SECTION 1.0 INTRODUCTION

1.1. Introduction In this report activities carried out towards the implementation of Resettlement Plan (RP), Indigenous People’s Pan (IPP) and other related Social Safeguards have been presented for the reporting period from July to December 2018.

1.2. Project Background Asian Development Bank (ADB) has approved the loan for South Asia Sub Regional Economic Cooperation (SASEC) Road Connectivity Investment Program (SRCIP). The SRCIP is a multi- tranche financing facility (MFF) that aims to improve about 500 km of priority road sections in North Bengal and Northeast of India, through an investment program set out in phases (tranches). The first tranche includes the package in the State of Manipur: Construction of Imphal-Kangchup-Tamenglong Road. Public Works Department (PWD), Manipur is the Executing Agency for the project. The project contracts is based on FIDIC documents, harmonized for multi-lateral banks, and is to be executed as item-rate, bill-of-quantities (BOQ) construction contracts.

1.3. Project Description

1.3.1. Imphal-Kangchup-Tamenglong Road The road construction package, i.e. Imphal-Kangchup-Tamenglong Road starts from Imphal and ends at Tamenglong. The instant road was originally proposed as part of Imphal- Tamenglong-Tousem-Haflong Road which would have become an important link of the SASEC Road Network/ Connectivity. The Imphal-Tamenglong road will provide direct and shortest connectivity to Tamenglong, District Headquarter. Subsequently when the further stretch from Tamenglong to Haflong is constructed, Imphal will get connected to the East West corridor at a distance of approximately 187.0 km against the existing 267.0 km, thus providing the shortest connecting link between ASEAN and SASEC countries. It will also lessen the distance to Guwahati resulting in considerable Vehicle Operating Cost (VOC) savings and Travel Time savings. The length of the main alignment i.e. from Imphal-Kangchup-Tamenglong (IKT) is 103.020 km with two spur alignments connecting Haochong (4.150 km) and Kabui Khullen (0.800 km). The total length works out to 107.970 km. The initial 12.900 km of this road alignment, starting at Naoremthong in Imphal, up to Kangchup, follows the existing road and falls in plain terrain (Valley Section). Further alignment between Kangchup to Tamenglong (about 90 km) is Greenfield alignment following existing tracks at certain locations and falls in hilly terrain (Hill Section). The project stretch passes through four districts namely Imphal West, , and Tamenglong, with major part in Noney and Tamenglong Districts. The project road from Imphal to Tamenglong via Kangchup passes through 30 villages along the project alignment. It is proposed to improve the first 5.54 Km length to four lane divided carriageway and next 7.36 km length to two lanes with paved shoulder and the remaining hill stretch to two lanes. Spurs will be constructed to intermediate lane (5.5m) standards.

SECTION 2.0 SOCIAL SCENARIO OF THE PROJECT

2.1. Introduction Imphal-Kangchup-Tamenglong road is divided in to two sections based on its geographical and social features. The 1st section i.e. from Imphal-Kangchup is in plain area falling in and inhabited by both general and tribal people having private ownership of land. The 2nd section i.e. Kangchup to Tamenglong is completely hilly area falling in (etched out of District), (etched out of ) and Tamenglong District inhabited by tribal community only having community/customary landholding system. The following map (Figure 2) shows the distribution of newly formed districts along with the existing ones summing altogether to 15 districts1. Source: Government Website of Manipur (As on 11th April 2017) Two separate Resettlement Plans (RPs) are prepared for these two sections treating them as separate subprojects. Moreover, a separate Indigenous Peoples Plan (IPP) has also been prepared keeping in view project impacts on many tribal communities living along the subproject, especially in the Hill Section. The project road section from km 0+000 to km 12+900 is in the Valley Section. The available RoW for this road section is not sufficient to accommodate the widening proposal and therefore acquisition of additional strip of land is required for the entire section. SIA and land acquisition is in process. The road section from Imphal (Naoremthong, Ch. 0+000 km) to Kangchup (Ch. 12+900 km) is valley Revenue Land. State Government has decided to acquire land for the construction of

the project road through acquisition of land from land owners as per the provisions of Right to Fair Compensation and Transparency in Land Acquisition Rehabilitation and Resettlement Act (RFCLARRA), 2013. The project road section from 12.900 km to 103.020 km which falls in the Hill Section does not come under revenue land. As per the provision of Memorandum issued by Government of Manipur dated 19th April 1994, PWD, Manipur will not acquire land for construction of road in hilly areas. The villagers have donated land, for construction of road after thorough consultation of proposed alignment. The land in the hills are owned and managed by the Village Chief / Headman in the Kuki Tribe dominated area. However, in the Naga Tribe dominated area land parcels are owned by individual Customary Right holders. Village Chief allots large parcels of land to villagers for their use but they do not have individual ownership right. Government of Manipur has its policy that for road construction in such hilly areas, the land will be taken through donations from Village Chiefs but compensation will be paid to individual land holders for all non-land assets including structures, standing crops and trees. The land donation agreements have been signed between the land owners / land holders / Village Chiefs and the Project Director, EAP, PWD, Manipur representing the Government of Manipur. The sample Deed Agreement is appended. Almost 90 km in this section of the road is Greenfield alignment. The survey work is in progress, but the progress is very slow due to presence of thick jungles, continuous rainfall making the site inaccessible. In this project context, all the villages in the Hill Section falling in the alignment had consented to donate land for the purpose of this road. To achieve this, the Employer has agreed to provide each village with appropriate identified community infrastructure. There is provision for construction of 16 community centres in the Contract.

SECTION 3.0 SOCIAL MONITORING OF RP AND IPP IMPLEMENTATION

3.1. Status of Land Acquisition The project road from Imphal (Ch. 0+000 km) to Kangchup (Ch. 12+900 km) traverses through the plains (Valley Section) where villages and semi-urban settlements are present. At many places encroachers are present on the ROW. The road is planned to be upgraded to 4-lanes (from Ch. 0+000 to 5+400 km) and then to 2-lanes with paved shoulder (from Ch. 5+400 to 12+900 km), as per design. This has led to the need of uptake of land from Govt. holdings and private ownership as well.

For the project implementation purpose 15 m on either side of the existing centreline is required. For this, a joint assessment survey (JAS) has been conducted including all related parties like the EA, Revenue Department of Govt. of Manipur, Agriculture Department, Forest Department, Horticulture Department, Fisheries Department, the CSC and the INGO. Following the JAS the Govt. of Manipur Secretariat, Revenue Department has issued a notification under section 11(1) of RTFCLARRA, 2013 for land acquisition in the stretch of Imphal to Kangchup of the proposed project corridor (Ref: Notification No. 4/26/LA/2015- Com(Rev) pt-2 dated 23rd June 2018).

Based on the notified landed properties it has been found that 24.9596 Ha of land is likely to be affected for implementing the project. The land falls under two Subdivisions of Imphal West District namely Lamphel (3.1336 Ha) and (21.826 Ha). The following Table 8 provides details of LA notified as per Govt. of Manipur’s notification. The detailed notification has been appended in Annexure 1.

Towards payment processing for acquisition of land in the Valley Section an initial sum of Rs. 50,00,000.00 (Rupees Fifty Lakh) only has been deposited to the Office of the Deputy Commissioner / Collector, Land Acquisition, Imphal West District, Lamphelpat, Manipur. Balance requirement of Rs. 1,00,00,000.00 (Rupees One Crore) for the acquisition of land during 2018-19 will be deposited to DC / Collector, Land Acquisition, Imphal West District, Manipur as and when the Cheque Drawal Authorty of GOM is available with the PIU for land acquisition purpose. This has been referred in PIU’s Letter No. 10/PD/SRCIP/LA/2013/2533 dated 21.12.2018 (Annexure 2).

3.2. Status of Land Donation in IKTR Project

From Kangchup (12.9 km) till Tamenglong (End Chainage 103.020 km) the road passes through hilly terrain. Along this stretch the land is either owned by Village Chairpersons / Communities or by individuals empowered by Customary Land Rights. Since there was a lack of all-weather connectivity the village communities have shown willingness to have the project implemented. In this stretch all the land required for the implementation of this project has been donated by communities / Village Chairpersons / individual customary land owners.

Towards land donation Memorandums of Understanding (MoU) have been processed with all affected villages. The deeds for agreement of land donation have been prepared and registration of the agreement has been completed. Altogether 69 deeds have been registered, 8 in Sadar Hills under and 61 in Tamenglong District. Sample Registered Land Deeds from Senapati and Tamenglong Districts have been appended in Annexures 3 and Annexure 4. Annexure 5 provides Letter of Chairman, Land & Properties Owners’ Welfare Association, Sadar Hills and Tamenglong District, Manipur in this regard.

3.3. Status of Temporary Land Acquisition The Civil Contractor has finalized parcels of land for temporary acquisition to put up their construction and labour camps, field office, etc. Temporary land acquisition for setting up plant and machinery has been done. Contract of temporary acquisition of land with private owners for its Site Office at Ch. 5+400, Plant Site and Labour Camp at Ch. 15+580, Crusher Plant at Ch. 20+770 km and another Site Office and Labour Camp at Ch. 77+000 were made. The Civil Construction Contractor has mobilized men and machinery and has constructed camp sites, offices at Ch.5+400 and 77+000. The Contractor has also temporarily procured two community land parcels to establish two Disposal Sites at Ch. 14+730 km and 15+900 km.

3.4. Assessment of Impacted Properties in the Project

3.4.1 Assessment of Impacted Properties other than Land in Imphal to Kangchup Stretch (Valley Section) of IKTR project

A joint assessment survey (JAS) has been conducted to identify all NTH properties falling in the ROW of the proposed project in the Valley Section. The following Table 9 presents the details of NTH properties identified within the ROW of 15 m on either side of the existing centreline.

The following Table 9 provides the present status of JAS for the Imphal-Kangchup stretch of the project road.

The details have been submitted to the SDM Offices of Lamphel and Lamshang Subdivision of Imphal West District and after evaluation of structures as per current SOR rates the estimated cost of compensation and assistances has to be decided.

3.4.2 Assessment of Impacted Properties other than Land in Kangchup to Tamenglong Stretch (Hill Section) of IKTR project

The following Table 10 provides assessment of project impacted properties to DPs living along Kangchup to Tamenglong stretch of the project corridor. The impacted properties include structures, trees, forest and agricultural standing crops. A JAS has been conducted in

which all the identified DPs have been verified and final list of DPs has been prepared. The list was approved by the Government.

Micro-Plans and ID Cards for DPs have been prepared by the INGO and these have been approved by the PIU. Annexure 6 and Annexure 7 provide details of Micro-Plans and ID Cards respectively.

3.6. Status of Disbursement of Compensation and Resettlement Assistances

A cumulative amount of Rs 3,46,22,193 /- (Rupees Three Crore Forty Six Lakh Twenty Two Thousand One Hundred Ninety Three) or USD 0.509 million only has been disbursed for compensation payable to Horticultural Class of trees and also for Agriculture Class of plants in addition to Forest Trees and standing structures along project Ch. 12+900 to 34+900, Ch. 72+400 to 82+500 and Ch. 97+760 to 98+550. The payments made till June 2018 have been towards the compensation of impacted horticultural, forest and agricultural properties standing on affected land.

The payments for one DP (impacted structure), three DPs (Horticulture) and 2 DPs (Fishery) have been disbursed during the QPR reporting period ending December 2018 along Ch. 12.9 km to 15.0 km. A sum of Rs. 15,51,250.00 has been disbursed during October-December 2018. Table 11 presents the details of payments made. Sample cheques receipts from paid DPs have been appended in Annexure 8.

3.7. Preparedness of EA / PIU in Implementing RP and IPP till December 2018

3.8. Grievance Redress Mechanism (GRM) in IKTR Project Government Order on constituting State Level and PIU Level Grievance redress Committee has been issued and the INGO during August 2017 has worked on formation of GRCs at Kangchup Chiru Village on 26th August 2017 to look into issues regarding grievances from DPs concerning project implementation, entitlements and compensation issues. There are few developments in this line. These are provided below. Formation of Grievance Redress Committee (GRC) . GRC along the project alignment from Kangchup Chiru to Waphong Inthan (Ch. 12+900 to 34+900) has been constituted. Final list of 14 GRC members submitted in November 2017. . Second GRC will be constituted at Nagaching in stretch between Ch. 35+000 and 72+400. . Third GRC will be constituted at Tamenglong between Ch. 72+400 and 103+020. . The formation of GRC at Nagaching and Tamenglong is under process.

Grievance Redress . On villagers’ grievance from Bhalok Part I and Part III on damage of agricultural land due to dumping and subsequent slip, a Public Consultation was carried out and the Contractor paid compensation of Rs. 6,35,000.00 during December 2017, before the GRC was formed. Moreover, Rs. 6,44,496.00 has been paid on 19.12 2018. . The resolution has been made on the following demands of cultivators whose paddy fields have been damaged. - Cost of 200 paddy tins per acre has to be provided - Reclamation cost of paddy fields to previous fertile condition - Permanent solution for mud slip protection near paddy fields

3.9. Public Consultation Several public consultation meeting have been held during the current and previous reporting periods. . Public Consultation undertaken during JAS in Nagaching Village (Ch. 52+000 to 59+000) held on December 01, 2017. The villagers agreed to support the project implementation related activities. . Public consultation have been carried out at sensitive villages, such as Nagaching, Ijeirang, Bhalok Part 2 and 3 and other affected villages along the project alignment. . Public consultations meetings will be conducted at all the labour camp sites and plant sites to sensitize outsider labourers and villagers for smooth project implementation avoiding unforeseen conflict issues. . Issues raised by the villagers of Bhalok Part 1, 2 & 3 related to property assessment and compensation have been addressed by DC of Tamenglong. . At PIU level individual issues of property assessment and compensation have been addressed on one-to-one basis. . On 21st and 22nd March 2018 meeting with Headmen of 15 Villages along project stretch were held at PIU Office. All the Headmen appreciated the project and way the project is being implemented. . On 6th April 2018 a JAS for assessing loss of horticulture trees and agriculture crops has been carried out from Ch. 68+000 to 72+400 km in which SDMs of Noney and Tamenglong were also present. Following the JAS a public consultation has been carried out with local villagers on their queries on compensation for standing agriculture crops and horticulture trees. 3.10. HIV/AIDS Awareness Training Programmes at Construction Camps for Construction Labourers This activity is yet to start and will be undertaken in association with INGO. After mobilization of construction workers, it is proposed to organize a HIV/AIDS awareness programme during the month of June 2018. However, till date no awareness camp on HIV/AIDS has been conducted for labourers at camp sites during the current reporting period ending June 2018.

3.11. Training and Capacity Building of Local Villagers An HIV/AIDS Capacity Building Training Programme was conducted by the Civil Contractor near the Labour Camps and Plant sites for the local villagers on December 01, 2017. 3.12. Progress of Work performed by INGO during the SMR reporting period (July-December 2018)

3.12.1. Progress of Work related to Disclosure Document a. The Final Translated copies of Executive Summary and Entitlement Matrix (in Bengali Script) submitted by the INGO has been approved by the EA. Similarly submitted Manipuri translated copies of Executive summary in English Script has also been approved by the EA. b. Based on the approved contents of the translated versions of the documents a gist has been selected for preparing the Disclosure Document for the purpose of public consultation.

c. The disclosure document has been prepared separately for the Valley and Hill Sections. d. The Disclosure Document has been finalized and approved. e. The INGO is sharing this while carrying out public consultation at site.

3.12.2. Micro-Plan Preparation for NTH During the reporting period new micro-plans for DPs with affected fisheries have been prepared for Ch. 13+000 to 15+000. Additional micro-plans for Horticulture trees and structures along Ch. 13+000 to 17+000 have been submitted to EA and the EA has approved all the micro-plans. Micro-Plans for Non-Titleholders (NTH) along Valley Section will be prepared once the socio- economic survey is complete following receipt of final list of impacted NTH structures from Government Line Department.

3.12.3. Micro-Plan Preparation for TH Micro-plans for Titleholders (TH) will be prepared soon. JAS for Valley Section from Ch. 0+000 to 12+900 has been completed and awaiting for valuation report form Government Line Departments.

3.12.4. Distribution of ID card to NTH Six new ID cards have been prepared during the current reporting period. The process is continuous. Once micro-plans are prepared and submitted to EA and have approval, only then the ID cards have been prepared.

3.12.5. Disbursement of Compensation / Assistance to NTH So far, Rs. 3, 46,22,193.00 has been distributed to 81 TH DPs till the end of the reporting period of December 2018. During the current reporting period of the SMR ending December 2018 for impacted structures, horticulture trees and fishery ponds, compensation amount of Rs. 15,51,250.00 has been distributed. (Vide Table 11 that provides details of disbursement of compensation to 6 DPs)

SECTION 4.0 CONCLUSIONS AND RECOMMENDATIONS

4.1. Conclusions a. Overall, the progress in the RP implementation front has taken up pace during the current reporting period. b. A sum of Rs. 1551 lakh has been disbursed as compensation for impacted structures, horticulture trees and fisheries during the current reporting period. c. In the Hill Section required land uptake through the process of Land Donation has been done successfully through community consultation and 100% Memorandum of Understanding (MOU) could be obtained. d. In the Valley Section, however, the LA process is progressing in promising pace compared to the previous reporting periods. A sum of Rs. 50 lakh has been deposited to Deputy Commissioner / District Collector, LA, Imphal West District for necessary land acquisition in his jurisdiction.

4.2. Recommendations a. The INGO has placed two different working teams for Kangchup area and Tamenglong area for carrying out a faster RP implementation activities. They need to gear up and field sizeable teams both for the Valley Section and the Hill Section required for carrying out RP / IPP implementation. b. The INGO team lack leadership and require filling this position as soon as possible. c. The INGO should work in close coordination with the EA and CSC for delivering required works on timelines.
