BACKGROUND

1. On 11 January 1982 we were asked by Worcester City Council to undertake a review of the City's boundaries with the districts of Malvern Hills and Wychavon. The City

Council's outline scheme suggested that the A449(T) and the M5 Motorway should form the City's northern and eastern boundaries respectively and also that there should be minor adjustments to the south-east and west of the city.

2. We considered the request, as required by section 48(5) of the Local Government

Act 1972, having regard to Department of the Environment Circular 33/78. We decided that we should undertake a review and we announced our intention in a letter to

Worcester City Council on 28 July 1982 in which we asked them to publish and submit to us a detailed scheme for the boundary changes sought. Copies of the letter were sent to those persons and bodies listed in Annex A to this report.

THE DRAFT SCHEME

3. Worcester City Council submitted their detailed scheme to us on 9 March 1983.

The submission of the scheme was published in the local press and by public notice.

The changes sought were identical to those set out in the outline scheme. As far as the boundary with was concerned, the detailed scheme proposed a minor adjustment so as to bring wholly into the city the small part of the Beaconhill Drive estate at present divided between the two districts.

4. Of the suggested changes to the Worcester/Wychavon boundary, the most substantial ones were to the north of the city area, where the scheme proposed the transfer to

Worcester of an area of North Claines parish containing an electorate of about 9"40 people.

It was stated that the residential areas were Worcester-related and that the existing boundary divided the Blackpole Trading Estate between two districts. The A449{T) was put forward as a potentially well-defined boundary, although it was conceded that this would mean the inclusion of a rural area immediately south of the road. The use of the A449(T) until its junction with the M5 would also entail the transfer to Wychavon of a small area containing a sports club and the County Highways Depot.

5. The scheme suggested that the M5 should form the city's eastern boundary as far north as the A422 Spetchley Road; this would entail the exchange of uninhabited areas of land between Worcester and Wychavon, It was also suggested that a small number of properties along a strip of land at Swinesherd to the north of the A422

(at present within the Parish of Whittington) should be included within the city.

6. Finally, the scheme proposed the removal of two boundary anomalies around the

Royal Worcester College for the Blind and the Electricity Board Training

College.

OUR DRAFT PROPOSALS

7. County Council and Malvern Hills District Council had previously indicated their support for the scheme. We received objections from

Wychavon District Council, North Claines Parish Council, Whittington Parish Council, and about thirty local residents. The District Council's objections were mostly to the loss of the part of North Claines parish to the north of the city and .were based mainly on the implications of possible development in an area proposed as Green Belt.

As far as the Blackpole Trading Estate was concerned they pointed out that the two parts were separated by the -Worcester canal which they considered a satisfactory boundary. North Claines Parish Council contended that there was no justification for the suggested changes, while local residents feared higher rates and increased development. Whittington Parish Council saw no community of interest between the city and the properties at Swinesherd.

8. We considered the City Council's scheme and the objections to it. On the basis of the information before us we decided that we should formulate draft proposals based substantially on the boundaries suggested by the City Council. 9. Our draft proposals for changes to the boundaries between Worcester City and the districts of Wychavon and Malvern Hills were published on 24 July 1984 in a letter to all three Councils. Copies of the letter were sent to all those persons and bodies who had received our previous consultation letter or who had sent comments on the draft scheme. Copies of the draft proposals were deposited for inspection at the main offices of the addressees of our letter. Comments were invited by 25 September 1984.

RESPONSE TO OUR DRAFT PROPOSALS

10. In response to our draft,proposals, we received letters from Hereford and

Worcester County Council, Worcester City Council, Wychavon District Council,

North Claines Parish Council, Whittington Parish Council, Parish Council,

Eric Forth MP, the Mid- Conservative Association and three commercial organisations. 159 letters of objection were received from local residents.

11. Hereford and Worcester County Council supported the majority of our proposals but it was now their view that the area of the Parish of North Claines west of the

Worcester-Birmingham railway should not be transferred to Worcester. The County

Council stated that as this area was predominantly agricultural land within a proposed Green Belt and in their opinion unlikely to be developed, it would have no common interest with the city.

Wychavon District Council urged that we withdraw our draft proposals in the face of overwhelming opposition demonstrated by the parish councils and the residents affected in the parishes of North Claines and Whittington, They were also particularly concerned about the future use of land to the north of the City.

They argued that the City Council's primary purpose was to seek land for development, while they themselves had been long committed to the protection of this area, part of which they stated was subject to Green Belt policy. The District Council also set out their view of the financial consequences; they estimated that the loss of rateable value could lead to an £80,000 reduction in rate Income, although they considered this would probably be more than offset by an increase in block grant.

13. North Claines Parish Council were totally opposed to the proposals affecting their parish. They could see no justification for the expansion of the city at their expense, for the purpose of development in what they regarded as an essential rural C^een Belt between Droitwich and Worcester. They said .that at a crowded public meeting to discuss the draft prcposals, residents were clearly very concerned about the possible destruction of village comnities and the rural way of life.

14. The District Council and Parish Council were supported in their objections by the

Mid-Worcestershire Constituency Conservative Association. The MP for that constituency,

Mr Forth, criticised the absence of any stated reasons for the City Council's scheme and our draft proposals; he also pointed to the loss of rate revenue to Wychavon

District Council if the Blackpole Trading Estate was transferred to Worcester.

15. All the residents who wrote to us were opposed to the proposals. The majority of them perceived no benefit from the proposed change and foresaw increased rates and development. It was also stated that the use of the A449(T) as a district boundary would be divisive of a scattered Claines village community on both sides of the road; they feared that its identity would be submerged in a future coalescence of the city area with the large village of (also in the'parish of North Claines, north of the A449(T)). Residents were said to look as. much to Droitwich as to Worcester for services.

16. We also received three objections from firms on the Trading Estate, mainly on the grounds that changes would be detrimental to the environment and would cause an increase in rates. 17. Warndon Parish Council (in the City of Worcester) understood the advantages of better-defined boundaries but pointed out that the proposed transfer to Wychavon

District of the part of their parish containing the County Highways Depot would reduce their rate resources by one third.

18. Our proposed boundary changes in the Swinesherd area were opposed by

Whittington Parish Council who stated that they were contrary to public opinion; they also felt this was a historic boundary and should not be altered. They further disagreed with the other proposed boundary adjustments in their parish.

19. There was one objection to the proposed changes to the Malvern Hills/

Worcester boundary from agents on behalf of the owners of a field which would as . a result be transferred to Malvern Hills District, on the grounds that it would be detrimental to their interests.

OUR FINAL PROPOSALS

20. As required by section 60(2) of the Act, we have reassessed our draft proposals

in the light of the representations we have received. There were no specific objections to our proposed realignment of part of the Worcester/Wychavon boundary

along the M5, to the east of the City, and there was only one objection to the proposed change to the Malvern Hills/Worcester boundary, to the west. We can see no valid objection to these proposals and have decided to adhere to them.

21. The County Council, which had previously raised no objections to the suggested

changes, were now opposed to the transfer of areas south of the A449(T) on the grounds that there was no further potential for development and therefore no community of interest with Worcester. This does not seem to us to take account of

development that has already taken place across and beyond the present boundary.

Although it was suggested by North Claihes Parish Council that some of the houses could be distinguished in character from those in the city area, we would expect such continuous development, some of which is accessible only from within the city area, to create a community of interest sufficient to make its transfer to Worcester desirable in the interests of effective and convenient local government. In a similar way we consider that there is a reasonable presumption that the Trading

Estate as a whole, together with the nearby housing, would be more effectively administered by one district council than two.

22. The possibility of increased rates was clearly a worry for many of those who wrote to us but, while we understood their concern, we would not regard the relative level of rates (which can change from year to year) as something which should affect our judgement. The fear of further development was also in the forefront of many people's minds and both Wychavon District Council and North Claines Parish Council were opposed to the possibility of areas of Green Belt coming within the distirct' of a local authority they regarded as anxious to promote development. But further development does not seem to us to be a relevant issue either. While there may be differences of approach between one district council and another, it seems to us that planning decisions of this kind will necessarily be taken against the background of county planning policy, and this seems to be confirmed by the comments of the County Council.

In our view, there is no inherent reason to suppose that areas of Green Belt should not be entrusted to a predominantly urban authority.

23. It is our conclusion, therefore, that the development in the areas south of the

A449{T) produces powerful arguments in favour of the changes proposed. We acknowledge that there is also a rural area involved and we have been concerned by the views expressed by some local residents about the possible effect on the community around the village of Claines of the use of the A449(T) as a boundary. However, it seems to us that little of the village is to be found north of the road and a boundary based on it would not have any serious additional divisive effect beyond that created by the road itself. In the absence of any other readily identifiable boundary which would not have to be drawn very tightly around existing development, we have decided on balance that the A449(T), which elsewhere marks a clear division between communities, should form the boundary and that it should do so until its junction with the M5. We do not consider that Warndon Parish Council's expressed concern about the consequential loss of its rate resources should override the need for a clearly recognisable boundary

24. We recognise there has been substantial opposition to our proposals in the

North Claines area (and both Wychavon District Council and Whittington Parish Council have referred to similar opposition in the areas south-east of the city). We also recognised that the population affected would no longer have the benefit of parish status. However we judge much of that opposition to be based on apprehension about the planning and rating consequences which, while understandable, should not in our view be allowed to affect our judgement of changes that we otherwise see as clearly being in the interests of effective and convenient local government.

25. We have therefore decided, having taken into account all the representations made to us, that we should confirm our draft proposals as our final proposals.

CONSEQUENTIAL ELECTORAL ARRANGEMENTS

26. We considered the electoral consequences of our proposals. In view of the resulting reduction in electorate in the Claines Central and West district ward we decided that the potential over-representation at district level would be prevented by merging this ward with the Claines East district ward to form a new combined two member North Claines ward.

27. Details of our final proposals are set out in Schedules 1-3 to this report:

Schedule 1 specifies the proposed changes in local authority areas and Schedules 2 and 3 the consequential adjustments to the existing electoral arrangements at district and county level. The proposed boundaries are shown on the large scale map being sent separately to your department. PUBLICATION

28. Separate letters enclosing copies of this report and of the large scale map,

are being sent to Worcester City Council, Malvern Hills District Council and

Wychavon District Council asking them to place copies of this report on deposit

at their main offices and to put notices to this effect on public notice boards

and in the local press. The text of the notices will refer to your power to make

an Order implementing the proposals, if you think fit, after the expiry of six

weeks from the date they are submitted to you; it will suggest that any comments

on the proposals should therefore be addressed to you, in writing, preferably

within six weeks of the date of the letter. Copies of this report, which includes

a small scale sketch plan, are also being sent to those who received the

consultation letter. LS

SCHEDULE 2 : revised District electoral arrangements, consequent upon the proposals described in Schedule 1.

1. It is proposed that the District Wards, as defined in the City of Worcester (Electoral Arrangements) Order 1977 and the District of Malvern Kills (Electoral Arrangements) Order 1976, shall be altered as described below.

Areas A, C and E, as described in Schedule 1, shall be transferred from the Hallow Ward of Malvern Hills District to the St Clement Ward of the

City of Worcester.

Areas B and D, as described in Schedule 1, shall be transferred from the

St Clement Ward of the City of Worcester to the Hallow Ward of Malvern

Hills District.

2. It is proposed that the District Wards, as defined in the City of Worcester (Electoral Arrangements) Order 1977 and the District of Wychavon (Electoral Arrangements) Order 1978» shall be altered as described below.

The Claines Central and West Ward and the Claines East Ward of Wychavon

District shall be amalgamated to form a single District Ward to be known as North Claines.

This Ward shall return two members to the District Council. 10

Areas F and G, as described in Schedule 1, shall be transferred from the

Claines Ward of the City of Worcester to the proposed North Claines-Ward of Wychavon District.

Area H1, as described in Schedule 1, shall be transferred from the existing

Claines Central and West Ward of Wychavon District to the Claines Ward of the City of Worcester.

Area H2, as described in Schedule 1, shall be transferred from the existing

Claines East Ward of Wychavon District to the Claines Ward of the City of

Worcester.

Area H3, as described in Schedule 1, shall be transferred from the existing

Claines East Ward of Wychavon District to the St Martin Ward of the City of Worcester.

Areas J and L, as described in Schedule 1, shall be transferred from the

Lovett Ward of Wychavon District to the St Martin Ward of the City of

Worcester.

Area K, as described in Schedule 1, shall be transferred from the St

Martin Ward of the City of Worcester to the Lovett Ward of Wychavon

District.

Area M1, as described in Schedule 1, shall be transferred from the St Martin Ward of the City of Worcester to the Bowbrook Ward of Wychavon District. 11

Areas M2 and Q as described in Schedule 1, shall be transferred from the St Martin Ward of the City of Worcester to the Spetchley Ward of

Wychavon District.

Areas N, P, R1' and R2> as described in Schedule 1, shall be transferred from the Spatchley Ward of Wychavon District to the St Martin Ward of the

City of Worcester.

Area S, as described in Schedule 1, shall be transferred from the Spatchley

Ward of Wychavon District to the St Peter Ward of the City of Worcester.

Area T, as described in_Schedule 1, shall be transferred from the St Peter

Ward of the City of Worcester to the Spetchley Ward of Wychavon District.

It is proposed that the County Electoral Divisions, as defined in the County of Hereford and Worcester (Electoral Arrangements) Order 1983 (Operative on 2 5 85), shall be altered as described below.

Areas A, C and E, as described in Schedule 1, shall be transferred from the Hallow ED to the St Clement ED. 12

Areas B and D, as described in Schedule 1, shall be transferred from the

St Clement ED to the Hallow ED.

Areas F and G, as described in Schedule 1, shall be transferred from the

Claines ED to the Droitwich Rural ED.

Areas HI and K2, as described in Schedule 1, shall be transferred from the Droitwich Rural ED to the'Claines ED.

Area H3, as described in Schedule 1, shall be transferred from the

Droitwich Rural ED to the St Martin ED.

Areas J, L, N, P, H1 and R2, as described in Schedule 1, shall be transferred from the Bowbrook ED to the St Martin ED.

Areas K, M1, M2 and Q as described in Schedule 1, shall be transferred from the St Martin ED to the Bowbrook ED.

Area S, as described in Schedule 1, shall be transferred from the

Bowbrook ED to the St Peter ED.

Area T, as described in Schedule 1, shall be transferred from the
