Miles** I. I. INTRODUCTION On June 6, 2011, Representative Anthony Weiner of New York admitted that he had publicly lied when he claimed that his Twitter feed had been hacked--allowing a lewd photo of a man‘s crotch to be posted publicly on his Twitter account. 1 Further, Weiner admitted that he had actually sent the photo of himself to a young woman in Seattle, Washington, a week earlier and he also acknowledged his involvement in ―several inappropriate‖ electronic relationships with numerous women over a three-year-period. 2 Weiner‘s actions raised several questions, including whether the congressman should resign from his job. 3 On June 16, 2011, ten days after his first press conference concerning the matter, Weiner announced his resignation from his congressional position.4 The question of whether an individual‘s use of social media outside the scope of employment5--meaning in no way furthering the employer‘s interests-- should affect his or her ability to maintain employment is not limited to politicians like Representative Weiner.6 Instead, * Assistant Professor, North Carolina A & T. ** Associate Professor, North Carolina A & T. 1 Chris Cuomo, Rep.
