Asunto C-248/19: Recurso Interpuesto El 20 De Marzo De 2019 C 213/10 ES Diario Oficial de la Unión Europea 24.6.2019 2) En caso de respuesta afirmativa a la primera cuestión prejudicial, ¿deben interpretarse el artículo 1, apartado 1, y el artículo 5 de la Directiva 2011/16, en su caso, teniendo en cuenta la naturaleza evolutiva de la interpretación del artículo 26 del Modelo de Convenio Tributario de la OCDE, en el sentido de que una solicitud de intercambio de información, junto con un requeri- miento de la autoridad competente del Estado miembro requerido que la tramita, cumplen el criterio de la existencia manifiesta de pertinencia previsible si el Estado miembro requirente indica la identidad del contribuyente afectado, el periodo al que se refiere la investigación en el Estado miembro requirente y la identidad del poseedor de la información mencionada, aun cuando solicita información referida a las cuentas bancarias y a los activos financieros no especificados pero delimitados por criterios que guardan relación, en primer lugar, con el hecho de que se hallan en poder del poseedor identificado de la información, en segundo lugar, con los ejercicios tributarios a los que se refiere la investigación de las autoridades del Estado requirente y, en ter- cer lugar, con su vínculo con el contribuyente afectado identificado? Manhaeve, agentes) Demandada: República de Chipre Pretensiones de la parte demandante — Declarar que la República de Chipre ha incumplido las obligaciones que le incumben en virtud de los artículos 3, 4, 10 y 15 y del anexo I, puntos B y D, de la Directiva 91/271/CEE (1)sobre el tratamiento de las aguas residuales urbanas: — al no haber dotado de una sistema colector de aguas residuales urbanas a 31 aglomeraciones urbanas (Aradippou, Ipsonas, Dali, Varoklini, Deryneia, Sotira, Xylofagou, Pervolia, Kolossi, Poli Chrysochous, Leivadia, Dromolaxia, Pera Chorio-Nisou, Lio- petri, Avgorou, Paliometocho, Kiti, Frenaros, Ormideia, Kokkinotrimithia, Trachoni, Episkopi, Xylotympou, Pano Polemidia, Pyla, Lympia, Parekklisia, Kakopetria, Achna, Meneou y Pyrgos), como exigen el artículo 3 y el anexo I, punto A, de la Directiva; y 24.6.2019 ES Diario Oficial de la Unión Europea C 213/11 al no haber garantizado que, en estas mismas aglomeraciones urbanas, las aguas residuales urbanas que entren en los sistemas colectores sean objeto, antes de verterse, de un tratamiento secundario o de un proceso equivalente, como exigen los artículos 4, 10 y 15 y el anexo I, puntos B y D, de la Directiva. — Condenar en costas a la República de Chipre. Motivos y principales alegaciones 1. En ausencia de un sistema colector integrado y operativo, la República de Chipre no se ha ajustado al plazo del 31 diciembre 2012 fijado por la Directiva 91/271/CEE sobre el tratamiento de las aguas residuales urbanas (prorrogado por el Tratado de Adhesión de la República de Chipre a la Unión Europea), por lo que se refiere a la recogida (artículo 3) y, por tanto, al trata- miento secundario de las aguas residuales urbanas (artículo 4), y a las infraestructuras y a los controles que conlleva dicho trata- miento (artículos 10 y 15), en 4 aglomeraciones urbanas que tienen más de 10 000 equivalentes habitante. 2. En ausencia de un sistema colector integrado y operativo, la República de Chipre no se ha ajustado al plazo del 31 diciembre 2012 fijado por la Directiva 91/271/CEE, sobre el tratamiento de las aguas residuales urbanas (prorrogado por el Tratado de Adhesión de la República de Chipre a la Unión Europea), por lo que se refiere a la recogida (artículo 3), y por tanto, al trata- miento secundario de las aguas residuales urbanas (artículo 4), y a las infraestructuras y los controles que conlleva dicho trata- miento (artículos 10 y 15), en 27 aglomeraciones urbanas que tienen entre 2 000 y 10 000 equivalentes habitante. The Water Development Department (WDD) is therefore investigating innovative methods for producing and conserving water. One of the concepts being considered is reduction of evaporation from surface water bodies. A reservoir operation study of the Southern Conveyor Project (SCP) suggests that an average of 6.9 million cubic meters (MCM) of water is lost to evaporation each year. The value of this water is over CYE 1.2 million, and replacement of this volume of water by desalination will cost CYE 2.9 million. The WDD has investigated the use of monomolecular films for use in evaporation suppression, but these films are difficult to use in the field and raise concerns about health effects.
