It was chaired by the Lord Chancellor and all the judges of the Supreme Court were members. The Council continued to function until 1981. At that time a new Judges’ Council was set up chaired by the Lord Chief Justice with a smaller membership of the more senior judges. In 2002 the Council adopted a written Constitution and has subsequently widened its membership to include representatives from all ranks of the Brief history judiciary, including the Supreme Court, the Court of Appeal, the High Court, the Circuit and District Benches, the Magistracy and the Tribunals. In March, 2006 the Council further revised its Constitution and membership following the coming into effect of the Constitutional Reform Act 2005. This Act and the Concordat of 26th January 2006 between the Lord Chancellor and Lord Chief Justice vest in the latter very considerable responsibilities in respect of the judiciary and of the business of the Courts of England and Wales. The Lord Chief Justice exercises these responsibilities through the Judges’ Council and the Judicial Executive Board. It has no constitutional status but is protected by legislation in the Constitutional or legal form of the Judicature Act 1873 and the Constitutional Reform Act status/basis 2005.

Such a court had been debated, but ultimately rejected, by successive governments for over half a century. In each debate, members of the judiciary declared that a court for appeals in criminal cases held the potential of destroying the world-respected English judicial system. The 1907 debates were no less contentious, but the newly elected Liberal government saw social reform, including judicial reform, as their highest priority. After much compromise and some of the most overwrought speeches in the history of Parliament, the Court of Criminal Appeal was created in August 1907 and began hearing cases in May 1908. A Veritable Revolution is a social history of the Court’s first fifty years. There is no doubt, that John Walton and the other founders of the Court of Criminal Appeal intended it to provide protection from the miscarriage of justice for English citizens convicted of criminal offenses.

Gabriel Popoviciu (“the appellant”) was convicted in Romania of two offences: accessory to aggravated abuse of power, and bribery. He was sentenced to a total of 7 years’ imprisonment, less the 24 hours he had spent under arrest. The whole of his sentence remains to be served. On 3 August 2017, a European Arrest Warrant (“EAW”) seeking the return of the appellant was issued by the Curtea de Apel in Bucharest (“the Bucharest Court of Appeal” or – in its capacity as the requesting judicial authority – “the respondent”). The appellant was arrested on 14 August 2017. On 12 July 2019, after a hearing in the Westminster Magistrates’ Court on 10 days spread over a period of nearly 6 months, District Judge Zani (“the DJ”) ordered the appellant’s extradition.

[By the Supreme Court of Judicature Act 1873, 36 & 37 Vict. cap. 66, sect. 3, as amended by the Amendment Act of 1875, 38 & 39 Vict. cap. 77, § 9, the Court of Chancery, the Courts of Queen's Bench, Common Pleas, and Exchequ~r, and the Courts of Admiralty, Probate, and Divorce, were united and consolidated together as one SuPREME CouRT OF JUDICATURE. • By the Supreme Court of Judicature Act 1877, 41 Vi et. cap. 9, sect 4, it was enacted that the ordinary Judges of the Court of Appeal should be styled Lords Justices of Appeal, and the Judges of the High Court of Justice (other than the Presidents of Divisions), should be styled Justices of the High Court. • By section 5 it was enacted that a puisne Judge of the High Court of Justice should mean for the purposes of the Act, a Judge of the Hil;h Court of Justice other than the Lord Chancellor, the Lord Chief Justice of I<~n~lan•l, the }!aster of the Rolls, the Lord Chief Justice of the Common Pleas, aml the Lord Chief Baron, and their successors respectively. The Supreme Court has no judicial functions. It never sits a~ a Collrt. It consists of two permanent divisions, viz, "HER }!AJE~ry's HIGH COURT OF JUSTICE" and" HER \lAJESTY'S COURT OF APPEAL." By an order in Council which came into force on 26th February, 11'81, the Three Common Law Divisions were consoli­ dated into one, to be called Queen's Bench Division, & the offices of Chief Justice of the Common Pleas & Lord Chief Baron were abolished.
