REPORT BY THE DIRECTOR OF INFRASTRUCTURE SERVICES

Abstract: This report recommends that the Committee notes the applications detailed in Appendix 1 of the report determined by the Head of Planning and Transport in accordance with the Scheme of Delegation detailed in Standing Orders.

1.0 RECOMMENDATION

1.1 The Committee is asked to note the applications, detailed in the Appendix, determined under delegated powers.

2.0 INTRODUCTION

2.1 In terms of the Scheme of Delegation to officers, the Head of Planning and Transport is authorised to approve planning applications in accordance with the Development Plan, the Local Plans or established policies and where there are no objections, except those which raise a general issue affecting a large area, or are of major land or economic development significance. The Head of Planning and Transport is further authorised to refuse minor planning applications that are clearly contrary to planning policies (e.g. illuminated signs, satellite antennae, certain householder applications, etc).

3.0 DELEGATED DECISIONS

3.1 Attached as an Appendix is a list of 75 applications determined under delegated authority during the period 22 January 2008 to 12 February 2008.

4.0 FINANCIAL IMPLICATIONS

4.1 There are no financial implications.

5.0 HUMAN RIGHTS IMPLICATIONS

5.1 There are no Human Rights issues arising directly as a result of this report.

8 That, prior to the occupation of any of the flats, the access, turning area, footway within the site and parking bays shall be formed in accordance with the standards of Angus Council

9 That, prior to the occupation of any of the flats, the existing footway ex-adverso the site shall be widened to 1.8 metres, all formed and constructed to the standards of Angus Council

10 That the developer shall afford access at all reasonable times to any archaeological organisation acceptable to the Planning Authority and shall allow them to observe work in progress and record items of interest and finds. Notification of the commencement date, information as to whom the Planning Authority should contact on site and the name of the archaeological organisation retained by the developer shall be given to the Planning Authority in writing not less than 14 days before development commences.

11 That, prior to the commencement of the development, a detailed remediation statement shall be submitted to the planning authority for approval. No works, other than investigative works, shall be carried out on the site prior to receipt of written approval of the remediation statement by the planning authority

12 That, prior to the commencement of development, remediation of the site shall be carried out in accordance with the approved remediation statement. Any amendments to the approved remediation plan shall not be implemented unless approved in writing by the planning authority

13 That, on completion of the remediation works and prior to any residential property on the site being occupied, the developer shall submit a report to the planning authority confirming that the works have been carried out in accordance with the remediation statement

14 That prior to the commencement of any work on the site, a scheme for the management and maintenance of open spaces within the development be submitted to and approved by the Council.

15 That prior to the commencement of the development, details of the means of site enclosure proposed to be used, shall be submitted for the prior approval of the Planning Authority and be erected on or before completion of the development.

16 That all stone boundary walls around the site shall be retained as existing, with no access being permitted to the public car park to the west

17 That, prior to the commencement of works on site, written confirmation shall be submitted to the planning authority from Scottish Water to state their acceptance of the development to the public sewer. Thereafter, this connection shall be made prior to the commencement of building operations

18 That, prior to the commencement of works, details of measures for management of surface water run- off from the site, which shall take the form of a Sustainable Urban Drainage System, shall be submitted to the planning authority and approved in writing. Thereafter, the approved drainage system shall be fully implemented prior to occupation of any of the residential properties

Thereafter, the approved details shall be fully implemented and access shall be formed in accordance with the standards of Angus Council prior to the occupation of the development hereby approved.

4 That no development takes place until there has been submitted to and approved by the Planning Authority, a scheme of landscaping, including, where appropriate, an indication of all existing trees and hedgerows on the land and details of these to be retained and cleared, together with the measures for their protection in the course of development.

If the scheme falls outwith the site an application shall be made for planning permission for the same. The SUDS scheme shall be fully implemented in accordance with the technical standards of SEPA.

7 That prior to commencement of the development hereby approved, samples of the roof and external wall finishes be submitted to and agreed in writing with the Planning Authority. The agreed scheme shall thereafter be implemented prior to occupation of the any part of the development hereby approved.

8 That notwithstanding the provisions of Class 13 of the Town and Country Planning (General Permitted Development) (Scotland) Order 1992 or any subsequent amendment, development hereby approved shall not be changed in use from Class 4 of the Town and Country Planning (Use Classes) (Scotland) Order 1997 unless otherwise agreed in writing with this planning authority.
