In the years after the World War II, the authorities led in building an international system for the protection of refugees, in order to ensure that the nations of the world would never again turn away people fleeing persecution. The 1951 Refugee Convention and its 1967 Protocol created a mechanism for refugees at risk of persecution to seek asylum in other states. The system introduced in different countries is rigorous, requiring detailed interviews, immigration court hearings, as well as extensive security and intelligence vetting. No individual can be granted asylum until this special security process is complete. Still there are numerous weaknesses in these man made laws. Islam, 14 hundred years ago gave such a comprehensive law for the scrutiny and well-being of asylum seekers. Islamic ―Hijrah Law‖ has such a wide range that it can be a guide-line to all man made laws. However, there are some Muslim scholars to position the text of the Qur’an as a text to be studied scientifically. Among these scientist is Khalil Abdul Karim, who explains that the Qur'an describes many stories of people who indicated earlier that Islam is not a new pure religion. Khalil Abdul Karim explained that the historicity contained in the Qur'an shows that the Islamic religion is closely related to the life or customs of the Arabs before Islam arrived. This article suggests that historicity of the Qur'an which is evidence that the majority of Islamic law derived from the Arabs in pre-Islamic Arab socio-cultural perspective study, thought Khalil Abdul Karim. Exploration data obtained from several sources, are analyzed using the content analysis, the process of decomposition of the data, drafting and preparation in a new way. The steps taken in the content analysis covering, open coding, axial coding, and selective coding. The results showed that the thought of Khalil Abdul Karim caused a variety of responses from various groups, both positive and negative responses.

    Through Islamic Banks’ Zakat House (IBZH): Investment of Zakah Funds in Microfinance to Remove Poverty in Bangladesh: A New Model ∗ Ahm Ershad UDDIN Abstract One of Zakat’s main objectives is to help eliminate poverty and famine. And in Shari’ah, the obligation of zakat payment is elaborated which if not maintained holds severe consequences. Zakat has its unique features of supporting the poor in providing a collateral free financial stability. The main socioeconomic factors in all the developing Muslim countries are poverty, unemployment and economic inequality which results in not meeting the basic needs of the poor. In a country like Bangladesh consisting of Muslim Majority, although governmental and non- governmental institutions collect and distribute zakat yet the ultimate goal of zakat is not attained completely. At present, modern Islamic jurists reinforce the notion of microfinance investment through the collection and usage of zakat money. This paper consists of a static ground for the poverty removal creating a financial institution which is equally responsible as those present in Bangladesh but with a different route in eliminating poverty where schemes can be initiated along with opening opportunities of employment. Finally, it also surfaces the model in investment of zakat fund through IBZH with opinions of Islamic jurists. Understanding the pillars of Takaful 1.1 CONCEPT OF TAKAFUL The doctrine of al-Takaful, as adopted by the Islamic insurance operators of today, is an adequate alternative to that of regular insurance services. Insurance services may have a place in Islamic finance if they are approved by the Shari’ah, based on shared responsibility, mutual cooperation and solidarity,1 in order to protect someone against a well-defined risk. which is derived from the root of the (مصدر) The term Takaful is a noun which means guarantee or responsibility, while Takaful ,(كفل) word Kafl .means sharing ,(المشاركة) whose chief characteristic is al-Musharakah ,(تكافل) Thus, the word Takaful stands for shared responsibility, shared guarantee, (تكافل) collective assurance, and mutual undertakings.2 Technically, Takaful from the economic point of view means a mutual guarantee or assurance, based on the principles of al-’Aqd provided by a group of people living in the same society, against a well-defined risk or catastrophe affecting one’s life, property or any possession of value. Hence, Takaful is better known as cooperative insurance with mutual agreement.3 In Takaful, there are usually four parties involved, namely: (1) partici- pant; (2) operator; (3) insured; and (4) beneficiary.4 The nature of Takaful is that in a society, anybody who has legal capacity may contribute an amount of money to a mutual cooperative fund. This is with a view to ensuring material security against a well-defined risk, probably related to another’s life or property. Thus, those who contribute to the mutual fund are known as participants, while those who are among the participants who face a risk and are assisted by the fund are known as the insured.
