Official Rules - New Year Fitness Resolution Sweepstakes
NO PURCHASE NECESSARY TO ENTER OR WIN. This promotion is not administered by, sponsored, endorsed, or associated with Facebook or Instagram. This Sweepstakes is solely sponsored by General Growth Services, Inc. (“GGSI” or "Sponsor"), it is a national Sweepstakes marketed at each of the Participating Malls (“Participating Malls”) referenced-below.
DATES: Enter once between January 15, 2018 3:00 PM CST and February 9, 2018 11:59 PM CST (“Promotional Period”). Limit one entry per person.
ENTRY: Visit a Participating Mall’s Facebook (“FB”) page, and look for the Sweepstakes message we post and answer the questions on our timeline.
ELIGIBILITY: The Sweepstakes is open to legal residents of the 50 United States or D.C., age 18 or older. Employees and officers of GGSI and their respective parent and subsidiary companies and affiliates are not eligible to enter or win. Immediate family members and household members of such individuals are also not eligible to enter or win. "Immediate family members" shall mean parents, step-parents, legal guardians, children, step-children, siblings, step-siblings, or spouses. "Household members" shall mean those people who share the same residence at least three months a year.
PRIZE/WINNER SELECTION/ODDS: Winner will be selected in a random drawing. The odds of winning depend on the total number of entries received nationally. One Grand Prize winner to receive a $100 GGP Gift Card.
CLAIMING PRIZE: Winner will be notified (“Win Notification”) via FB by the Sponsor and will have 4 days after the Win Notification to contact the Sponsor. The unverified winner must present a valid government issued photo ID and Image Release to the Sponsor within 7 business days after the first Win Notification or the prize will be forfeited. If a winner is age 17 or younger, their parent or legal guardian will be required to provide the documentation within the required time frame.
Win Notice: a winner who entered on Facebook will be “tagged” and may receive a direct message.
All gift cards and vouchers are subject to the terms of the issuer; certain gift cards are distributed with a Cardholder Agreement and subject to those terms. A prize must be accepted as awarded and may not be sold and is not convertible to cash. Additional prize restrictions and terms may be imposed by prize providers. If the prize is $600.00 or higher a 1099 tax form will be issued in the winner’s name for the approximate retail value of the prize. No prize substitutions or cash equivalents, except at the sole discretion of the Sponsor. Prizes are non-transferable.

TERMS/INDEMNIFICATION: By participating in this Sweepstakes and/or by accepting any prize that you may be awarded, you agree that Sponsor, Facebook, and their respective parents, subsidiaries and affiliated companies, units and divisions; and Sponsor’s advertising and promotional agencies, and prize providers and each of their respective officers, directors, agents, representatives and employees; and their respective successors, representatives and assigns (collectively, the "Indemnified Parties") shall not be liable for any and all actions, claims, including any injuries, losses or damages of any kind caused by your participation in this Sweepstakes or resulting from acceptance, possession or use of a prize. By participating in the Sweepstakes and/or accepting any prize that you may be awarded, you agree to fully indemnify each Indemnified Party from any and all such claims by third parties. The Indemnified Parties shall not be liable for: (i) technical errors, data corruption, or unauthorized access to or alteration of entry or other materials; (ii) claims based on publicity rights, defamation, or invasion of privacy; or (iii) any printing, typographical, administrative or technological errors in any materials associated with the Sweepstakes. Sponsor may prohibit participation in the Sweepstakes if, in its sole discretion, it determines a user is attempting to undermine the legitimate operation of the Sweepstakes by cheating or any other unfair playing practices of intending to annoy, abuse, threaten or harass any other participants or Sponsor representatives. In the event of a dispute regarding the identity of a person submitting an entry, the entry will be deemed to be submitted by the person whose FB ID address matches the address of the person “tagged”. Sponsor will not distribute more than the stated number of prizes described. The prize will remain unawarded if the winner and two alternate winners all fail to claim the prize. All properly claimed prizes will be awarded. Indemnified Parties are not responsible for any injury or damage to a participant’s computer related to or resulting from participating the in promotion. Sponsor reserves the right to cancel the promotion it if integrity of the promotion is compromised or corrupted. Void where prohibited or restricted by law. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE THE SWEEPSTAKE'S WEBSITE OR UNDERMINES THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHALL RESULT IN DISQUALIFICATION FROM PARTICIPATION IN THE SWEEPSTAKES. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY FEES) TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION. An entrant may be disqualified if they attempt to obtain more than the stated number of entries. The winner is responsible for all local, county, state, and federal taxes on prizes based on the value of the prize.
RELEASE: By entering, entrants agree to: (1) release the Sponsor and its agents, Facebook, from all liability, injuries, loss and/or damage of any kind arising from their participation in the Sweepstakes and the acceptance and use/misuse of any prize; (2) agree to be bound by the Official Rules and the decisions of the judge. Entrants authorize the Indemnified Parties to use their name, photo, hometown, Submission, and entry materials in programming or promotional material, worldwide in perpetuity, or on a winner's list, if applicable, without further compensation unless prohibited by law. By accepting a prize, each winner consents to the use by Sponsor and its agent and affiliates of his/her name, hometown, and likeness for advertising and promotional purposes without additional compensation in all media (except if winner is a resident of TN or where otherwise prohibited by law).
