Every effort has been made to insure pedigree and other vital information is accurate on all consignments listed herein, but sale management and their assigned is not responsible for errors or omissions. Horse Health Requirements: All horses must have a negative Coggins test within 12 months of the sale (AGID test will allow entry into Canada) and a health certificate within 30 days of the sale. All bred mares must have a veteri- nary certificate within 30 days of the sale stating that the mare is in foal. Any buyer of a bred mare who is uncertain of her being bred must have her vet checked by the sale vet before she leaves the grounds. If she is bred the cost of checking will be paid by the buyer. If not, it will be paid by the seller. Flu and rhino shots are required to be administered and documented before the sale. Hay, Straw, and Feed: Hay and shavings will be available to purchase at the sale. All stalls provided for stallion presentation or consigned sale horses will be furnished with shavings. Registrations: All consignments to the White Deer Morgan Horse Sale that are presented as registered are required to have all original registrations and transfers in place or applied for with the appropriate registry association be- fore the animal goes into the sale ring. Catalog number of horse is sale num- ber. Buyers: All sales are final. All horses will be transferred or released to the person indicated on the sales slip. Cost to transfer ownership of the regis- tered consignments to new owners will be deducted from the sale proceeds. Title passes at the fall of the auctioneer’s hammer, at which time all risk and responsibility for the horse passes to the buyer. Terms: All consignments must have a new halter and lead rope, otherwise the sale committee will supply one and charge the seller for the cost. No horse will be allowed to leave the barns without a checkout slip indicating full payment. All horses must be removed from the barns by midnight Saturday evening, the last day of the sale. All sellers are responsible for their horses up until the time that the gavel falls, after which the buyer is in full responsibility. The sale committee of the White Deer Morgan Horse Sale reserves the right to reject any horses for any reason including but not limited to: Unsoundness, poor condition, and improper documentation of registration or health papers. Sales Tax: Horses sold are subject to the 6% Pennsylvania sales tax. This tax must be paid by the buyer in addition to the purchase price, unless the sale of the horse qualified for exemption under the rules and regulations of the Pennsylvania Department of Revenue and the buyer furnishes the sale certificates of exemption in the form approved by the Department of Revenue. Exemption forms with instructions will be available in the sales office and may be executed by the buyer at time of settlement. 3 Buyer’s Payment: Buyer shall pay for the horse(s) prior to the conclusion of the sale by one or more of the following means: cash, approved personal check (with letter from bank guaranteeing payment), money order, cashier’s check, traveler’s check or credit card (VISA/Mastercard, 3% buyer’s premium to be added to total purchase price). US funds only. Checks are to be made payable to White Deer Morgan Horse Sale. A $75 service charge will be in- curred on all bad checks (NSF, Stop Payment, etc.). Horse Outs: If horse is cataloged and does not go through the sale on Sat- urday, September 22nd, and no substitution horse is presented, the seller is required to pay a withdrawal fee of $200 per horse. Warranties: Ages, heights, markings and physical conditions are approxi- mated and not guaranteed. It is the responsibility and obligation of the buyer to examine the horse before he bids, as all sales will be final. In case typo- graphical errors or other errors are discovered, the auctioneer will announce them, which will take precedence over the printed catalog. Buyers are there- fore cautioned to pay attention to the auctioneer’s announcements. Guarantees: No guarantees whatsoever, expressed or implied, are made by the sale committee, the auctioneers, pedigree readers, bid spotters, or any- one associated with the White Deer Morgan Horse Sale as to title, quality, un- soundness or soundness of any consignments. Presentations given in writing by the consignor to the sale committee will be announced at the time of sale as though by the consignor. Any claims made based upon said presentations, guarantees, or omissions, shall be made against the consignor only and not the sale committee or any persons related to the sale. Seller’s statements of soundness or unsoundness will be announced at the sale. Liabilities: Everyone is urged to use caution and care while attending the sale. The White Deer Morgan Horse Sale, all members of the committee, and all those associated with the sale in any way shall not be liable for any injuries sustained by anyone attending the sale, and all parties entering the grounds where the sale is held do so at their own risk and further agree that the organization responsible for the sale is hereby released from any liability or responsibility for any injuries sustained by them during the attendance of the sale and its related activities from any case whatsoever. TERMS OF CONSIGNMENT When used herein the consignor shall include any person entering an animal or animals in any sale conducted herein, including the owner or his agent signing the reverse side of this agreement; and White Deer Morgan Horse Sale shall be referred to as WDMHS. By entering an animal or animals in any sale conducted by WDMHS, the consignor or his agent signing the reverse side of this agreement, the consignor does thereby agree to the following terms and conditions. The consignor agrees that all animals shall be at the place of sale in proper time, delivered free of expense to WDMHS. The consignor agrees that after having consigned stock to the sale of WDMHS, he will not dispose of it by private sale, either prior or during the progress of sale. He also agrees that no 4 animal will be withdrawn from the sale, except in case of injury or sickness, subsequent to the time of entry of sale, sufficient in nature to prevent realizing a fair price, and in case of withdrawl of any animal without the consent of this company, will forfeit their consignment fee. Consignor shall notify WDMHS within 24 hours if the horse develops a seri- ous injury or serious disease after consignment which impairs its suitability for sale. Upon such occurrence, consignor shall make the request for withdrawal in writing as soon as practical after the onset of the condition and consignor determines that the horse is not suitable for sale. Consignor shall provide an affidavit of a licensed veterinarian which (1) states the date the animal was first examined for the condition, (2) specifically identifies the condition of the animal, and (3) states an opinion to a reasonable degree of scientific and medical cer- tainty that the animal is suffering from serious injury or serious disease which renders the horse unfit for transportation and sale. Consignor shall submit the request for withdrawal and veterinarian affidavit to WDMHS not later than 24 hours prior to commencement of sale session. The animals consigned to the WDMHS are entirely at the risk of the consignor until sold and fully paid for. The consignor is the responsible party, WDMHS acting only as the agent. Consignor warrants title of each animal (including foals and foals in utero) free of any liens or encumbrances and agrees to defend title against all claims. Consignor warrants all information set forth herein regarding pedigrees, identity, engagements, etc. Consignor warrants that no animal is suffering fron any contagious disease or is unsafe or vicious, will be sent to the sale. Consignor acknowledges that consignor is solely responsible for all information provided herein. Consignor agress to indemnify and hold WDMHS harmless from all costs, claims and expenses incurred because of question to title, pedigree, physical condition, identity, engagements or resulting from claims against the animal or proceeds from the sale. The registration certificate of each animal listed as registered must be fur- nished with a clear title of ownership by the consignor. The consignor authorizes WDMHS to act on his agent in the transfer of the registration certificate. The consignor agrees that he will be present in person, or have a duly au- thorized representative present, to make true representations respecting each animal.
