Due to the help of many individuals, I bypassed much of the red tape and bureaucratic "channels" (truly the bane of researchers in Latin American countries) that otherwise would have made life so much more difficult and less pleasurable. With this frame, the war between Bolivia and Paraguay over the Northern Chaco region (1932–1935) emerges as a paradigmatic conflict that many in the Americas interpreted as resulting from the conspiracy man- oeuvres of foreign oil interests to grab land supposedly rich in oil. At the heart of such interpretation, projected by those critical of the fratricidal war, were partial and extrapolated facts, which sidelined the weight of long-term disputes between these South American countries traumatised by previous international wars resulting in humiliating defeats and territorial losses, and thus prone to welcome warfare to bolster national pride and overcome the memory of past debacles. -

This article aims to disentangle the relationship between the media and legislative behavior in foreign policy, using Paraguay as a case study. We analyze the level of public debate on international affairs, measured by the frequency of news in the newspaperABC Color in the six months before the roll-call votes on the Chamber of Deputies of Paraguay. The literature on Latin American studies finds a lack of parliamentary interest in foreign affairs due to low voter attention to this subject, and therefore a low impact on reelections. We find the relationship between parliamentary polarization and public interest in a bill to be mediated by mass media. After estimating a Tobit model, we observe a significant and positive relationship between the news coverage a law receives and the degree of polarization among parliamentarians. Thus, our empirical evidence contradicts the idea that there is a lack of electoral interest in foreign policy. We confirm this finding through qualitative data gathered from in-depth interviews. -

PART I INTRODUCTION TO THE INTER-AMERICAN SYSTEM FOR THE PROTECTION OF HUMAN RIGHTS PART I: INTRODUCTION TO THE INTER-AMERICAN SYSTEM FOR THE PROTECTION OF HUMAN RIGHTS 1.1 The Organization of American States: The Development of the Human Rights System The Organization of American States (“OAS” or “the Organization”) is a regional inter-governmental organization which includes thirty-five Member States: the independent nations of North, Central and South America and the Caribbean.1 Cuba remains a member, but its Government has been excluded from participation in the OAS since 1962. The OAS has also granted Permanent Observer status to fifty-seven States and to the European Union. The OAS Charter (“Charter”), the Organization’s constituting instrument, is a multilateral treaty that was adopted and opened for signature in Bogotá, Colombia in 1948; it entered into force in December 1951.2 The Charter was subsequently amended by the Protocol of Buenos Aires in 19673 and by the Protocol of Cartagena de Indias in 1985.4 In 1992 and 1993, two additional amending Protocols were signed: the Protocol of Washington5 and the Protocol of Managua.6 The Protocol of Washington entered into force in 1997 once it was ratified by two-thirds of the Member States, and the Protocol of Managua came into force on January 29, 1996. The Charter makes very few express references to human rights. Article 3(l) establishes that the “American States proclaim the fundamental rights of the individual without distinction as to race, nationality, creed, or sex.” Article -

Law As The Handmaid of Politics: The Case of Paraguay by Mario Ramos-Reyes, Ph.D. Abstract What is the role of law in Latin America? And, what is the role of culture? The recent history of the Republic of Paraguay serves as a useful case study to address these questions. The historical facts are beyond dispute. Paraguay has had three different Constitutions over the past seventy years but one fundamental question remains unresolved. To what extent is a paternalistic-nationalistic form of executive power, ranging from the “inorganic” (Rousseaunian) character to the heavy influence of the “caudillista” style influence the legal system? Professor Ramos-Reyes, an expert in Latin American politics, explores how political needs and cultural aspirations have influenced the shape of the diverse legal forms of the executive power, mainly but not exclusively on the Paraguayan experience since the 1930s. What were the ideas behind the periodic changes of constitutions? Does it follow then that constitutions may be changed for the sake of political expediency to support and legitimize non-democratic values? The current realities of Paraguay in particular and Latin America in general, seem to support the author’s thesis. “What confuses the spirit even more is the use that [people] make of these words: democracy, democratic institutions, democratic government. If we do not define them clearly, and understand these definitions, we will live in a confusion of inextricable ideas, benefiting all demagogues and despots.” Alexis de Tocqueville1 A. Washington D.C.: Georgetown University Press, 2004. 320 pp. International human rights doctrine and international law have increasingly come to recognize that the international community has an interest in and responsibility to uphold fundamental human rights. This recognition means that states have come under increasing scrutiny for the way in which they treat their own citizens. Although some scholars continue to maintain that universal human rights do not challenge national sovereignty or state control (for example, see Krasner 2001), the immunity that state officials enjoyed from external interference in their domestic affairs has eroded quite significantly over the past fifteen years. As Andrea Bianchi notes, “while state sovereignty remains one of the pillars on which the system hinges, its actual content has undergone a gradual process of erosion. Matters which once indisputably belonged to the domestic jurisdiction of states, such as the way a state treats persons under its jurisdiction, nowadays may be the object of international scrutiny” (Bianchi 1999: 117). While realists dismiss such scrutiny as meaningless and ineffectual, they fail to recognize that casting a spotlight on violations of internationally recognized human rights is the first step in holding violators accountable for their actions. Although it ultimately remains the responsibility of national governments to make respect for human rights effective, the international human rights community wields significant power in its ability to “name and shame” violators. -
