  • What Amounts to a Surrender by Operation of Law?
September 2010 Review Property @ction Welcome to the Fifth Edition of the Quarterly Review from Hammonds’ Property@ction Team. In this issue we will look at the following: (i) What amounts to a surrender by operation of law; (ii) Does it do what it says on the tin? - full repairing and insuring leases; (iii) Double trouble; (iv) Compulsory purchase orders; (v) Adverse possession; We welcome all contributions to this review and if you would like to discuss this further please contact any of the editorial team. What amounts to a surrender by operation of law? Where a landlord and tenant bring a lease to an end, they usually do so by completing a deed of surrender. However, sometimes, it may be implied that a surrender has occurred. The term commonly used for an implied surrender is a surrender “by operation of law”. In a recent case, QFS Scaffolding v Sable1 , the court considered some of the relevant principles for a surrender by operation of law to take place. Facts The landlord (Mr and Mrs Sable) granted a lease to a tenant company which eventually entered into administration. Prior to the administration, a new company (QFS) was formed with a view to taking over the tenant’s business. The Sables negotiated terms for a new lease with QFS who, in fact, went into occupation. However, the negotiations faltered and no new lease was entered into. Instead, QFS asked the administrator of the tenant to assign the lease to it and, as a result of this request, a deed of assignment was executed.

  • Cleopatra Crater on Venus: Happy Solution of the Volcanic Vs
CLEOPATRA CRATER ON VENUS: HAPPY SOLUTION OF THE VOLCANIC VS. IMPACT CRATER CONTROVERSY; A.T. Basilevsky, A.T. Vernadsky Institute of Geochemistry and Analytical chemistry, Moscow, USSR, and G.G. Schaber, U.S. Geological Survey, Flagstaff AZ 86001 ~ntroduction. Cleopatra is a 100-km-diameter crater on the eastern slope of Maxwell Montes in western Ishtar Terra. For over 12 years, Cleopatra has been the subject of scientific controversy. Discovered during the Pioneer Venus altimetric survey, this feature was initially interpreted as a caldera near the top of a giant volcanic construct, Maxwell Montes [I]. Venera 15/16 data and recent Arecibo radar images show, however, that the Maxwell Montes appear to be more of a tectonic construct, with little or no resemblance to other giant shields known in the Solar System; thus, a nonvolcanic origin of Cleopatra was proposed [2-61. The similarity of the double-ring structure of Cleopatra to those of other multi-ring impact craters of similar size on Venus and the Moon, Mercury, and Mars was more recently given by Basilevsky and Ivanov [7] as the primarily reason to consider this feature an impact crater. At the same time, some characteristics of Cleopatra seemed to contradict an impact origin. For example, Schaber et al. [8], suggestingthat a definitive verification of a volcanic or impact origin would probably require Magellan data, proposed that the evidence from Venera 15/16 and earlier data for a probable volcanic origin for Cleopatra is substantial. They cited, among other points: (1) the absence of a raised rim and highly backscattering ejecta deposits; (2) the crater's association with plains-forming deposits immediately downslope to the east, interpreted as probable lava flows emanating from a distinct breach in the crater's rim; (3) the excessive depth (2.5 km) and depth-to-diameter ratio (0.028) of the crater, (4) the offset of the inner and outer craters; and (5) the crater's position in what was interpreted as a regional tectonic framework.

Scottish Book Trust Authors Live: Anthony Horowitz Date: (In purple) Author/Interview subject: Anthony Horowitz Interviewed by: Janice Forsyth Other speakers: JF: Hello there, I am Janice Forsyth. A huge warm welcome to Authors Live. This is the world-class series of authors events that are beamed live into all sorts of venues all over the UK. We're talking about schools, homes, libraries, wherever you are, we're so delighted that you are joining us. And this is a particularly special day because we are about to welcome a fabulous author. But before I introduce him we also have some wonderful children from three South Lanarkshire primary schools. From Quarter Primary School, Leadhills and High Mill Primary School. They might even give you a wave, I don't know. But they're very nice anyway. Aren't they gorgeous? Yeah, they're waving too. Yeah, they're not too cool for school, and neither are you. It's so lovely to have you along. So as I said, every time we have an Authors Live it’s special, but this is particularly special because we're welcoming such a big name from the world of children's books. And it's a big year for him too because he's celebrating the 15th anniversary of the massively popular, I love them, Alex Rider, super spy books. Some of you will have read them I know and some of you also will have seen the film adaption of the very first one, Stormbreaker which I also loved. It's time I grew up! No it's not.
