HIGHWAYS As agreed at the November meeting, Cllr McEwen arranged a meeting with Cllr Eddie Johnson, ECC Cabinet Member for Highway Maintenance and Small Scheme Delivery, Cllr Rodney Bass, ECC Cabinet Member for Highways and Transportation, together with a number of representatives from the Ringway Jacobs organisation, on 2nd December. The Clerk will give a summary at the meeting, however attached to the agenda at Appendix 2 (pages 17-18) is a - 1 - MBL Parish Council

Councillors are asked to CONSIDER if they would like to put forward any schemes.

c) Road Closures Temporary closure of length of Hobbs Cross Road/, Matching from its junction with Green Lane, north west for a distance of approximately 1300 metres, for 3 days from 26th January 2014 for Highway Maintenance Works (emailed to members).

9. CLERKS COMMUNICATIONS AND CORRESPONDENCE REPORT To RECEIVE the oral report of the Clerk on matters which may be of current interest to Members and which require a formal update, and to RECEIVE such correspondence and communication as the Clerk may place before the Council. Items under this agenda item are for NOTING only. o Work continues on the Emergency Plan o Clerk has chased EFDC requested a written response to her request for details of their policy on neighbour notification of planning applications, and the placing of yellow notification notices. o Request for changes to two locations of polling stations - Councillors are asked to NOTE that the Clerk has spoken with Simon Hill at EFDC who has confirmed that the report as read out at the last Parish Council meeting was incorrect, and he has received confirmation from EFDC Electoral Services that both East and polling stations have now moved to . EFDC has apologised for this error. o The next Local Community Meeting for Epping, , North Weald and will be held on Tuesday 17th. February 2015, meeting start at 19.30 and finish at 20.30 (location to be confirmed). 11. ESSEX COUNTY COUNCIL FLOOD INFORMATION REQUEST On 19th December 2014, Essex County Council wrote to all Parish Councils asking them to provide details of the top three priority areas in the Parish to prevent future surface water (surface water) flooding of homes. This is as a result of Essex County Council having the role of the Lead Local Flood Authority (LLFA). Council are asked to AGREE the top three priority areas to forward to ECC. These details which then be assessed to help inform the priorities of the Essex Flood Partnership Board, and in turn the flood and water management flood prevention work over the next few years. The deadline for responses is 31st January 2014.

12. OPEN PARISH MEETINGS The Open Parish Meeting was very successful with 71 people in attendance (including Councillors). Some of the main points of discussion included:  Car parking / School drop off arrangements for Moreton School - congestion concerns  Delivery of the Forrester (possibly going on line)  The Cripsey Community, and concern in terms of transparency  World War commemoration events for next 4 years  The possibility of a WW1 commemorative booklet which could be given to each household and kept within each house should the resident move.  Neighbourhood Plan  Parish Safety and Community Volunteers  2015 year of the Volunteer

Councillors are asked to inform the Clerk of any issues or concerns which came to light this year, so that these can be considered for next year.

13. BUDGET / PRECEPT 2015/2016 Councillors are asked to CONSIDER the budget, and subsequently the precept for 2015/2016. This will be completed on a 'live' basis during the meeting, however details will be sent to all councillors prior to the meeting.

Items that need to be considered include:  Request from the Norway House Partnership asking this Parish Council if they would like to contribute funding towards family activities at Norway House.  Request from Essex Air Ambulance for financial support for their organisation  Any cost towards the creation of a WW1 booklet for households  Ongoing annual repairs to pump 4 - MBL Parish Council

In addition, Grant Application forms were sent to the previous recipients of grants, informing them of the requirement to formally apply for grant funding for 2015/2016. Three responses have been received as follows:

Lavers PCC - Grant of £1,800 for maintenance of churchyards St Germains PCC - Grant of £1,200 for maintenance of churchyard Moreton PCC - Grant of £500 for maintenance of churchyard

The Clerk has full copies of the application forms and latest sets of accounts for all three applicants, and is happy to provide this to any Councillor upon request.

Council Tax Reform Councillors may recall that due to the recent welfare reforms, the way in which council tax benefit is calculated has changed, with the responsibility for the benefit scheme being passed to, and agreed by, the local authority (EFDC). This subsequently meant a change in the council tax base, which in turn had the effect of showing a greater increase in the Parish Council percentage of council tax despite there being no changes. The effect this would have on town and parish councils was of great debate in 2012, the outcome of which was that EFDC agreed to pass on a percentage of the support grant they receive from Government to Parish Councils to offset this alteration. This grant is NOT guaranteed.

For 2014/2015, EFDC awarded the Parish Council £1,084 by way of a Parish Support Grant to offset the negative effect of the welfare reforms. This was based on a Tax Base of 541.2. For 2015/2016, the Parish Support Grant for this Council will be £992 - a decrease of £92. The reason for the increase is due to an alteration in the Tax Base to 552.4

Councillors should also note that a cap has been set on EFDC’s ability to raise its precept without the need to go to a referendum - the cap being 2%. This cap does not currently apply to town and parish councils.

The District Council has asked to be notified of the Precept request by 31st January 2015 and Members are, therefore, asked to CONSIDER the proposed 2015/2016 precept figures.

14. COMMUNITY GAMES After the great success of the Community Games in Essex in 2014, and still building on the Legacy of the London 2012 Games, Active Essex, the County Sports Partnership of Essex, are once again inviting communities to take part in the Community Games, which is a way to bring communities together to take part in sporting and cultural activities! Community Games must include both sporting and cultural/art activities, and some sort of ceremony, ideally an opening and/or closing ceremony. Who can be involved? A community could be a street, an estate, regular users of a park or other public space, etc. It is important that the Games are driven and shaped by a community and although an event can be facilitated by a local authority or other statutory organisation, the community itself must be instrumental in the development and delivery of the event. It must be local, accessible and convenient, be fun, friendly and open to all and reflect and celebrate the communities’ diversity. Communities are able to apply for funding of £400 towards any such event. The deadline for application is Friday January 30th 2015. Councillors are asked if they are aware of any such group or organisation in the community who may wish to hold such an event, and if so if they would like to apply for funding.

C.230 APOLOGIES FOR ABSENCE (1) NOTED that apologies had been received from Cllr Radbourne. Apologies had also been received from EFDC Cllr T Boyce.

C.231 OTHER ABSENCES (0) NOTED there were no other absences.

C.232 MINUTES The minutes of the Parish Council meeting held on 8th September 2014 were AGREED and signed as a true record. Noted there were no outstanding actions.

C.233 DECLARATIONS OF INTEREST The following Declarations of Interest were NOTED:

All present Declared a discloseable pecuniary interest in any items relating the Neighbourhood Plan, by virtue of owning land in the Parish.

C.234 PARISHIONERS FORUM There were no members of the public present.

C.235 NEIGHBOURHOOD PLANNING (NP) Cllr Busch gave Members and update on the current status of the Neighbourhood Plan, stating that it had now been submitted to EFDC for a review by a Senior Planning Officer to assess whether or not the document complies with all the relevant regulations, and that there are no contradictions with the Local Plan or National Policy. Once the review has been received, and providing no further amendments are required, a further 6 week consultation period commences, managed and organised by EFDC. The next major step after this time is inspection by an Examiner, and subsequently Referendum.

Cllr Chiverrell asked what message should be given to Parishioners and the Champions in terms of the delay. Cllr Busch stated that these delays have unfortunately been out of our control, and were for a number of different reasons, including the pre-submission consultation, the sad death of Tim Dickenson, and various family illnesses of those involved. This subsequently meant that the initial referendum date of May 2014 could not be achieved. The Steering Group have considered this, and the general consensus is that a full copy of the final Neighbourhood Plan should be printed for each house within the Parish, so that Parishioners

have a clear understanding of the Neighbourhood Plan prior to referendum, which it is hoped will be May 2015 - the same time as the General Elections.

It was suggested that a covering letter could accompany the document stating why there has been a delay. This was AGREED. [Cllr Silk arrived]

Cllr Busch reminded Members that at the start of the process, the suggestion had been made by Graeme Cooper that the Volunteers (Champions) could be taken to the House of Commons as a' thank you' for all their effort and time, given free of charge. Council AGREED that a financial contribution could be made towards the cost of this trip.

C.236 REPORTS Members received the following reports:

a) Bobbingworth Nature Reserve - Cllr Thompson reported that a gate has been installed in the car park entrance to the reserve, the reason being Countrycare are going to create a bigger pond in the area. The new gate will create an additional access point for the different machinery required, rather than having to use the access near the sewage works, which has historically caused problems. This new access will be a permanent feature. Cllr Mangan expressed his concern that this new gate would allow access by unauthorised persons including G&T, and suggested that the gate is a temporary access whilst these works take place. This concern was also expressed by other Councillors present. Cllr Mangan also stated that there used to be a bund of earth there, which acted as a barrier for unwanted unauthorised visitors, and that this should be returned. Cllr Thompson stated that Veolia are the company who are managing the project, and that the installation of the gate was discussed some time ago at one of the Committee meetings. This has been agreed in conjunction with EFDC. Cllr Thompson AGREED that he would bring these concerns to the attention of the Committee, and would report back at the next meeting.

b) District / County Councillors Reports – The Clerk stated that EFDC Cllr Tony Boyce had expressed concern about this Council's decision to contribute funds towards the Community Cycling event held on 6th July 2014, suggestion this may be misappropriation of funds. Cllr Mangan stated that the Cripsey Community is not a Charity, but an organisation set up for the benefit of local residents in need. The funds given by the Parish Council were towards the running of the event, and not to the Cripsey Community directly. Councillors noted that £500 originally precepted for the Tour de France event had been reallocated towards this event due to the Parish Council agreeing not to hold any specific TDF event. A further £280.13 (inc VAT) was to be retrospectively agreed at this meeting. Cllr Padfield stated that whilst she supported funds towards the event, she was concerned that the Council had originally only agreed £500, yet these costs had increased. With this, and the WWI Celebration costs, Cllr Padfield expressed her concern at the amount of funds being spent on such events. Cllr Padfield suggested that a more robust procedure should be in place to ensure such costs don't spiral out of control. Cllr Thompson stated he agreed to a point, however the bank balance of the Council is relatively healthy at this point in time, and there are enough funds for these costs. Cllr Bengtson stated the Council need to be clear about what costs it has committed to, and only spend those costs. The Chairman understood these points, but stated the Cycling event was a one off, and as such a cost that will not present every year. Councillors stated that whilst they fully supported the funds put towards the Community Cycling event, going forward they need to be clearer about any costs agreed, and formally agree any further costs prior to them being spent. Cllr Thompson reminded Members about Section 137 which gives the Council the power to spend £7.20 per head of electorate for the benefit of the electorate. 8 - MBL Parish Council

c) Parish Councillor Reports - Cllr Devereux stated that following discussion at the last Parish Council meeting, he had obtained costings for a Defibrillator of around £1,000 to purchase. There are options in terms of having a fully automatic one for which no training is required, or there are courses that offer training in how to use them, following which you would receive a certificate of training, however this decision depends on the cost Council want to pay. Cllr Mangan stated that a fully automatic one would be most appropriate, as it simply guides you through what you need to do at the time it's used. The cost of a first aid course is approximately £80 per person. The Chairman stated that if there is enough interest, then there may be a clear need to hold these training sessions. Cllr Busch expressed her concern that in a 10 square mile Parish, putting one defibrillator in the centre of Moreton isn't a sensible use of public money, as how many people in the Parish are within 3 minutes reach of Moreton. Cllr Devereux stated that having a defibrillator in the Parish would have given the individual who died during the TDF event more of a change. Cllr Busch understood this, however stated that it's not the role of the Parish Council to provide medical facilities for its residents. Cllr Mangan said that St John's Ambulance did aim to have one defibrillator in every parish. There are also some Parishes where the residents have paid for their own. After much discussion, Councillors AGREED not to progress the possibility of a defibrillator in the Parish.

Cllr Thompson stated that with the help of Joe Skeplehorn, he had created the wording for plaque to go into the newly refurbished pump house, a copy of which was attached to the agenda, as was a copy of the quotation received to create the plaque. Cllr Thompson stated that he had received an updated quote of £39.50, which consisted of a different format of laminate onto aluminium substrate. All Councillors present AGREED that Cllr Thompson could move forward with the creation of the sign and the new quote.

Cllr Thompson reported that Tony Ellis, Crime Prevention Office for Brentwood and Police District, was retiring, although he would continue to be actively involved in crime prevention on a voluntary basis. Councillors AGREED a letter of thanks should be sent to Tony thanking him for his services to this Parish.

C.237 HIGHWAYS a) Councillors NOTED the update on any reported Highway issues (See Appendix A attached to the Minutes).

Cllr McEwen stated that various highways within the County have improved significantly, and since October ECC Highways has been working on rural roads. There is still a lot of works to be completed, and many of these are weather dependent. At present they are working on the A414.

The Clerk stated that she had written to Cllr McEwen complaining about the level of service being received by ECC Highways, a copy of which is reproduced below.

I want to formally complain about the poor service from Highways regarding the issues in the table below. Each of the issues below was reported on 24/8. I have been regularly monitoring the status on the website (which has remained the same) however after being informed that the website is often out of date I called Highways today to get a verbal update. The representative stated that the current status for each was as stated on the website, and that the issues were with the Public footpaths people to investigate. It has been two and a half months since these issues were reported, and none of them have received a visit. I have a raft of points I would like complain about:

1. Giving incorrect information on the website - it isn't going to be investigated in 28 days - It has in fact been 72 days!

2. I think most reasonable people can understand that perhaps ECC don't have enough funds to do all the work, but what is even more frustrating is misleading information, or lack of agreed action. If you can't do it, say why, and then we know whether or not we can argue the point. 3. What happens if the inspector doesn't visit within the set 28 days? Is this actually an 'aim' or is it a requirement of their roles? What can we do if this doesn't happen 4. We are often left to accept the response from Highways that 'the works are not urgent, and will be completed, but we cannot say when'. Even a rough idea (6 months, a year, never) would be better. 5. I absolutely understand that issues such as footpaths, potholes, local signage, are not a priority in terms of the County as a whole, however they are so very important for people at a local level.

The current system in place at Highways doesn't work, and I think most people know that. For Parish Council staff, we are so frustrated by the poor service we get, that it's almost expected that nothing is going to be done about any of the items we report. I regularly find myself apologising to members of the public saying 'that's just what highways are like'. It's almost accepted that the service will be poor! Quite frankly we are absolutely at a loss as to what we can do about it. I fear nothing, hence the reason I am complaining to you.

I hope in some way you may be able to help - not necessarily with the issues below, but give us some hope that these issues will be fixed at some point in the future.

Councillors also expressed their deep concern at the lack of progress for many of the issues detailed in the Highways list, stating that the level of service being received from ECC is not sufficient. Cllr McEwen confirmed she would arrange a meeting with the Portfolio Holder for Highways, Cllr Rodney Bass, so that the Clerk can raise these issues directly with him.

Councillors NOTED the excerpt from the ECC Highway Maintenance Strategy which detailed how ECC categorise and prioritise potholes.

Councillors NOTED that Tilegate Road will be closed for 4 weeks from 17th November 2014 for water replacement words. Access will be maintained for all users of Magdalen Laver Village Hall.

b) Action Required Downgrading of Byways - Councillors NOTED that the Clerk had not been able to progress this matter at this time, however it remains on her list of jobs to action.

C.238 CLERKS COMMUNICATION AND CORRESPONDENCE REPORT Members NOTED the following Communications and Correspondence:

o The Clerk has begun works to update the Emergency Plan, and recently attended an Emergency Planning workshop o Letter received from Inland Revenue stating there has been an underpayment for 14/15 of £148.60. b) Change of Bank Account Councillors had recently discussed changes to the Parish Council banking arrangements which allowed for electronic banking. However, after discussion with a representative of NALC, and reviewing the arrangements offered by Barclays, the Clerk now recommends that this Parish Council no longer moves forward with electronic banking provided by Barclays Bank, for reasons that sufficient safeguard could not be put in place to ensure no misuse of the system.

The Clerk stated that she continued to find the current banking arrangements laborious and time consuming, and she is unable to speak with Barclays directly to ascertain up to date balances. The Clerk had again reviewed the services offered by Unity, a bank which the Council considered some time ago, has contacted them to ascertain the services they offer. Attached to the Agenda was proposal put forward by Unity for the provision of such banking services.

Council CONSIDERED moving bank to Unity under the terms explained in the proposal, and after discussion it was AGREED. PROPOSED Cllr Collins, SECONDED Cllr Busch.

ECC 2332439 Greens Farm Lane, Issue first reported by local resident 11/8, then chased by Parish Council after Cllr Padfield reported. (11/8/14) Magdalen Laver The pothole is 41 inches wide, and 3 inches deep. ECC have inspected the potholes and categorised it as a Priority 4 - Priority 4 (according to the current ECC maintenance strategy this mean Low Priority - more than 28 days repair - Repair within the next available programme, schedule a more detailed inspection, monitor through more frequent inspections or review condition at next inspection, based on an assessment of risk of deterioration before the next visit). ECC website has therefore closed this reference number, and marked it concluded. It is on the regular schedule of maintenance works (completed annually).

ECC 2329297 Outside Moreton School Parking continues to be an issue outside Moreton School, exacerbated because the yellow zig zag lies (21/5/14) simply cannot be seen - this is causing a serious safety risk to both children and drivers. 30/6 - informed verbally that this road is due to resurfaced and as such it would not be cost effective to repaint these lines at this time. 4/7 - Clerk enquired as to a date when the road was scheduled to be resurfaced. No response received. 13/8 - ECC website states inspected and ECC will be monitoring or deterioration as it doesn't meet criteria to be fixed. 25/8 - Clerk emailed asking 1) what the criteria is for repainting, 2) how the lines are going to be monitored for deterioration being as it not possible for them to deteriorate any further, and 3) a date for when the road is due to be resurfaced. 29/8 - ECC website status has now changed stating being investigated within the next 28 days. 4/11 - Website still states to be investigated within 28 days. Clerk therefore called Essex Highways, and was informed this was a NEPP issue, and that we needed to contact them. 4/11 - formal request put in to NEPP for creation of yellow zig zag lines. 7/11 - Yellow Zig Zag lines outside Moreton School - response received stating this will be added to the list of sites to be re-marked. They will try to arrange for contractors to carry out the works quickly but yellow lines can only be remarked when the carriageway is dry and has not been gritted or salted. In view of this it may not be possible to carry out the works this year and so may have to take place next year when weather conditions allow.

However, the implementation of restrictions is dependent on their passing public consultation, the necessary legal process and having an available budget. Due to the high number of requests for parking schemes, the Parking Partnership has to prioritise which schemes progress and not all requests for parking restrictions or residents’ parking will become sealed traffic orders. On average, the NEPP will only introduce 6 schemes per district each year. The emailed contained a traffic regulation order request form, stating that in order that the NEPP can consider the application Part 1 (up to the funding item) needs to be completed and returned to the NEPP. Also attached was a prioritisation score sheet which NEPP officers use when reporting the issues to the local authorities in the NEPP. The local authority then prioritises the schemes in their district before the Joint Committee, which is made up of Councillors from all the districts in NEPP approve schemes for advertising and formal consultation. 22/9 - PCSO Dillaway confirms details of accidents in the area. Formal application to NEPP made requesting yellow lines in this location.

Noted that lime render works should be taking place 2015, providing ECC can agree a budget. Clerk emailed Jacqui Hoggar to inform her. Further damage to bridge on 19th September. ECC informed. confirmed they would visit 26/9. Update awaited. Chased 30/10.

Dear Maggie

Firstly, I would like to take this opportunity to thank you for arranging the meeting with Cllr Bass, Cllr Johnson, and the entourage of Highway representatives that were with them yesterday. I would also like to thank all in attendance for their time yesterday. Please would you be kind enough to pass this email on to the relevant individuals concerned as agreed.

As agreed, please find attached the following:  Moreton, Bobbingworth and the Lavers Parish Council Highway list  Parish Council Highway list  Parish Council highway list ( I appreciate this is not in your area, but it makes sense to address them all at the same time, hence the reason I have copied Cllr Jackson into this email).

All these reports should be read bearing in the mind that if the ECC Highway reporting system was kept updated, the despondent attitude of the Parish Councils concerned probably wouldn't exist (or at least not the degree it does). Our discussion on 'poor communication' yesterday refers!

It was accepted at yesterday's meeting by Cllr Bass and Cllr Johnson that the Highway reporting system is not up to date, is ineffective in its current form, and requires improvements. This is the overarching issue for all three Parish Councils above. The failure of the reporting system leads to a great deal of staff time having to be put into constantly monitoring the website waiting for updates, or calling Highways direct for updates (which can take up to 45 minutes). I accept that Cllr Bass and Cllr Johnson are aware this is a problem, and that it is being looked at. I would therefore like to formally request we are kept informed on any progress with this. 80% of the issues on the attached relate to this lack of communication, which I appreciate Cllr Bass stated is 'the past', but I would still like it noted that it's also still 'current'!

In terms of the outstanding issues that need addressing, these are marked in RED on the attached. I would be grateful to receive a response to each of these queries.

I thank Cllr Bass and Cllr Johnson for their summary as to how the reporting system works (in terms of notifying ECC of highway issues, then the Members Enquiry avenues if no response is received). It is accepted that a large amount of work has been undertaken over recent months to address vast sections of roads in Essex for resurfacing, which is great. However, it is often the small issues at a local level which cause the greatest concern. It was suggested at yesterday's meeting that it is entirely possible that some potholes may 'never' get repaired, the likelihood being that any such potholes are not deemed to be a risk according to the maintenance strategy guidelines. If there are such issues which cause concern at a local level, how are we do address these?

As mentioned at yesterday's meeting, Parish and Town Councils are often first in line for members of the public who have issues with Highways, want to report an issue or are looking for an update. At present, all we can do is express what we know to these members of the public, which includes that the reporting and monitoring system is flawed, and that we are as frustrated as them. I feel useful, interactive engagement with Town/Parish Councils to help them understand how the Highway system operates, the criteria applied, and how the engineers assess highway issues, can only help with understanding, and subsequently help Highways in terms of relaying such information to the members of the public.

In sections the path is noted as being narrow, but walkable. This matter has been passed to the PRoW Enforcement and Liaison Officer and PRoW Engineer to see if anything can or should be done in respect of this matter.

At this present time I am unable to provide a timescale of when the above will be undertaken. Fingerpost works require a check for statutory undertaker plans (STATs), to make sure that there are no buried utility company or other assets before any works can commence. The Inspector will request a gap in the vegetation is formed, to facilitate access in readiness for such an installation; however, I must advise that this a low priority non-urgent defect and therefore will be added to the list of ongoing works.

COMMUNITY AGENTS

A new service was launched in July 2014 to support older people and their informal carers to help themselves or one another to find and implement independent living solutions.

In just five months Community Agents have visited over 1,000 clients across Essex.

Thirty four of the planned 36 Community Agents have been recruited countywide with vacancies in and Brentwood. Recruitment is taking place for the remaining two posts and the shortfall is currently being covered by other agents working additional hours.

Age UK Essex Voice Network has successfully recruited 26 volunteers to engage with clubs and groups for older people in Essex and promote the benefits of Community Agents.

Support volunteers are in the process of being recruited. Anyone interested should contact the Service Coordinator on 01245 291024. Neighbourhood Watch co- ordinators are being invited to join the project to spread the word at street level. Awareness and communications training is planned for the New Year to help them identify those who would benefit from the services Community Agents offers and to encourage potential clients to come forward.

Social Care Customer Service Operators are being offered the opportunity to shadow an agent to see how the project works on the ground. At the same time experienced agents will sit with operators to help them maximise appropriate referrals.

Extensive engagement activity has been taking place with clinical commissioning groups, , Police and Crime Commissioner, Essex Fire and Rescue and District/Borough/City Councils.

At a local level agents and the project team are researching and linking directly with community, faith and other groups. They are attending meetings with local organisations such as health and wellbeing boards, CVSs and CABs to ensure the Community Agent scheme is recognised and integrated as a major community support provider for older people in Essex. Dear Parishes

Earlier this year thousands of households and businesses signed up to participate in the Essex Energy Switch. It helped many people reduce their gas and electricity bills at a time of rising energy prices – with an average saving of £200 per year. We are now offering residents another chance to make sizable savings on their gas and electricity bills.

Residents have from 3rd December 2014 until 2nd February 2015 to register their interest (without any obligation) at www.essex.gov.uk/energyswitch. It is a completely free, easy, safe and secure way to cut their energy bill without wasting valuable time endlessly comparing prices on comparison sites.

This year we hope that even more residents will benefit from making the switch and to achieve this I urge you to play your part in making residents in your area aware of the Essex Energy Switch whenever you are able to do so.

This is a fantastic opportunity to help householders and SMEs to save money without obligation in a safe, secure and proven manner. I hope that we can all work together to make this a success for residents, businesses and Essex as a whole.
