Details On the afternoon of August 14, 2014, when the police officers from the National Security Brigade of Yining Municipal Public Security Bureau arrested Meng Xiumei, one of them swung a piece of documentation in his

1 hand, saying, “We’re from the Public Security Bureau, and this is our search warrant.” With these words, they started to rummage through the rooms. A week later, on approximately August 22 or 23, the captain of the National Security Brigade, together with another police officer, came to Meng Xiumei’s home again to give her family the Detention Warrant. 5. Authority who issued the warrant or decision: Yining Municipal Public Security Bureau, Xinjiang Uygur Autonomous Region 6. Reasons for the arrest imputed by the authorities: No reasons were given when the police arrested Meng. Later, the alleged reason was given that Meng Xiumei’s belief in Almighty God was punishable under Art. 300 7. Legal basis for the arrest including relevant legislation applied (if known): Article 300 of the Chinese Criminal Code.

III. Detention 1. Date of detention: Date of criminal detention: August 15, 2014 Date of arrest: September 20, 2014 Date of sentence: August 2016 Date of imprisonment: December 2016 2. Duration of detention: Since the afternoon of August 14, 2014 till now. 3. Forces holding the detainee under custody: Yining Municipal Public Security Bureau of Xinjiang Uygur Autonomous Region ordered the detention. After the Supreme People’s Court of Xinjiang Uygur Autonomous Region made its decision, Meng Xiumei was transferred to the Uygur Women’s Prison in December 2016. 4. Places of detention: Meng Xiumei had been detained at the Yining Municipal Detention Center of Xinjiang Uygur Autonomous Region since the afternoon of August 14 of 2014. Upon the sentence of her jail terms in December 2016, Meng Xiumei was transferred to and has been detained at the Uygur Women’s Prison.

2 5. Authorities that ordered the detention: Yining Municipal Public Security Bureau of Xinjiang Uygur Autonomous Region ordered the detention. The Higher People’s Court of Xinjiang Uygur Autonomous Region made the decision of detention. The Administration of Prisons of Xinjiang Uygur Autonomous Region implemented the decision of detention. 6. Reasons for the detention imputed by the authorities: Based on Article 300, she was sentenced to 14 years of imprisonment and 5 years of deprivation of political rights because of activity in The Church of Almighty God, more than the usual 7 years for being believed to be a local leader, as well as her establishment of a video group and her participation in organizing and producing publicity videos for The Church of Almighty God. 7. IV. Circumstances of the arrest. On the afternoon of August 14 of 2014, Ms. Meng Xiumei was staying with her mother and daughter at home. Three officers (2 male and 1 female) knocked the door open in the name of checking residence cards. After they confirmed Meng Xiumei’s identity, five or six more plain-clothes men entered the room. Among them, a middle-aged man appearing as the captain swung a piece of documentation in his hand, saying, “We’re from the Public Security Bureau, and this is our Search Warrant.” With these words, they started to rummage through the rooms and searched out dozens of books of faith and discs. After finishing the procedure of checking residence cards for Meng Xiumei and her mother, the police officers took Meng Xiumei away, together with the searched-out books of faith, discs, more than 16,500 RMB in cash, three MP5 players and a computer. All the personal property was confiscated subsequently. Later, Meng Xiumei and her mother learned that those men were police officers from the National Security Brigade of Yining Municipal Public Security Bureau.

V. Internal Remedies Meng Xiumei had been detained at the Yining Municipal Detention Center of Xinjiang Uygur Autonomous Region, and the police didn’t allow her family to meet her. During the span between August 2014 and the end of

3 2015, Meng Xiumei’s husband hired an attorney at the cost of 6,000 RMB to defend her. In December 2015, the decision of her case was made for the first instance, but the court didn’t notify her family. At the attorney’s, Meng Xiumei’s husband saw the decision on the verdict, which reads, “(2015) Yizhou Criminal First-Instance Preliminary Document No. 27 Criminal Verdict: The defendant Meng Xiumei is sentenced to 14 years of imprisonment and 5 years of deprivation of political rights for organizing and using a xie jiao to undermine the implementation of the laws.” Later, Meng Xiumei’s husband asked her attorney to make an appeal. In August 2016, the Xinjiang Higher People’s Court of Xinjiang Uygur Autonomous Region announced its decision and ordered rejection of the appeal and affirmed the original judgment. This was the final decision.

CASE 2: SHUHUA

II. Arrest 1. Date of arrest: December 19, 2013

Place of arrest: On December 19, 2013, around 1 p.m., Zhang Shuhua was taken away from one female Chirstian’s home on Daxu Street in Daxu Town, Tongshan District, Xuzhou City, Jiangsu Province by the police. 3. Forces who carried out the arrest: Daxu Town Police Station in Tongshan District, Xuzhou City 4. Details No warrant or other document was exhibited. 5. Authority who issued the warrant or decision: On January 25, 2014, under the permission of Tongshan District People's Procuratorate of Xuzhou City, Tongshan District Public Security Sub- Bureau of Xuzhou City conducted arrest of Zhang Shuhua on suspicion of “organizing and using a xie jiao to undermine the implementation of the laws.” 6. III. Detention 1. Date of detention: Zhang was arrested on December 19, 2013. The time of criminal custody is unknown. Zhang was arrested on January 25, 2014 and escorted to Women’s Prison on January 5, 2016. 2. Duration of detention: Zhang was detained from December 19, 2013 till now. 3. Forces holding the detainee under custody: Zhang was detained by Tongshan District Public Security Sub-Bureau of Xuzhou City, after being sentenced, she was escorted to Nantong Women’s Prison on January 5, 2016 to serve her jail terms. 4. Places of detention: On December 19, 2013, along with three other Christians, Zhang Shuhua was arrested by the police of Daxu Town Police Station in Tongshan District, Xuzhou City, and detention site is unknown. On January 3, 2014, Zhang

5 Shuhua was transferred to Sanbao Detention Center of Xuzhou City. During her detention there, she was once taken to a hotel in Xuzhou for interrogation. On January 25, 2014, Zhang Shuhua was officially arrested. On November 7, 2014, the Tongshan People’s Court openly heard the case of Zhang Shuhua and other Christians. On December 15, 2015, Zhang Shuhua was sentenced for 7 years and 6 months of imprisonment for her being active in The Church of Almighty God and copying, keeping and transporting spiritual books. On January 5, 2016, Zhang Shuhua was transferred to Nantong Women’s Prison (Address: No. 258 of Haodong Road, Nantong City, Jiangsu Province), where she has been serving her jail terms and detained till now. 5. Authorities that ordered the detention: Tongshan District Public Security Sub-Bureau of Xuzhou City ordered the detention, Tongshan People’s Court of Xuzhou City made a sentence which conducted by Jiangsu Prison Management Bureau. 6. Reasons for the detention imputed by the authorities: Zhang Shuhua was arrested on the charge of “organizing and using a xie jiao to undermine the implementation of the laws.” Seeing from the media report of the public trial of Tongshan People’s Court in November 2014, Zhang Shuhua and other Christians were sentenced on the charge of “organizing and using a xie jiao to undermine the implementation of the laws,” because of their being active in The Church of Almighty God and being responsible of copying, keeping and transporting spiritual books, and printing books for more than 10,000 copies. 7. Legal basis for the detention including relevant legislation applied: According to Article 300 of the Chinese Criminal Code, Zhang Shuhua was sentenced by Tongshan People’s Court of Xuzhou City for 7 years and 6 months of imprisonment, on the charge of “organizing and using a xie jiao to undermine the implementation of the laws.”

IV. Circumstances of the arrest. On December 19, 2013, around 1 p.m., Zhang Shuhua was having a meeting in one female Christian’s home with one brother and another sister on Daxu Street in Daxu Town, Tongshan District, Xuzhou City, Jiangsu Province. Six to seven plain-clothes police officers of Daxu Police Station of Tongshan District, Xuzhou City falsely claimed that they came to check the birth

6 control, and entered and made a mess of the Christian’s home, then took away Zhang Shuhua and other three CAG members without showing any document.

V. Internal Remedies Zhang Shuhua’s family didn’t make an appeal after she was sentenced, because they didn’t know the fact at all. They never got the notification of the trial or received any court decision until the day before she was sent to Nantong City to serve her jail terms, that was, on January 4, 2016, when they learned that she was sentenced to jail and saw her for a glance.

The above ten defendants are all detained in the Yining Detention Center in the Xinjiang Uygur Autonomous Region. Xinjiang Uygur Autonomous Region High People’s Court, Ili Kazak Autonomous Prefecture Branch, heard the case brought by the People’s Procuratorate of Ili Kazak Autonomous Prefecture, Xinjiang Uygur Autonomous Region, in which defendants of the orginal instance Meng Xiumei, Zhong Jun, Luo Guifang, Zhong Hua, Xiao Lanfen, Luo Laihui, Peng Jianbiao Xia Zhonglian, Meng Hong, and Zhu Guangying were indicted for sabotaging the enforcement of laws by organizing and utilizing cult organizations. On December 3, 2015, Yizhou Criminal First-Instance Preliminary Document No. 27 Criminal Verdict (2015) was entered. After conviction, the defendants of the original instance Meng Xiumei, Zhong Jun, Zhong Hua, Peng 13

Jianbiao, and Xia Zhonglian appealed against the verdict. A Collegiate Panel was convened by the Court according to the law. After the defendants were questioned by questionnaire, the facts were found to be clear and a court hearing was denied. The court proceedings have now been concluded. The original verdict was affirmed: Since 2005, defendants Meng Xiumei, Zhong Jun, Luo Guifang, Zhong Hua, Xiao Lanfen, Luo Laihui, Peng Jianbiao, Xia Zhonglian, Meng Hong, Zhu Guangying and others successively joined the “Almighty God” cult, covertly participated in the “Almighty God” cult meetings on a long-term basis, or managed the “Almighty God” cult in Ili Prefecture and other places, distributed and spread cultist sophistry and doctrine, secretly developed “Almighty God” cult membership, or provided funding to the “Almighty God” cult, collaborated closely with members of the “Almighty God” cult in other places, or produced and disseminated propaganda materials of the “Almighty God” cult, or recorded video materials that fabricated and distorted the facts, attacked and defamed the and the Chinese government. Among them, Defendant Meng Xiumei successively assumed leadership posts for the “Almighty God” cult organization’s Ili District Sunshine Church and Ili District, commanding and managing various tasks for the “Almighty God” cult in Ili District. According to the superiors’ arrangements of the “Almighty God” cult at the end of 2013, defendant Meng organized and established the “video group” that filmed fabricated and distorted facts, and reported the videos to the higher levels of the cult organization. Defendant Zhong Jun successively assumed the commanding posts of the “Almighty God” cult’s Second Line Gospel Team and Frontline Gospel Team, actively spread the “Almighty God” cult’s heresy and developed cult membership, participated in the video group of the Ili District’s “Almighty God” cult and was responsible for the video filming work. From December 2013 to March 2014, defendant Zhong participated five times in succession in the filming of videos about the so-called “members of the ‘Almighty God’ cult organization being extorted for confession under torture and their properties being unlawfully seized by the police.” Defendant Luo Guifang successively transmitted information and distributed cult books and materials for the “Almighty God” cult. Luo served as the Ili District’s “affairs chief” who handled copying and duplicating of information for the “Almighty God” cult for distribution to various churches, and contacted others to make “prison uniforms” for filming videos that fabricated and distorted the facts. Defendant Zhong Hua successively assumed the posts of church “Leader,” “Preacher,” “Watering person,” and “Commander of the Second-Line Gospel Team” for the “Almighty God” cult, actively spreading the heresy of “Almighty God” and developing membership for the organization. At the end of 2013, Zhong participated in the video group of the Ili District’s “Almighty God” cult, contacted members of the “Almighty God” cult, prepared video filming props, selected filming locations, and actively participated in video filming. From December 2013 to March 2014, Zhong

14 participated five times in succession in the filming of the videos about the so-called “members of the ‘Almighty God’ cult organization being extorted for confession under torture and their properties being unlawfully seized by the police.” Defendants Xiao Lanfen and Luo Laihui, the couple actively promoted and spread the heresy of “Almighty God,” disseminated “Almighty God” cult materials, drew and developed membership for the “Almighty God” cult organization, and used their residence as a meeting point for members of the “Almighty God” cult. From February to March 2014, they twice let members of the “Almighty God” cult use their home to film the videos about the so-called “members of the ‘Almighty God’ cult organization being extorted for confession under torture,” handled and participated in food preparation and external guarding for the video crews, kept video filming props, etc. Xiao Lanfen also produced prison uniforms for video filming, and joined other members of the “Almighty God” cult in January 2014 in the shooting of the videos about the so-called “members of the ‘Almighty God’ cult organization being extorted for confession under torture by the police.” Defendant Peng Jianbiao actively participated in the member gatherings of the “Almighty God” cult to draw others in joining the “Almighty God” cult, and participated in the video group of the Ili District’s “Almighty God” cult. From December 2013 to March 2014, Peng successively participated three times in filming the video contents of the so-called “members of the ‘Almighty God’ cult organization being extorted for confession under torture and their properties being unlawfully seized by the police.” Defendant Xia Zhonglian actively participated in the member gatherings of the “Almighty God” cult, used the Dry Cleaner’s she operated as a contact point for the Ili District’s “Almighty God” cult to receive and transmit instructions, books, video materials, etc. of the “Almighty God” cult for various churches of the “Almighty God” cult in different Ili counties and cities. In 2013, Xia contributed 1,500 RMB of ‘donated money’ to the “Almighty God” cult. Defendant Meng Hong participated in the member gatherings of the “Almighty God” cult on numerous occasions, watched, studied, and exchanged “Almighty God” cult contents, received arrangements from her elder sister Meng Xiumei, and used the shop she operated to store, receive, and relay “Almighty God” cult instruction, books, video materials, etc. Meng contributed 800 RMB of “donated money” to the “Almighty God” cult from 2011 to 2013. Meng Xiumei used 500 RMB of it to buy a mobile hard disk for use in producing videos that fabricate and distort the facts. Defendant Zhu Guangying actively participated in the member gatherings of the “Almighty God” cult to watch, learn, and exchange the contents of the “Almighty God” cult. Since the beginning of 2012, Zhu has begun to accept the arrangement of leader Meng Xiumei of the “Almighty God” cult’s Ili District and forwarded many times the “Almighty God” cult’s heretic materials to Kuitun, Bole and other places. Accordingly, the Court of first instance adjudicates as follows: Defendant Meng Xiumei is sentenced to 14 years of imprisonment and deprivation of political rights for 15 five years on the charge of sabotaging the enforcement of laws by organizing and utilizing cult organizations; Defendant Zhong Jun is sentenced to 14 years of imprisonment and deprivation of political rights for five years on the charge of sabotaging the enforcement of laws by organizing and utilizing cult organizations; Defendant Luo Guifang is sentenced to thirteen years of imprisonment and deprivation of political rights for four years on the charge of sabotaging the enforcement of laws by organizing and utilizing cult organizations; Defendant Zhong Hua is sentenced to ten years of imprisonment and deprivation of political rights for three years on the charge of sabotaging the enforcement of laws by organizing and utilizing cult organizations; Defendant Xiao Lanfen is sentenced to six years of imprisonment on the charge of sabotaging the enforcement of laws by organizing and utilizing cult organizations; Defendant Peng Jianbiao is sentenced to five years of imprisonment on the charge of sabotaging the enforcement of laws by organizing and utilizing cult organizations; Defendant Xia Zhonglian is sentenced to four years of imprisonment on the charge of sabotaging the enforcement of laws by organizing and utilizing cult organizations; Defendant Luo Laihui is sentenced to three years and six months of imprisonment on the charge of sabotaging the enforcement of laws by organizing and utilizing cult organizations; Defendant Meng Hong is sentenced to three years of imprisonment on the charge of sabotaging the enforcement of laws by organizing and utilizing cult organizations; Defendant Zhu Guangying is sentenced to three years of imprisonment on the charge of sabotaging the enforcement of laws by organizing and utilizing cult organizations; the seized articles (see the list of seizure by the investigating authorities for details) used by the defendants for the criminal activities of “Almighty God” shall be confiscated. After sentencing, Defendant Meng Xiumei of the first instance filed an appeal on the grounds that the circumstances of her crime were not particularly serious, that she did not participate in the production of the videos, her subjective culpability was not profound, and that she had confessed and showed remorse for her crimes. Defendant Zhong Jun of the first instance filed an appeal on the grounds that there was no evidence proving that he had participated in the illegal organization’s filming of the videos. Defendant Zhong Hua of the first instance filed an appeal on the grounds that the video taken had not defamed the Chinese Communist Party and the Chinese government. Defendant Peng Jianbiao filed an appeal on the grounds that the role he had played posing as a police officer and taking a video did not constitute a crime. Defendant Xia Zhonglian of the first instance filed an appeal on the grounds that the “Xia Lian” Dry Cleaner’s operated by her was not the contact point of the “Almighty God” cult organization in Ili District, that she was a first-time offender and occasional offender of minor subjective culpability, and the sentence in the first instance was excessive. Upon ascertainment at trial: The original judgments asserted that the appellants 16

Meng Xiumei, Zhong Hua, Zhong Jun, Peng Jianbiao, Xia Zhonglian, the defendants of the first instance Luo Guifang, Xiao Lanfen, Luo Laihui, Meng Hong, and Zhu Guangying had long believed in and joined the “Almighty God” cult and participated in the production and dissemination of the “Almighty God” cult propaganda materials and organization, and the use of the “Almighty God” cult to sabotage the enforcement of laws are factually clear, confirmed by physical evidence including “Almighty God” cult books, materials, electronic storage devices/equipment, mobile hard drives, playback devices/equipment, police uniforms, police equipment, prison uniforms and filming equipment, and documentary evidence including photographs, case acceptance registration forms, case decisions, identities, household registration certificates, arrest procedures, case investigation results, detention certificates and detainee health checklists, as well as other evidence including on-site investigation transcripts and photographs, search transcripts, identification records, seized item lists, electronic evidence inspection report, Guo Guangli’s witness testimony, defendant confessions and so on. Based on the facts of appeals filed by the five appellants, combined with the facts identified in the case, the following comprehensive judgments are made: I. Regarding the grounds for appeal of Appellant Meng Xiumei that “the circumstances of her crime are not particularly serious, she was not involved in the production of the videos, her subjective culpability is not profound, and she had confessed and showed remorse for her crimes,” the judgment is as follows: Regarding “the circumstances of Meng Xiumei’s crime are not particularly serious,” investigation shows that Meng Xiumei’s own confession and the statements of the three defendants Zhong Hua, Luo Guifang, and Zhu Guangying mutually confirmed that Meng Xiumei is the leader of the “Almighty God” cult organization in Ili District responsible for commanding and managing various tasks of the “Almighty God” cult organization in Ili District. According to the provisions of Paragraphs 1 and 4 of Article 26 of the Criminal Law of the People’s Republic of China, a principal criminal refers to any person who plays a principal role in a joint crime shall be punished on the basis of all the crimes that he participates in or that he organizes or directs. Being the main offender, the circumstances of Meng Xiumei’s crime should not be merely identified by the 100 books and 61 discs of the “Almighty God” cult seized from her residence. Instead, they should be determined by the fact that all the personnel involved in the case and the people related in other cases were organized and directed by defendant Meng Xiumei, as well as the fact that the activities of the entire “Almighty God” cult organization in Ili District were conducted through the production and dissemination of the “Almighty God” cult propaganda materials and other methods to sabotage the enforcement of laws. Therefore, the circumstances of Meng Xiumei’s crime are particularly serious. Regarding the issue that “Meng Xiumei did not participate in producing the videos,” investigation shows that Meng Xiumei’s confession corroborates with Zhong Hua’s confession, proving that Meng Xiumei set up the video group for video production. Although Meng Xiumei did not directly participate in the production of video filming, 17 as mentioned above, as the commanding manager of the “Almighty God” cult organization in Ili District, Meng Xiumei is the principal offender and should be criminally responsible for the videos produced and filmed by the video group that she had set up. Regarding the issue that “Meng Xiumei’s subjective culpability is not profound, and she had confessed and showed remorse for her crimes,” investigation shows that the Court of first instance has taken into consideration that Meng Xiumei had confessed to the facts of the crime when she was sentenced, that she also pleaded guilty, showed remorse and established a frank confession, when the Court imposed a lighter punishment. 2. Regarding Appellant Zhong Jun’s grounds for appeal claiming that “there is no evidence proving that he participated in an unlawful organization and participated in the video filming,” investigation shows that Zhong Jun’s own confession corroborates with Zhong Hua’s confession, proving that Zhong Jun is a member of the “Almighty God” cult organization. Zhong Jun’s own confession, the four people Zhong Hua, Xiao Lanfen, Luo Laihui and Peng Jianbiao’s confessions, and Guo Guangli’s testimony are corroborative with each other, proving that on five successive occasions, Zhong Jun took part in producing the video contents, the so-called “members of the ‘Almighty God’ cult organization being extorted for confession under torture and their properties being unlawfully seized by the police.” 3. Regarding Appellant Zhong Hua’s claim that “the videos he took part in filming did not defame the CCP and the Chinese government,” investigation shows that Zhong Hua’s own confession corroborates with Zhong Jun, Xiao Lanfen, Luo Laihui and Peng Jianbiao’s confessions, and Guo Guangli’s testimony, proving that on five occasions, Zhong Hua had participated in video filming about the so-called “members of the ‘Almighty God’ cult organization being extorted for confession under torture and their properties being unlawfully seized by the police.” In any country of the world, the police are law enforcement agents. They are the profession and symbol for maintaining public order. Any act involving the fabrication of facts that disparages, defames, or insults the police is regarded as challenging the social order, provoking the government and the country that will cause negative effects to the implementation of administrative regulations. Therefore, the video group personnel including Zhong Hua that fabricated facts to disparage, defame and insult the police has affected the implementation of state laws and administrative regulations. 4. Regarding appellant Peng Jianbiao’s grounds for appeal that “it does not constitute a crime to pose as a police officer and participate in video filming,” investigation shows that Peng Jianbiao’s own confession corroborates with Zhong Hua, Xiao Lanfen, and Luo Laihui’s confessions, proving that on three occasions, Peng Jianbiao participated in video filming about the so-called “members of the ‘Almighty God’ cult organization being extorted for confession under torture and their properties being unlawfully seized by the police.” As mentioned earlier, the video group personnel’s fabrication of facts to disparage, defame and insult the police has affected the implementation of state laws and administrative regulations. 18

Regarding Appellant Xia Zhonglian’s grounds of appeal that the “Xia Lian” Dry Cleaner’s operated by her is not the contact point of the “Almighty God” cult organization in Ili District, that she is a first offender and occasional offender with minor subjective culpability, and the sentencing of first-instance is excessive,” investigation shows that Xia Zhonglian’s own confession corroborates with Luo Guifang’s confession, proving that Xia Zhonglian used the “Xia Lian” Dry Cleaner’s that she operated in the Ren He Yi Ju Community, Jiefang Road, Yining City, as a contact point for the “Almighty God” cult organization in Ili District: Xia Zhonglian received and forwarded instructions, books, and video materials of the “Almighty God” cult organization for various “Almighty God” churches in the counties and cities of Ili. In summary, the grounds for appeals filed by the five appellants are invalid. This Court believes that the “Almighty God” organization, also known as “Practical God” and “Eastern Lightning,” designated as a cult organization and banned by the state in November 1995, is a cult enshrouded by the cloak of religious beliefs in the development of organization members. It poses a real danger and potential threat to the social stability of China. Appellants Meng Xiumei, Zhong Hua, Zhong Jun, Peng Jianbiao, Xia Zhonglian, and the defendants of the original instance Luo Guifang, Xiao Lanfen, Luo Laihui, Meng Hong, and Zhu Guangying have long joined the “Almighty God” cult to organize and participate in the production and dissemination of “Almighty God” cult propaganda, organize and use the “Almighty God” cult to sabotage the enforcement of laws. The conducts of the above-mentioned personnel constitute the crime of sabotaging the enforcement of laws by organizing and utilizing cult organizations. In summation of the above, the findings in the original judgments are clear in facts, conclusive and sufficient in evidence, accurate in conviction, and appropriate in sentencing. The trial procedure is lawful. The appellants’ grounds for appeals are rejected. In accordance with the provisions of Article 225, paragraph 1, subparagraph 1 of the Criminal Procedure Law of the People’s Republic of China, the following ruling is stipulated: The appeal is dismissed, and the original verdict is upheld.
