergy abuse of minors under a rug of silent re-assignments. Even the Church now represented in the deeds and words of Francis cannot by-pass coming to grips with the disjunctions and with abuse. So George McLean’s theological response to the disjunctions and crisis of abuse remains a valid, long-term project. He advises nothing less than, “… rethinking the entire nature of the Church and its public presence in quite different, indeed kenotic, terms.” 2 That is a tall theological order. 3 What does a theological project of that scope involve? Outlining some directions along which to think about a kenotic theology of the Church draws on more than theological reflection and research.

From January 8th through February 25th, 2014, the Extraordinary General Chapter of the Legion of Christ took place in Rome. His Eminence, Cardinal Velasio De Paolis, CS, and his two counselors, Fr. Gianfranco Ghirlanda, SJ, and Fr. Agostino Montan, CSI, presided. Sixty- one chapter fathers participated, 19 ex officio and 42 elected by the nine territories of the congregation and the centers of Rome. 2. This Extraordinary General Chapter marks the end of the journey of in-depth revision that the congregation has travelled since the apostolic visitation, which took place during 2009- 2010, and the naming of a Pontifical Delegate in the summer of 2010. Our principal tasks in the Chapter, as Pope Benedict XVI1 indicated and as Pope Francis confirmed2, were to revise the Constitutions and to elect a new central government for the congregation. 3. In the first days, in light of the reports that the Pontifical Delegate and the pro-General Director submitted, we focused on analyzing the life of the Congregation since the ordinary General Chapter that took place in 2005. One of the outcomes of the intense exchange of ideas that took place in those days was the communiqué that the Chapter approved on January 20th, 2014, about the journey of renewal of the Congregation.
