Internal Control and Compliance Assessment Legislative Joint Auditing Committee State Agencies Financial and Compliance Audit Section Arkansas Department of Correction June 30, 2010 INTRODUCTION This report is issued to inform the Legislative Joint Auditing Committee of compliance with state fiscal laws and regulations as well as deficiencies in internal controls for the Arkansas Department of Correction. As discussed in the Results of Assessment section below, our procedures disclosed the Agency did not have an acceptable, consistent valuation method for livestock. SCOPE AND METHODOLOGY We performed an internal control and compliance assessment of the Arkansas Department of Correction, a department of Arkansas state government, as of and for the year ended June 30, 2010, and have issued our report dated August 26, 2011. Management of the Agency is responsible for establishing and maintaining internal controls and complying with applicable laws and regulations. The assessment included cash on deposit, cash receipts, expenditures, purchasing, inventories, capital assets, and data entry to the Arkansas Administrative Statewide Information System (AASIS). The assessment consisted principally of inquiries, observations, analytical procedures, and selected tests of internal control policies and procedures, accounting records, and other relevant documents. We relied on financial data in AASIS recorded by the Agency and audit work conducted in the fiscal year 2010 State Comprehensive Annual Financial Report (CAFR) and Single Audit Report. The methodology used in conducting this assessment was developed uniquely for this engagement and, therefore, was more limited in scope than an audit or attestation engagement performed in accordance with Government Auditing Standards issued by the Comptroller General of the United States. -

Transparency. 2 Director’s Letter As Director, it is with sincere pride that I present you with the Arkansas Department of Correction (ADC) Fiscal Year 2018 Annual Report, as required by Ark. Code Ann. 12-27-107. During the fiscal year, the Arkansas Department of Correction jurisdictional count remained at, or near, 18,000 inmates. Our continued implementation of the Think Legacy Reentry Program, college programs, and workforce readiness programs will reduce the number of inmates returning to incarceration after release. During this fiscal year, we also began the construction of additional beds at the Pine Bluff Unit. -

As acknowledged in the Arkansas State Department of Health’s (“ADH”) own guidance, correctional facilities and detention centers . pose a high risk for transmission of COVID- 19” due to their “congregate nature.” See ADH COVID-19: Guidance for State Correctional Facilities and Local Detention Facilities, dated Mar. 27, 2020 (“3/27/20 ADH Guidance, Def. Ex. 10”) (Dkt. No. 36-10). Thus, Defendants knew that, unless they fully prepared to take swift and systemwide action in the face of the greatest pandemic in modern history, it would only be a matter of time before COVID-19 would infect staff, incarcerated people, or both, with likely serious injury and possible death to follow. And the blueprint for this swift and systemwide action was laid out by the Centers for Disease Control and Prevention’s (“CDC”) guidance, which is specifically geared towards correctional facilities and identifies in detail the steps that Defendants should take in order to stem and mitigate the spread of COVID-19. -

Arkansas Department of Correction Annual Report FY 2015 Arkansas Department Of Correction FY2015FY2015 Director‟s Message: A As Director of the Arkansas Department of Correction, I am pleased to submit the ADC Fiscal Year A 2015 Annual Report, a showcase of different initiatives and agency accomplishments achieved in FY15. For another Fiscal Year, the Arkansas Department of Correction experienced an increase in the nnual Report inmate population. Our jurisdictional count reached over 18,000 inmates. Populations and challenges nnual Report may change from year to year throughout our facilities but our commitment to excellence has not changed. Although an expanding inmate population can present challenges to ADC professionals, the primary goal is to provide the best in correctional services at the lowest possible cost for the citizens of Arkansas. The ADC received „checks‟ symbolic of energy savings and incentives from CenterPoint Energy and Entergy. The checks for energy efficiency incentives total close to $400,000 from all efforts combined and amount to savings of about $2.8 million. Down on the farm, the layer operation came into production at the Cummins Unit. Eggs from one of the three layer houses will be used to feed the entire inmate population, while eggs from the other two layer houses will be sold to county jails or prisons in other states. This agricultural work opportunity is just one of the many programs provided to the inmates to strengthen their work ethic. The Arkansas Department of Correction provides various other treatment programs, work opportunities, education programs and vocational training while providing for public safety and carrying out the mandates of the courts. -

DEPARTMENT OF CORRECTION Enabling Laws Act 266 of 2016 A.C.A. §12-27-101 et seq. History and Organization In 1838, Governor James S. Conway signed legislation establishing the State Penitentiary. Today, the Department of Correction’s Mission statement is to: Provide public safety by carrying out the mandates of the courts; Provide a safe, humane environment for staff and inmates; Provide programs to strengthen the work ethic; and Provide opportunities for spiritual, mental, and physical growth. The Board of Corrections has constitutional and supervisory power and control over the Arkansas Department of Correction. The Board has seven voting members including the Parole Board Chair, five citizen members and one criminal justice faculty member employed at a four- year Arkansas university. Each member is appointed by the Governor and serves a seven-year term. The Department’s Director reports directly to the Board as the agency’s chief executive, administrative and fiscal officer. The Director is responsible for the agency’s philosophy, mission and operations. The Department has six Deputy or Assistant Directors that oversee various areas: . Institutions (Correctional Facilities) are divided between the Chief Deputy Director who is responsible for Varner/Supermax, Cummins, East Arkansas Regional Unit, the Wrightsville Complex, the Pine Bluff Complex, and the Tucker Unit along with the ADC Farm Program, Emergency Preparedness and the K-9 Units; and the Deputy Director for Institutions who is responsible for the Ouachita River Unit, the Newport Complex (Grimes and McPherson), the North Central Unit, the Delta Unit, and the four work release units: Benton, North West (Springdale), Mississippi County, and Texarkana. -

Transparency. 2 Message from the Director I am pleased to submit the ADC Fiscal Year 2017 Annual Report, as required by Ark. Code Ann. 12-27-107. The Arkansas Department of Correction continued to experience growth in the inmate population during FY17 with the jurisdictional remaining over 17,000 inmates. During this fiscal year, we continued to work on Reentry and Restrictive Housing goals. One Reentry success is our Think Legacy program utilizing an evidenced-based “Thinking for a Change” program developed by NIC.
