Among them, the foremost was the idea that a comprehensive bibliographical dictionary of fiqh literature in India in the recent times should be prepared for it would not only be helpful in providing an indicator of the intellectual potential of the Muslim Intelligenstia of the Indo-Pak subcontinent, but also a guide to the young and experienced researchers alike for the location of the relevant material. The study of nature of survey, and as such does not warrant or pre-suppose a critical or analytical examination of the Urdu Fiqh literature in India. Nevertheless, it provides an insight into the juridical mind of muslim India, besides opening a window to the academic awakening of the Muslim Ulama and Fuqaha of the country. It is presented with the hope that some serious scholars would utilize the accumulated information for deeper studies on the subject, apart from enriching it from bibliographical point of view. -

Religion and State in Late Mughal India: The Official Status of the Fatawa Alamgiri Dr. Muhammad Khalid Masud* Following the advent of the phenomenon of the nation-state in modern Muslim countries, the issue of the relationship between the state and religion assumed great significance. Islamic scholars have differed over the scope of this relationship, and a key factor underpinning this inquiry has been different interpretations of the various schools of Islamic law. In this regard, the Hanafi school, due to its wide following, has been the center of attention of Islamic scholars since long. This article examines the Fatawa Alamgiri, a compilation of authoritative Hanafi doctrines, with respect to the meaning of the official recognition of the Hanafi school and the relationship between the state and madhhab (school). The meaning of official recognition is explored in the context of personal madhhab of the kings, royal patronage of madhhab, madhhab as a source of legislation, requirements for judges to interpret madhhab, and prevalence of madhhab among the masses. This article concludes that official recognition of madhhab cannot be obtained only on the basis of the evidence of personal adoption of madhhab by kings, its royal patronage, and its prevalence among the masses. In fact, official recognition is obtained when a madhhab becomes the exclusive source of legislation in the state, and judges are required to adhere to it exclusively. In this sense the Hanafi madhhab was never recognized as an official madhhab in pre-colonial India. 1. Introduction The formation of the nation-state in modern Muslim countries raised some important questions about the place of Islamic law in the structure of the state. -

ijcrb.webs.com JUNE 2012 INTERDISCIPLINARY JOURNAL OF CONTEMPORARY RESEARCH IN BUSINESS VOL 4, NO 2 AN ANALYTICAL STUDY OF AL-GHAZALI’S CONTRIBUTION TO USUL AL- FIQH Dr Farooq Hassan Assistant Professor Department of Humanities, NED University of Engineering & Technology Karachi, Pakistan Abstract: Abu Hamid , al-Ghazali (1058- 1111/450-50 ), a medieval Muslim theologian, Sufi, Jurist, Usuli remarkably contributed to Usul al-fiqh on Tariqat al-Mutakallimin (Tariqh al- Shafi’iyah) along with many other sciences. The details of his life and the works are well- documented with some exceptions. He wrote al Mankhul min Taliqat al-Usul (the sifted from the Commentary on the fundamentals) when he was young, than he wrote many other books on the same subject, this continued till the end of his life. After 25 years he wrote al- Mustasfa min Ilm al-usul, (a year before his death in 504/1110) which gained a lot of renown from many circles, on the other hand one of his best books was neglected and gradually faded away from the screen. Some thinkers have refused to accept it as al- Ghazal’s book. Some others showed their doubts about its authorships. Some more scholars when writing about his literary contributions have failed to mention al-Mankhul and said that some books have been falsely attributed to him. Many other have analyzed a few pieces from this book and commented that this kind of language used in this book is without dignity and much below the level of such scholar. There are others who have claimed that this could be a compilation of lectures by his student which were delivered by al-Ghazali. -
