INTRODUCTION Daniel is a senior partner at a large, internationally recognized law firm. Patricia recently passed the state bar exam and accepted a job with this law firm. Daniel asks Patricia to draft a memorandum on a complex area of law for a group of senior partners. Patricia works long hours completing her first assignment, attempting to im- press the senior partners. The senior partners found a slight omission in the memorandum and requested a new draft. Infuriated, Daniel goes to Patricia’s office. Daniel publicly berates Patricia in front of all the junior associates. Daniel screamed at Patricia, “A lobotomized first-year law student would have done a better job! I cannot believe the state bar would have licensed someone with such diminished brain capacity like you! How did you get hired here? Don’t you know it’s a privilege to be part of this firm? It’s a good thing you didn’t send this to a client and bring any more shame onto our office than you already have! Don’t come back into my office again until you can put logical sentences together!” Daniel leaves Patricia standing in the office with twenty other people in shock of what they witnessed. Staff members whis- per when Patricia walks by. Other attorneys ostracize Patricia the rest of the day because the entire office heard she does not have any “brain capacity.” When Patricia leaves for the day, she is in tears, visibly upset. She does not return for work the rest of the month. Patricia sees a psychologist regularly for treatment because she has previously been diagnosed as highly sensitive.1 She makes an appointment to see her psychologist. Patricia fears she is not a qualified attorney. She experiences panic attacks and severe anxiety, she does not eat, cannot leave her bed, fears any of the emails she re- ceives from senior partners, and sinks into a deep depression because she feels she cannot practice law competently anymore. Patricia brings an action against Daniel in state court for intentional infliction of emotional distress. Daniel’s attorney files a motion to dismiss be- cause Patricia failed to state a claim. Daniel’s attorney argues that even though the conduct was extreme and outrageous, because Patri- cia’s harm was unforeseeable as a result of a non-apparent mental condition (her previous diagnosis as highly sensitive), a reasonable person would not experience severe emotional distress from Daniel’s conduct. The judge grants this motion because a person of reasona- ble sensitivities would not undergo such emotional distress from be- ing publicly berated. A highly sensitive person (“HSP”) is someone predisposed to higher emotional responses to external stimuli from their environ- 1. See infra Part II. 2019 The Highly Sensitive Person’s Redress for IIED 535 ment.2 These responses include observable tendencies such as over- whelming arousals, negative emotionality, and lower levels of socia- bility, while also being acutely aware of subtle environmental de- tails.3 Under current tort law, a plaintiff seeking compensation for emotional distress resulting from intentionally cruel conduct would claim intentional infliction of emotional distress (“IIED”).4 Yet, to determine if a plaintiff suffered severe emotional distress, the law as- sumes that there exists a person of reasonable sensitivities. “The law intervenes only where the distress inflicted is so severe that no rea- sonable [person] could be expected to endure it.”5 Courts construe this widely accepted rule to mean a person of “ordinary sensitivi- ties.”6 HSPs, let alone anyone else in society, can hardly have their emotional status judged against a person of ordinary sensitivities. At first glance, IIED seems intimately connected to HSPs be- cause the tort serves as a vehicle of recovery for the HSP’s severe emotional distress. Foreclosing IIED to only those of reasonable sensitivities has introduced an unintentional discriminatory nature into tort law.9 This Note argues that courts should recognize that there is no such thing, in isolation, as a “reasonable” or “unreasonable” reaction to intentional cruelty that rises to the level of extreme and outrageous conduct. More specifically, in light of almost a quarter century of re- search on HSPs and recognition that as many as one in five persons are highly sensitive, courts should permit plaintiffs to present expert testimony about HSP temperament traits and instruct jurors to con- sider and decide how a “reasonable HSP” would have reacted to the particular defendant’s conduct. Part II explores the almost quarter century of HSP research, focusing on HSP temperament traits indica- tive to diagnosis and showing a HSP’s predisposition to a greater risk of suffering severe emotional distress from an external stimulus. Part III analyzes the virtually universal rule and central cause of the fore- closure to recovery for the HSP, arising from comment j to section 46 of the Restatement (Second) of Torts (“Restatement (Second)”), re- quiring an IIED claimant to effectively show that their emotional dis- tress was “reasonable” and was not simply an “unreasonable” form of emotional distress. Part III will challenge this rule as outmoded as applied in three ways: (1) in the context of the historical psychologi- cal research alongside ongoing HSP and psychological research; (2) that a “reasonable” emotional person is a legal fallacy; and (3) by courts regularly affording little or no analysis after finding the con- duct to be extreme and outrageous. Part IV proposes that allowing a HSP-plaintiff in an IIED action to call expert witnesses to aid the court in determining whether the HSP-plaintiff’s emotional distress is 8. BUEHLER† For more than a century, courts have universally applied the eggshell plaintiff rule, which holds tortfeasors liable for the full extent of the harm inflicted on vulnerable “eggshell” victims. Liability attaches even when the victim’s condition and the scope of her injuries were completely unforeseeable ex ante. This Article explores the implications of this rule by providing a pioneering economic analysis of eggshell liability. It argues that the eggshell plaintiff rule misaligns parties’ incentives in a socially undesirable way. The rule subjects injurers to unfair surprise, fails to incentivize socially optimal behavior when injurers have imperfect information about expected accident losses, and fails to account for risk aversion, moral hazard, and judgment-proof problems.

Loomis* INTRODUCTION As Gwendolyn Robbins’ seventy-year old father drove along a high- way in upstate New York, his car veered off the road at sixty-five miles per hour and turned over in a culvert on nearby farmland.1 After a long day of driving from New York City to Plattsburgh and back, he fell asleep at the wheel.2 Gwendolyn was a passenger in the car, and she suffered a severely damaged left hip and an injury to her right knee.3 Gwendolyn was faced with a choice: she could accept well-recognized and established surgical procedures, which would offer her the prospect of a good recovery and near-normal life; or, she could refuse these procedures and accept the inevi- table necrotic development in the bone structure of her injured limbs, which would ultimately lead to a wheelchair-bound life.4 For Gwendolyn, there was no question which option to take: the wheelchair-bound life. Gwendolyn was a devout Jehovah’s Witness, and she refused the surgical procedures because her religion prohibited blood transfusions, which the surgeries would require.5 When a defendant injures a plaintiff, tort law normally applies the “Avoidable Consequences Doctrine,” or the duty to mitigate damages. The plaintiff is expected to take reasonable steps to minimize her anticipated losses.

In this edition of Seaview, we examine whether under English and Hong Kong law, (subject to apportionment) the owners of a vessel are responsible for all of the damage to the vessel with which she collides and her cargo, if the damage to the other vessel and her cargo is exacerbated by the poor condition of the latter vessel. Introduction In most cases, a collision between two vessels caused by negligent navigation gives rise to mutual claims in tort between the vessels. In order for a vessel to be found liable for damages in tort arising out of a collision at sea, it must first be proven that the vessel had a duty of care, for example, a duty to take reasonable care and use reasonable skill to prevent the vessel from doing injury (The Voorwaarts and the Khedive (1880) 5 App Cas 876) or a duty to exercise good seamanship. Then it must be shown that the duty of care was breached by the vessel's negligent action, that damages were suffered as a result and that the damage suffered was caused by the vessel's negligence. In addition to the negligence, the Privy Council established in the case of The Wagon Mound (No 1) [1961] 1 AC 617, the principle that to find a party liable for negligence, the damage caused must be reasonably foreseeable. To what extent then, does damage have to be foreseeable before a party may be considered liable for negligence? Let us examine the eggshell skull rule.

Yet the legal academy has criticized many private precautions because they merely shift crime onto other, less guarded citi- zens, rather than reduce crime. The conventional wisdom likens such precaution-taking to rent-seeking: citizens spend resources to shift crime losses onto other victims, without reducing the size of those losses to soci- ety. The result is an unambiguous reduction in social welfare.     STUDENT ANSWER 1: 1. No viable tort claim for battery, but viable claim for negligence against Dennis Penny does not have a viable tort claim for battery against Dennis. A battery is committed when the defendant intentionally causes harmful or offensive bodily contract with the plaintiff. Dennis had no intent to cause harm to Penny or to purposefully hit her with a baseball. Dennis’s baseball may be negligence but it is not a battery. Penny does have a viable tort claim against Dennis for negligence. To recover in tort Penny must plead and prove that Dennis owed a duty of reasonable care to her, that he breached the duty owed, and the breach proximately caused her physical injury. Dennis owed a duty to use reasonable care and not hit people with baseballs that were foreseeably walking outside the stadium. It was foreseeable that someone could be hit because it had previously happened and the zone of danger was Oak Street where the baseballs had previously been hit. Dennis breached that duty when he hit a ball out of the park, which proximately caused Penny’s injuries. However, under the doctrine of respondeat superior Fernbury Flies will be liable for Dennis tort. Torts of employees may be vicariously imputed to the employer if the tort was committed within the scope of an in furtherance of the employers business. The tort must be closely connected with what the employee was employed to do, substantially within the authorized time and space limits, and motivated in part by a purpose to serve the employer.

Greenberg* The Internet, and social media in particular, provides the means by which billions of users may interact with one another in the new “global village” and shape and disseminate messages beyond the boundaries of the traditional community. As more of our interpersonal interactions take place through social media, our online presence becomes a manifestation of our existential selves, subject to the same reputational and privacy risks as in the real world. This Note explores the effect on our privacy interests when we use social media platforms without restraint by electing to share private information with hundreds or thousands of “friends” and second, third, and fourth degree connections. By applying the principles of the libel-proof plaintiff doctrine to privacy law, this Note argues that there is a point at which broad self-exposure negates a reasonable expectation of privacy such that consent to disclosure crosses a threshold and extinguishes the right to privacy for the entire range of issues disclosed.
