    Seitz Colorado State Soil Soil Science Society of America Introduction Many states have a designated state bird, flower, fish, tree, rock, etc. And, many states also have a state soil – one that has significance or is important to the state. The Seitz is the of- ficial state soil ofColorado . Let’s explore how the Seitz is important to the state of Colorado! History In 1972, Seitz soils were first established in the area around Rio Grande County, Colorado. The soil got its name from the Seitz stream which was close to where soil scientists described the soil. The Seitz soil is the foundation for the grand and scenic views associated with Colo- rado and the large variety of outdoor recreational opportunities the state has to offer. What is Seitz Soil? The Seitz soils located primarily in southwestern Colorado are predominantly found at higher cooler elevations. These soils are found on hills, ridges, high valleys, and mountain slopes. Seitz soils are used as pastureland for grazing cattle, forestry, and outdoor recreation like hik- ing, camping, and winter sports because they are found in the mountainous areas of Colorado. Seitz soils are very deep, well drained soils developed in colluvium and slope alluvium. This means that as the rock on the mountainsides weather, the weathered material begins to creep and fall downslope due to gravity and water. As these materials reach a more stable position in the landscape, they accumulate and, over time, further weathering occurs, creating the Seitz soil. They are found on hills, ridges, mountain slopes, and valley sides, on slopes ranging from 2 to 65 percent.

    “JUST WIN, BABY”: THE TENTH CIRCUIT REJECTS THE “ANYTHING GOES” TACTICS OF THE HAIL-LITIGATION GOLD RUSH † †† EVAN STEPHENSON & KAYLA SCROGGINS-UPTIGROVE ABSTRACT In Colorado, the federal courts are experiencing a legal gold rush arising from hail and other storm damage insurance lawsuits. Entrepre- neurial plaintiffs’ lawyers, public adjusters, insurance appraisers, and others have developed aggressive techniques for maximizing the value of hail-damage claims. These tactics drew a sharp rebuke from the U.S. Court of Appeals for the Tenth Circuit in two published opinions, both in appeals captioned Auto-Owners Insurance Co. v. Summit Park Town- home Ass’n (Summit Park). The court affirmed an order that vacated a $10,870,090.96 hail-damage appraisal award, sanctioned the policyhold- er’s attorneys for misconduct, entered a default judgment against the policyholder as a sanction, and required the policyholder’s lawyers to pay the insurance company’s attorney fees. Summit Park rejects various claim practices of wide import that have taken root in other jurisdictions. These practices frequently arise in the context of insurance apprais- al, a relatively informal method of alternative dispute resolution that in most cases depends on the parties to an insurance valuation dispute each appointing an impartial appraiser to determine the amount of the property loss. The policyholder in Summit Park obtained an approximate $10 mil- lion appraisal award by appointing a partisan appraiser with whom its law firm had undisclosed and extensive fiduciary, personal, and financial connections.     To: Air Quality Control Commission From: Colorado Local Elected Officials Re: Rulemakings Date: June 18, 2020 Dear Air Quality Control Commissioners and Staff, As elected officials representing residents from across the entire state of Colorado, we write in support of the work being done by the Air Quality Control Commission (AQCC) and to encourage the Commission to continue its rulemaking efforts to develop real, meaningful regulations that protect all Coloradans, the air we breathe, and the environment in which we live and recreate. We understand that there are two overlapping and related external factors impacting the work of the Commission and staff: the Covid-19 pandemic and the collapse of the global oil and gas futures market. However, we ask that as the rulemaking process moves forward, the voices of all Coloradans across the state continue to be heard. Our primary concern is the perception of a divide between the needs of rural and urban communities across the state. Every Coloradan deserves to be able to breathe clean air, drink clean water as well as live, work, and recreate in a safe, healthy environment. SB19-181 expressly grants local governments the power to regulate oil and gas activity above and beyond the level of the state government. Contrary to arguments made elsewhere, this is an expansion of our authority as local elected officials, not a limitation. Local protections paired with robust statewide rules from the AQCC will allow each and every local government in the state to adapt to the unique circumstances of our jurisdictions and truly protect our residents.
