CHAPTER ONE 1.1 the PLANNING PROCESS in Terms of Section 24(1)
CHAPTER ONE 1.1 THE PLANNING PROCESS In terms of section 24(1) and (2) of the Local Government Municipal Systems Act (No 32 of 2000) municipalities should comply with the following key planning imperatives at all times, namely: . “The planning undertaken by a municipality must be aligned with, and complement, the development plans and strategies of other affected municipalities and other organs of state so as to give effect to the principles of co-operative government contained in the Constitution. Municipalities must participate in national and provincial development programmes as required in section 153 (b) of the Constitution.” In addition to the above, regulation 2 (1) (d) of the Local Government Municipal Planning and Performance Regulations, 2001 stipulates that the municipality’s Integrated Development Plan must at least identify “all known projects, plans and programs to be implemented within the municipality by any organ of state.” The above are clearly the key planning basis for Ndlambe Municipality in the development and review of its IDP. This is a progressive planning rationale and it has been entrenched into a ‘simple’ legislative framework to ensure consistence and an enhanced quality of the IDP. The principle of co-operative governance underpins this development planning rationale. Co-operative governance is enshrined in the Constitution of the Republic of South Africa as a practice for maximum benefit. This chapter seeks to identify those elements of convergence between the different plans, projects and programmes within the District, Provincial and National levels. 1.1.1 National Policy Directive – Medium Term Strategic Framework (MTSF): In July 2009 the Minister of Planning formulated and distributed a Medium Term Strategic Framework (MTSF) to guide Government Programs in the Electoral Mandate Period between 2009 and 2014. -

PROCLAMATION by the MEC for Economic Development, Environmental Affairs and Tourism No.? ? January 2019 1. I, Lubabalo Oscar Mabuyane, Member of the Executive Council for Economic Development, Environmental Affairs and Tourism (DEDEAT), acting in terms of Sections 78 and 79 of the Nature and Environmental Conservation Ordinance, 1974 (Ordinance No. 19 of 1974), and Section 18 of the Problem Animal Control Ordinance, 1957 (Ordinance 26 of 1957) hereby determine for the year 2019 the hunting season and the daily bag limits, as set out in the second and third columns, respectively, of Schedule 1, hereto in the Magisterial Districts of the Province of the Eastern Cape of the former Province of the Cape of Good Hope and in respect of wild animals mentioned in the first column of the said Schedule 1, and I hereby suspend and set conditions pertaining to the enforcement of Sections 29 and 33 of the said Ordinance to the extent specified in the fourth column of the said Schedule 1, in the district and in respect of the species of wild animals and for the periods of the year 2019 indicated opposite any such suspension and/or condition, of the said Schedule 1. 2. In terms of Section 29 (e), [during the period between one hour after sunset on any day and one hour before sunrise on the following day], subject to the provisions of this ordinance, I prohibit hunting at night under the following proviso, that anyone intending to hunt at night for management purposes by culling any of the Alien and Invasive listed species, specified species, Rodents, Porcupine, Springhare or hunting Black-backed jackal, Bushpig and Caracal, in accordance with the Ordinance, must apply to DEDEAT for a provincial permit and must further notify the relevant DEDEAT office, during office hours, prior to such intended hunt. -

Notice of an Environmental Assessment dated 30 September 2011 the revised Basis Information Document, project progress report no 5 and the draft Basic Assessment Report dated June 2012 has reference. 2. Members of the project team met with committee members of Cannon Rocks and Boknesstrand Ratepayers Associations on 19 July 2012. During this meeting it was agreed that the members of the project team and the Ndlambe Ratepayers Forum (NRF) will meet on 8 August 2012. The purpose of these meetings was to clarify uncertainties and discuss concerns identified by the members of the NRF. Various questions as well as studies required, were also raised during these meetings. 3. A letter by Mr Johan de Wet, Appendix A, was also drafted to address concerns regarding the project. 4. Attached, for ease of reference, the submission from Kleinemonde Ratepayers Association, Appendix B, dated January 2012. To a large extend none of the issues raised in the submission have been addressed in progress report no5. However, some specific issues are included under Ndlambe East Project Design below. 5. Concerns and questions addressed in both appendices must also be addressed. 6. The following design standards are used in the document. -
