Inclusive Dates: 1841-1991, bulk 1971-1995 Scope & Content: Record Group 190, Governor’s Extradition Files, contains 90 boxes spanning the years 1841-1995, beginning with Governor James C. Jones and ending with Governor Ned McWherter. The earliest extradition files consist mostly of correspondence between various state governors requesting the return of fugitives. Starting with Series X, the files are arranged chronologically by governor and then alphabetically by surname of extraditee. Numerous files include the fugitive’s alias names. These files are primarily composed of correspondence between state officials requesting the return of fugitives, as well as warrants, appearance bonds, and other legal documents that are required for extradition purposes. Series XI contains rendition warrants and extradition waivers. These files differ from others in that these fugitives agree to voluntarily return to the state where they committed the crime. Therefore the formal extraditions are waived. 1 Physical Description/Extent: 44.75 cubic feet Accession/Record Group Number: RG 190 Language: English Permanent Location: LXXII-A-3-C-3 Repository: Tennessee State Library and Archives, 403 Seventh Avenue North, Nashville, Tennessee, 37243-0312 Administrative/Biographical History According to Title 40, Chapter 9, it is the Governor's duty to cause arrest and extradition of fugitives: “Subject to the qualifications of this chapter and the provisions of the Constitution of the United States controlling, and acts of congress in pursuance of the United States Constitution, it is the duty of the governor of this state to have arrested and delivered up to the executive authority of any other state any person charged in that state with treason, a felony or another crime, who has fled from justice and is found in this state.” In addition, according to the Tennessee Constitution, Article III, Section 17, the Governor sends all extraditions files to the Secretary of State. “A Secretary of State shall be appointed by joint vote of the General Assembly and commissioned during the term of four years; he shall keep a fair register of all the official acts and proceedings of the Governor; and shall, when required lay the same, and all papers, minutes and vouchers relative thereto, before the General Assembly; and shall perform such other duties as shall be enjoined by law.” 2 Organization/Arrangement of Materials Series I Governor James C.
