At a time when the U.S. has been weighed down by its slowest recovery since the Great Depression, when Europe’s currency threatens its union and, I might add when our critics flood the field with stories that refuse to move beyond the misdeeds at two of our papers in Britain, I am delighted to report something about News Corporation you Rupert Murdoch, Chairman and Chief Executive Officer might not know from the headlines: News Corporation In 2012, for the second year in a row, we have brought our stockholders double-digit growth in total segment operating income. FOR THE SECOND We accomplished this because we do not consider ourselves a conventional YEAR IN A ROW, company. -

In 1983, 50 corporations controlled the vast majority of all news media in the U.S. At the time, Ben Bagdikian was called "alarmist" for pointing this out in his book, The Media Monopoly . In his 4th edition, published in 1992, he wrote "in the U.S., fewer than two dozen of these extraordinary creatures own and operate 90% of the mass media" -- controlling almost all of America's newspapers, magazines, TV and radio stations, books, records, movies, videos, wire services and photo agencies. He predicted then that eventually this number would fall to about half a dozen companies. This was greeted with skepticism at the time. When the 6th edition of The Media Monopoly was published in 2000, the number had fallen to six. Since then, there have been more mergers and the scope has expanded to include new media like the Internet market. More than 1 in 4 Internet users in the U.S. now log in with AOL Time-Warner, the world's largest media corporation. In 2004, Bagdikian's revised and expanded book, The New Media Monopoly , shows that only 5 huge corporations -- Time Warner, Disney, Murdoch's News Corporation, Bertelsmann of Germany, and Viacom (formerly CBS) -- now control most of the media industry in the U.S. General Electric's NBC is a close sixth. Amazon's Antitrust Paradox
LINA M. KHAN Amazon’s Antitrust Paradox abstract. Amazon is the titan of twenty-first century commerce. In addition to being a re- tailer, it is now a marketing platform, a delivery and logistics network, a payment service, a credit lender, an auction house, a major book publisher, a producer of television and films, a fashion designer, a hardware manufacturer, and a leading host of cloud server space. Although Amazon has clocked staggering growth, it generates meager profits, choosing to price below-cost and ex- pand widely instead. Through this strategy, the company has positioned itself at the center of e- commerce and now serves as essential infrastructure for a host of other businesses that depend upon it. Elements of the firm’s structure and conduct pose anticompetitive concerns—yet it has escaped antitrust scrutiny. This Note argues that the current framework in antitrust—specifically its pegging competi- tion to “consumer welfare,” defined as short-term price effects—is unequipped to capture the ar- chitecture of market power in the modern economy. We cannot cognize the potential harms to competition posed by Amazon’s dominance if we measure competition primarily through price and output. Specifically, current doctrine underappreciates the risk of predatory pricing and how integration across distinct business lines may prove anticompetitive. These concerns are height- ened in the context of online platforms for two reasons. First, the economics of platform markets create incentives for a company to pursue growth over profits, a strategy that investors have re- warded. Under these conditions, predatory pricing becomes highly rational—even as existing doctrine treats it as irrational and therefore implausible. -

I have a confession to make. I’m in therapy. It has been about 40 hours now since I witnessed Scotland lose to Australia in the dying moments on Sunday. I’ve no idea what it was like to be a neutral, but it is many years since I have heard the whole of Murrayfield chanting Scotland Scotland as one – and I don’t think we’ve ever heard that particular roar at Twickenham. For 80 glorious minutes, those bloody chariots were impounded in a secure facility somewhere off the M4. It was a magnificent day. It was an incredible story. For a moment we dreamed: were off to face Argentina in the semis…we could have them…and then you’re just a noravirus outbreak in the All Black dressing room from winning the World Cup. It was not to be. But what a day. What a story. And after tuning into non-stop abuse on social media, I quickly graduated to newspapers and their websites. What were the pundits saying? Why had the South African referee Craig Joubert got it so wrong? Why hadn’t he used the TMO (turns out he was right not to, but I needed a newspaper to clear it up for me), why had he run off the pitch like a scalded cat, not shaking a single player’s hand in the process? Why is it so hard being Scottish? Then I came across this snippet of brilliance from my colleagues on The Daily Telegraph in Sydney – the cheeky bastards had made Joubert man of the match. -

Media scion James Murdoch quits News Corp board 1 August 2020 Disney acquired most of the group's assets. James Murdoch, 47, has recently been critical of his father's business and its media coverage. In January, he denounced the climate change skepticism of some Murdoch media, citing coverage of the fires which devastated large parts of Australia. He has launched his own private holding company called Lupa Systems, which among other things has taken a stake in Vice Media. "We're grateful to James for his many years of James Murdoch, who has resigned from News Corp, has service to the company. We wish him the very best been critical of the business and its media coverage in his future endeavors," said Rupert Murdoch, executive chairman of News Corp and James's brother Lachlan Murdoch in a statement. Former 21st Century Fox chief executive James © 2020 AFP Murdoch, son of media tycoon Rupert Murdoch, has resigned from News Corp's board, according to a document released Friday by the US Securities and Exchange Commission (SEC). A letter sent by James Murdoch to the board said the decision was due to "disagreements over certain editorial content published by the company's news outlets and certain other strategic decisions." News Corp owns the Wall Street Journal, the New York Post, The Times and the Sun newspapers among others, but not Rupert Murdoch's Fox News network. James Murdoch was once seen as his father's successor, but Friday's move reinforces his disengagement from the family media empire, which grew from a newspaper group in Australia. -

The Rules of #MeToo Jessica A. Clarke† ABSTRACT Two revelations are central to the meaning of the #MeToo movement. First, sexual harassment and assault are ubiquitous. And second, traditional legal procedures have failed to redress these problems. In the absence of effective formal legal pro- cedures, a set of ad hoc processes have emerged for managing claims of sexual har- assment and assault against persons in high-level positions in business, media, and government. This Article sketches out the features of this informal process, in which journalists expose misconduct and employers, voters, audiences, consumers, or professional organizations are called upon to remove the accused from a position of power. Although this process exists largely in the shadow of the law, it has at- tracted criticisms in a legal register. President Trump tapped into a vein of popular backlash against the #MeToo movement in arguing that it is “a very scary time for young men in America” because “somebody could accuse you of something and you’re automatically guilty.” Yet this is not an apt characterization of #MeToo’s paradigm cases. -

Before the Murdoch takeover: new evidence indicating the need for a further “Fit and Proper” review AVAAZ, 8th March 2017. Submission for Karen Bradley, Secretary of State for Culture Media and Sport Introduction An acquisition of Sky Plc. by 21st Century Fox (21CF) would result in a major expansion of the influence of the Murdoch Family Trust (MFT) over Sky. In 2012 Ofcom was highly critical of the role of James Murdoch who was CEO and Chairman of News International during the period of criminal and other reprehensible conduct at that organisation. This submission details a long list of wrongdoings and criminal misgovernance that has emerged since Ofcom reviewed the licenses held by BSkyB in 2012. It also draws attention to an unfolding sexual harassment epidemic being unearthed at Fox News in the US. The Secretary of State notes in her 6th March 2017 letter1 to 21CF and Sky that 21CF’s record of compliance with the broadcasting code might reflect on the culture or corporate governance at 21CF. The “huge failings of corporate governance” at News Corporation, the precursor company to 21CF were noted in the Culture, Media and Sport Committee on News International and Phone Hacking and the Secretary of State herself acknowledges that James Murdoch’s actions during this time was a “failure of corporate governance.” The shocking scale of corporate misgovernance and criminal conduct make it incumbent upon the Secretary of State to exercise her powers under Section 58(3) of the Communications Act 2003, to refer the Sky bid on broader public interest grounds than those she currently says she is minded to exercise. -

The Donald Trump-Rupert Murdoch relationship in the United States When Donald Trump ran as a candidate for the Republican presidential nomination, Rupert Murdoch was reported to be initially opposed to him, so the Wall Street Journal and the New York Post were too.1 However, Roger Ailes and Murdoch fell out because Ailes wanted to give more positive coverage to Trump on Fox News.2 Soon afterwards, however, Fox News turned more negative towards Trump.3 As Trump emerged as the inevitable winner of the race for the nomination, Murdoch’s attitude towards Trump appeared to shift, as did his US news outlets.4 Once Trump became the nominee, he and Rupert Murdoch effectively concluded an alliance of mutual benefit: Murdoch’s news outlets would help get Trump elected, and then Trump would use his powers as president in ways that supported Rupert Murdoch’s interests. An early signal of this coming together was Trump’s public attacks on the AT&T-Time Warner merger, 21st Century Fox having tried but failed to acquire Time Warner previously in 2014. Over the last year and a half, Fox News has been the major TV news supporter of Donald Trump. Its coverage has displayed extreme bias in his favour, offering fawning coverage of his actions and downplaying or rubbishing news stories damaging to him, while also leading attacks against Donald Trump’s opponent in the 2016 presidential election, Hillary Clinton. Ofcom itself ruled that several Sean Hannity programmes in August 2016 were so biased in favour of Donald Trump and against Hillary Clinton that they breached UK impartiality rules.5 During this period, Rupert Murdoch has been CEO of Fox News, in which position he is also 1 See e.g. -
