By Maryanne Kaishian, Brooklyn Defender Services In my years as an attorney with Brooklyn Defender Services, I have witnessed a disturbing truth: police lie so often there is a word for it. “Testilying” happens in court and on paperwork, even when an incident was caught on video. Cops also lie to the public about policy issues to maintain power. Commissioner Dermot Shea and other top NYPD officials continue their campaign of lies and disinformation against bail reform, which gave all New Yorkers some of the same pre-trial rights as the wealthy – namely, the right to fight a case while free and presumed innocent. Shea claims, contrary to the NYPD’s own data, that the re- cent tragic shootings in NYC are the result of more equitable treatment of poor New Yorkers facing certain criminal charges. He would have us believe that the police are so disempowered by critics that they can no longer swoop in to stop crime. Shea and NYPD brass also blame the City Council’s legisla- tion that bans police chokeholds, highlighting both the inherent violence of policing and the inefficacy of attempts to reform the police. Chokeholds have been banned since 1993 and are already broadly defined by the NYPD’s own Patrol Guide as “any pres- sure on the throat or windpipe.” Proposed use-of-force legislation would simply codify the NYPD’s own existing rules, which they routinely ignore. In any case, the Council bill was not in effect when shootings occurred over the weekend. Moreover, the current rate of shootings for 2020 is no higher than that of 2015 — prior to bail reform — when Broken Windows-policing advocate Bill Bratton was com- missioner. The truth is that the NYPD has emerged from a global pan- demic and economic crisis — when summer youth programs were gutted and public school funding was stripped — with its budget and outsized power intact. Plans to hire 500 new cops for the subways are forging ahead even as the city made major cuts to its Fair Fares program, which subsidizes MetroCards for low-in- come New Yorkers. Now that demands for accountability and defunding have gained traction, the NYPD faces a PR crisis of its own making. A Siena poll released in June shows that most New Yorkers, including 87 percent of Black residents, do not feel safer when they see a cop. Rather than attempting fundamental change, the Department is determined to prove itself indispensable in its cur- rent, violent iteration. To this end, the NYPD and its apologists peddle the false- hood that policing consists almost entirely of stopping crime in its tracks. They need you to believe that you, too, could be killed if you manage to divert a single cent from their coffers to your community. The reality is that police are generally not violence interrupt- ers, and they often do not solve crimes after they have occurred. Just 13 percent of all NYPD arrests are for crimes classified as “violent felonies.” Of those, only half result in a conviction of any kind. Stud- ies show that increasing the size and budget of a police force does not directly correlate with safer streets. Even as spending on po- licing has increased, most murders in low-income neighborhoods remain unsolved. The NYPD demands accountability from everyone but themselves. The Department refuses to require personnel to attend virtu- al misconduct hearings or provide body camera footage to inves- tigators. Officers without masks beat masked demonstrators on video, after weeks of sometimes-violent mask-wearing enforce- ment, then insisted that more cops were essential for public safe- ty. We must divest from policing, not simply legislate palatable ways for police to inflict harm while the NYPD drains the city’s finite resources. Every dollar spent on policing is a dollar that is not spent on schools, parks, housing, employment initiatives or alternatives to policing with demonstrated efficacy. We have al- ready seen these choices play out to devastating consequences. And yet, against all evidence, the NYPD doggedly insists this city would improve if only the Police Department had more cops, more funding, more power and less criminal justice reform. The park, located in a once vacant lot beneath the AirTrain tracks, is the result of a 15-year-old effort to extend Atlan- tic Avenue to 95th Street and expand access to Downtown Jamaica from the Van Wyck Expressway. Former attorney Michael Kohn, 70, ciphoned cash from clients’ bank accounts after represent- ing them in real estate and personal injury matters between 2013 and 2017, said Queens District At- torney Melinda Katz. “The victims trusted the defendant to act on their behalf, when they hired him to handle var- ious legal matters,” Katz said. Instead the de- fendant allegedly pocketed tens of thousands of dollars that should have been distributed to his cli- ents.” In one instance, Kohn allegedly stole more than $80,000 from a victim after handling the sale of a property in Woodside. Another client who was awarded $90,000 in a 2015 civil settlement never received any of that money, Katz said. A third victim was administering a dead rel- ative’s estate when they hired Kohn to handle the sale of a Douglaston property that sold for $650,000 in 2013. The victim allegedly received just $100,000 after the sale. Kohn, who lives on Long Island, resigned from the bar in January 2019. Kohn was released on his own recognizance and ordered to return to court on Oct. 27. He faces 15 years in prison if convicted. Specifically, Melcer alleged that in December 2016, the victim and his brother were playing in a soccer match of the premises of the Juan Morel Campos Secondary School in Brooklyn. According to the complaint, after the game was ended by the referees due to excessive violence during the match, members of the opposing soccer team stabbed the victim and his brother, Hon. In an order dated Oct. 5, 2018, Hon. Reginald Boddie denied the plaintiffs’ motion. Thereafter, the plaintiffs moved to stay the proceeding until the related criminal case against the assailants was completed and the defendants cross­moved to dismiss the complaint as asserted against them. In an order dated May 2, 2019, the Supreme Court denied the plaintiffs’ motion for a stay and granted the defendants’ cross motion. Melcer and the other plaintiffs appealed, and the justices of the Appellate Division, Second Department affirmed the order. The justices agreed with the Supreme Court that the plaintiffs failed to demonstrate that the defendants obtained actual knowledge of the essential facts constituting the claims within 90 days after the claims arose or a reasonable time thereafter. They found that the criminal complaint prepared by the NYPD was not evidence that the defendants acquired actual knowledge of the essential facts underlying the claims against them. The justices noted that the NYPD complaint failed to provide actual notice of the facts constituting the plaintiffs’ claims of negligent supervision, failure to provide adequate security and staffing, failure to prevent foreseeable injury and failure to call for additional police support; or that the victim’s brother was injured as a result of the defendants’ alleged negligence. In addition, the justices found that the plaintiffs did not demonstrate a reasonable excuse for their failure to serve a timely notice of claim. They explained that the fear of retaliation by the government because of the victim’s brother and other family members’ lack of legal status in the United States was not reasonable. Finally, the justices concluded that the plaintiffs failed to present any evidence that the defendants were not substantially prejudiced by the one­year delay. They determined that the delay deprived the defendants of the opportunity to promptly find and interview witnesses and obtain a medical examination of the injured plaintiff or otherwise conduct a timely and meaningful investigation. —Melcer v. Muller filed a complaint in Kings County Supreme Court, Civil Term against the city of New York, as the owner of the building where she fell, and others in an effort to recover damages for her personal injuries. In the Supreme Court, the city moved for summary judgment dismissing the complaint as asserted against it. In an order dated March 13, 2019, Hon. Kathy King denied that branch of the city’s motion.
