This seems to be the outcome of Great Peace Shipping Ltd v Tsavliris Salvage (International) Ltd [2002] 3 WLR 1617. It is unjust to hold the parties to their original obligations in the light of the changed circumstances. Cardiff City refused to pay Nantes the £15m transfer fee and this was in line with s 1(2) of the Frustrated Contracts Act: all money still owing under the contract ceases to be due. This is followed by the provision that money already paid is recoverable and a party who has received valuable benefits under the contract, other than money, can be ordered by the court to pay compensation for this. The question is: did Cardiff receive valuable benefits in a heightened profile and increase in reputation by signing Sala? The law of France must also be involved here in some way. Cardiff therefore planned to submit to FIFA, football’s world governing body, to explain the withholding of the first instalment of the fee amid a row as to which club owned Sala when he was killed? GFFN 100 2018 THE GFFN 100: AN INTRODUCTION Welcome to another edition of the Get French Football News 100. Published at the end of ev- ery year by GFFN, the guide you are reading is as detailed and comprehensive a set of player profiles as one is likely to find, especially in English. Some of these players are well-known, even to the casual fan, and though they have been the subjects of countless profiles, we hope that you can gain a bit more depth in knowledge of their stories. This is especially true with the likes of Neymar and his Paris Saint-Germain team-mate Kylian Mbappé. In 2018, neither was ever far from the limelight in a year in which France won the World Cup, thanks in large part to the teen- age sensation. Neymar may have garnered the odd headline for less positive reasons, but both remain as compelling off the pitch as they do on it. It is thus no surprise to see Mbappé top the rankings again; it does not take much objectivity to realise his immense talent and potential, but the present document is much more than a narra- tive driven by celebrity. We have watched the matches that do not generate headlines, seen the teams that are rarely on television, especially internationally, and artfully blended statistical anal- ysis with old-fashioned scouting to create what we feel is a definitive guide to the professionals currently plying their trade in France. If some rankings seem high, or low, read the profiles before making a snap decision as to our choices; this is a meritocracy.

  • A Review of the Emiliano Sala Decision
Sports Law/ Dispute Resolution 17th February 2020 Olukolade Ehinmosan1 A REVIEW OF THE EMILIANO SALA DECISION Background The January 2019 Summer Transfer Window was an exciting beehive of European football transfer activity. Arguably the most notable transfer of the Window, FC Nantes Centre Forward Emiliano Raul Sala sealed his move to then English Premier League outfit, Cardiff City. Sala expressed elation and even dubbed the transfer a “dream move.”2 The atmosphere soon became sour with the tragic demise of Sala in a devastating plane crash while travelling from France to team up with his new club, Cardiff City FC. Within a few days of the incident, searches and investigations ensued, including an investigation by the Air Accidents Investigations Branch (AAIB), as the plane had gone missing. On its part, FC Nantes lodged a complaint against Cardiff City before the FIFA Bureau of the Players’ Status Committee (PSC). The complaint ripened into a full-blown dispute which we have endeavoured to review below. FC Nantes, France vs. Cardiff City FC, Wales The Bureau comprising a four-man panel sat and passed a decision in Zurich, Switzerland on 25 September 2019.3 1 Olukolade Ehinmosan, Associate Dispute Resolution Department, SPA Ajibade & Co., Lagos, NIGERIA. 2 See <https://www.sportbible.com/football/news-sala-was-just-about-to-fulfill-his-dream-of-playing- in-the-prem-20190123> accessed February 11, 2020 at 9:28 am. 3 See <https://resources.fifa.com/image/upload/player-emiliano- sala.pdf?cloudid=zz1mucunt6ydvrzqrqdw> accessed February 11, 2020 at 9:28 am. GET FRENCH FOOTBALL NEWS 2020/2021 Ligue 1 Preview Guide Rarely has French football been simultaneously seemingly on the verge of a breakthrough moment in Europe, with the Champions’ League achievements of Lyon and Paris Saint-Ger- main not yet brought to their conclusion as I write this, or so seemingly vulnerable. For all of the achievements that teams like Lille or Lyon have had in recent years, French clubs still re- main prey for those with deeper pockets, and success only makes their most talented players that much more attractive - the unsettled nature of things at both the Stade Pierre Mauroy and Groupama Stadium are testament to that. Still, though, there is much to celebrate as a new season of Ligue 1 dawns - yes, Paris Saint-Ger- main look likely to stroll to the title again, but Marseille and their boisterous supporters will relish being back in Europe’s elite competition after finishing second. There is joy, too, at Rennes, where the Breton side have continued their steady improvement under Julien Stéphan and been rewarded with a place in the Champions’ League. For all of their acheivements last campaign, though, both of those teams may struggle, as Lille did last season, to negotiate playing in Eu- rope. Both have made important additons this summer, though, in the form of the influential Álva- ro González making his loan move permanent for Marseille and Rennes making a canny move in plucking Martin Terrier from Lyon to bolster their attack. Among their competitors, however, Lille have been the big spenders, splashing out €30m on the Canadian attacker Jonathan Da- vid, his success in the Belgian league hopefully boding well for him as he hopes to succeed the departed Victor Osimhen.

  • 2018/2019 Ligue 1 Preview Guide
2018/2019 LIGUE 1 PREVIEW GUIDE As Ligue 1 begins again, there is a rare air of expectancy. No, there haven’t been the sort of blockbuster transfers of the likes of Kylian Mbappé or Neymar, just the usual flow of some of the league’s best players to England and Spain, in the form of Malcom, Fabinho, Thomas Le- mar, Issa Diop, and others. But there have also been a number of brilliant signings made under the radar, and given the recent record of French clubs in turning young players around for con- siderable profit, the league’s official new slogan “The League ofalents” T may be more apt than the casual observer may realise. Paris Saint-Germain, of course, remain prohibitive favourites for the title, but have enough weaknesses, particularly at left back and in defensive midfield as new manager Thomas uchelT toys with the idea of a back three. Still, though, this marks a decided summer of change for the champions, for whom Gianluigi Buffon is their only signing, a marked contrast from previous spending. Still, though, a full season of Neymar and further development from Kylian Mbappé should leave them well-placed to repeat. Away from the capital, Lyon and Marseille haven’t experienced much in the way of movement, with both clubs losing only a few spare parts, as Nabil Fékir’s mooted move to Liverpool failed to come to fruition. The additions of Léo Dubois and Martin Terrier follow on from their recent trend (Lucas Tousart, Tanguy N’Dombélé) of buying young players from other clubs, hoping to reap the benefits by selling them on.
