Roth Professor of Economics University of Texas at El Paso The transition from socialist to market economics is typically informed by outcomes-based social welfare theory (SWT). Institutionless, intentionally value- free SWT is ill-suited to this enterprise. The only evaluative standard to which it gives rise—efficiency—is indeterminate, and the theory is not accommodative of other dimensions of moral evaluation. By contrast, the contractarian enter- prise focuses on the role and importance of formal and informal institutions, including ethical norms. Given that individuals should be treated as moral equivalents, the project assigns lexical priority to rights and regards justice as impartiality. This explicitly normative, institutional approach permits analysis of potential conflicts between informal norms and prospective, formal rules of the games. Moreover, it underscores the instrumental and intrinsic value of rights in the transition process. Finally, the emphasis on impartiality—embodied in the generality principle—facilitates analysis of constitutional constraints on behav- ior that is inimical to the transition process. The Transition: The Consequentialist Approach It is clear that the transition from socialist to market economies has typi- cally been informed by received, consequentialist social welfare theory (here- after referred to as SWT).1 Because SWT is consequentialist, institutionless, and intentionally value-free it should come as no surprise that the standard reform prescription begins at the endpoint, an idealized market, phrasing everything in those terms, ignoring the crucial question of how reforms engage existing soci- ety. -

President Ronald Reagan Letter to General Secretary Mikhail Gorbachev March 11, 1985 THE WHITE HOUSE WASHINGTON March 11, 1985 Dear Mr General Secretary As you assume your new responsibilities, I would like to take this opportunity to underscore my hope that we can in the months and years ahead develop a more stable and constructive relationship between our two countries. Our differences are many, and we will need to proceed in a way that takes both differences and common interests into account in seeking to resolve problems and build a new measure of trust and confidence. But history places on us a very heavy responsibility for maintaining and strengthening peace, and I am convinced we have before us new opportunities to do so. Therefore I have requested the Vice President to deliver this letter to you. I believe our differences can and must be resolved through discussion and negotiation. The international situation demands that we redouble our efforts to find political solutions to the problems we face. I valued my correspondence with Chairman Chernenko, and believe my meetings with First Deputy Prime Minister Gromyko and Mr. Shcherbitsky here in Washington were useful in clarifying views and issues and making it possible to move forward to deal with them in a practical and realistic fashion. In recent months we have demonstrated that it is possible to resolve problems to mutual benefit. We have had useful exchanges on certain regional issues, and I am sure you are aware that American interest in progress on humanitarian issues remains as strong as ever. In our bilateral relations, we have signed a number of new agreements, and we have promising negotiations underway in several important fields. -

This is a distinction that no other school can claim. On March 2, 1893, * L-41.,_, with two days remaining in his administration, President Benjamin Harrison * * accepted an appointment as Non-Resident Professor of Constitutional Law at * Stanford University. * Harrison's decision was a triumph for the fledgling western university and its * * founder, Leland Stanford, who had personally recruited the chief of state. It also * provided a tremendous boost to the nascent Law Department, which had suffered * months of frustration and disappointment. * David Starr Jordan, Stanford University's first president, had been planning a law * * program since the University opened in 1891. 3 The End of American Exceptionalism The Social Question in the United States Fred Block Exceptionalism has been the dominant theme in United States history from its founding. At the time that the United States won its independence, the old nations against which the United States formed its identity were, in fact, the great European imperial powers—England, France, the Netherlands, and Spain, and the United States differed from these nations in critical ways. First, to expand and grow, the United States had no need to establish overseas colonies; it could draw immigrants from Europe and extend its territorial empire westward. It was able to create an internal colony in the American South where chattel slavery was the central economic institution. Second, it led the world in developing a democratic political system in which the right to vote was given to most adult white males. However, the tensions between slave states and free states resulted in the creation of a uniquely constrained central government.1 Third, the combination of early democracy, the continuing inflows of both coerced and free laborers, and the rich- ness of the American continent created a uniquely productive economy that sus- tained unprecedented levels of prosperity for two full centuries. Together, these elements made the trajectory of the United States exceptional.2 But over the last forty-five years, American exceptionalism seems to have come to an end. Werner Sombart insisted that there was no socialism in America because “all socialist utopias came to nothing on roast beef and apple pie,”3 mean- ing that the material prosperity and upward mobility available to white workers in the United States precluded the kind of mass socialist movements that emerged in Europe. -

Aron Tabor April 26, 2019 iii iv Abstract The first two decades of the twenty-first century saw an unprecedented proliferation of the discourse of American exceptionalism both in scholarly works and in the world of politics; several recent contributions have characterized this notion in the context of a set of beliefs that create, construct, (re-)define and reproduce a particular foreign policy identity. At the same time, some authors also note that the term “American exceptionalism” itself was born in a specific discourse within U.S. Communism, and, for a period, it was primarily understood with reference to the peculiar causes behind the absence of a strong socialist movement in the United States. The connection between this original meaning and the later usage is not fully explored; often it is assumed that “exceptionalism” existed before the label was created as the idea is traced back to the founding of the American nation or even to the colonial period.
