Faulconbridge NSW 2776 1 2 Foreword Of all the ships that have flown the ensign of the Royal Australian Navy, there has never been one quite like the first HMAS Perth, a cruiser of the Second World War. In her short life of just less than three years as an Australian warship she sailed all the world’s great oceans, from the icy wastes of the North Atlantic to the steamy heat of the Indian Ocean and the far blue horizons of the Pacific. She survived a hurricane in the Caribbean and months of Italian and German bombing in the Mediterranean. One bomb hit her and nearly sank her. She fought the Italians at the Battle of Matapan in March, 1941, which was the last great fleet action of the British Royal Navy, and she was present in June that year off Syria when the three Australian services - Army, RAN and RAAF - fought together for the first time. Eventually, she was sunk in a heroic battle against an overwhelming Japanese force in the Java Sea off Indonesia in 1942. Fast and powerful and modern for her times, Perth was a light cruiser of some 7,000 tonnes, with a main armament of eight 6- inch guns, and a top speed of about 34 knots. She had a crew of about 650 men, give or take, most of them young men in their twenties.

The war left so many issues unhandled, one such issue is the theme of this thesis, and that is to analyze legal regime that is governing sunken warships. Status of warship still in service is protected by international law and national law of the flag State, stipulating that warships are entitled to sovereign immunity. The question arises whether or not such sovereign immunity status follows warship wreck? Contemporary international law regulates very little considering ”sovereign wrecks‘, but customary international law, municipal court decisions and State practices are addressing issues quite profoundly, stating that even the warship is no longer in service it is still entitled to sovereign immunity status. HMAS Perth is Australian owned warship whose wreck current location is within Indonesian Territorial Sea. Recent reports show that commercial salvaging has been done, provoking outrage amongst surviving HMAS 3erth‘s naval personnel and Australian historians.     CALL THE HANDS NHSA DIGITAL NEWSLETTER Issue No.11 August 2017 From the President Welcome to the 11th edition of Call the Hands, a newsletter for Society members and the broader Navy Family. A large part of this edition and the accompanying Occasional Papers is contributed by readers, members and volunteers which is greatly appreciated as your stories are generally untold. The Society continued support for Navy with Treasurer, Nick Horspool attending the graduation of New Entry Officers Course (NEOC) 56 at HMAS Creswell and presenting the naval history essay prize. Long term member and volunteer, Leyland Wilkinson represented the Society at a ceremony in Iluka, NSW for the unveiling of a plaque to to HMAS Waree a steam tug which was wrecked there on 17 October 1946. Following receipt of a Community Heritage and Icons Grant from the Department of Environment and Energy to redesign of the Society’s website work commenced in July on this important project. The website is central to most Society activity. A key feature of the website will be pages featuring 15 heritage sites of naval significance. Three of these are World Heritage listed. The Society looks forward to launching the new site in the coming months. Acknowledgment of the significant contribution made by Mrs Mae Clark to the wellbeing of apprentices at HMAS Nirimba in our July edition brought to mind the efforts of another important lady. In this case, Mrs Carleen Angel whose selfless efforts made it possible for naval personnel to enjoy theatre experiences they may otherwise missed. Her contribution to Navy and the Defence community spanned more than 3 decades.

    Athens Journal of Tourism - Volume 1, Issue 1 – Pages 65-74 The ‘Road’ Less Travelled: Commemorating those who lie in Sea Graves By Patrick O’Leary Caroline Winter† Battlefield tourism is an increasing global phenomenon, often associated with a ‘memory boom’ and a desire for families to trace their own place in national history. It has also been argued, that travel to sites of conflict is one of the ways in which social memory can be created and perpetuated. In Australia for example, travel to the Gallipoli battlefield of the First World War has become a ‘rite of passage’ for younger generations. In this paper, we explore the notion that social memory of Australians at war is associated with a limited number of sites, particularly Gallipoli, Villers-Bretonneux and the Kokoda Track. Part of the reason for this may be that physical access to these sites is relatively easy, given the vast improvements in international travel options, as well as a plethora of media coverage. There are many other sites that equally deserve to hold special significance for Australians but which do not attract the same attention, particularly because they are far harder to visit and even harder to find. Naval ‘grave’ sites are a case in point. This paper traces a family visit to the site of the 1942 sinking of the HMAS Perth and the USS Houston off north-west Java to commemorate the 70th anniversary of ‘The Battle of the Sunda Strait’. Naval war graves present special demands on those few intrepid pilgrims who choose ‘the road less travelled’, none more than the alien environment, the difficulties in identifying the site itself and the effects of the lack of social memory about such sites.
