Warranty Information Technical and Customer WARRANTY INFORMATION LIMITED WARRANTY Bethesda Softworks LLC, a ZeniMax Media company (“Bethesda Softworks”) warrants to you, the original purchaser of this disc or other physical media and the game software encoded thereon (“Game”), that under normal use the Game shall be free from defects in material and workmanship for a period of 90 days from the date of purchase (“Warranty Period”). This Limited Warranty: (a) does not apply if (i) the Game is used for a business or commercial purpose, or (ii) the Game is not delivered on physical media; and (b) is void if failure of the Game has resulted from accident, abuse, virus or misapplication. EXCLUSIVE REMEDY AND LIMITATION OF LIABILITY Warranty claims must be made to the retailer from whom you purchased the Game. You must return the Game to your retailer during the Warranty Period, together with a copy of the original sales receipt and an explanation of the difficulty you are experiencing with the Game. At its option, the retailer may either repair or replace the Game. Any replacement Game will be warranted for the remainder of the original Warranty Period or 30 days, whichever is longer. Bethesda Softworks’ and its licensors’ and suppliers’ entire liability and your exclusive remedy shall be, at the retailer’s option, the repair or replacement of the Game that does not meet this Limited Warranty and is properly returned to the retailer. Outside the United States, neither of these remedies nor any product support services are available without proof of purchase from an authorized international source. WARRANTY PROTECTION Warranty protection is available only to you, the original purchaser. In the event of any questions in this regard, Bethesda Softworks reserves the exclusive right to determine warranty eligibility and appropriate redress, if any. NO OTHER WARRANTIES, CONDITIONS OR DUTIES. The foregoing applies even if Bethesda Softworks or its licensors and suppliers have been advised of the possibility of such losses or damages. Thorne Abstract The past decade has seen an increase in the availability of user-friendly game development software, the result of which has been the emergence of a genre of reflexive and experimental games. Pippin Barr, La Molleindustria’s Paolo Pedercini, and Davey Wreden are exemplary in their thoughtful engagement with an ever-expanding list of subjects, including analyses and critiques of game development, popular culture, and capitalism. These works demonstrate the power of games as a site for critical media theory. This potential, however, is hindered by the player-centric trends in the game industry that limit the creative freedom of developers whose work is their livelihood. In the era of communicative capitalism, Jodi Dean argues that the commodification of communication has suspended narrative in favour of the circulation of fragmented and digestible opinions, which not only facilitates the distribution and consumption of communication, but also safeguards communicative capitalism against critique. Ultimately, the very same impulse that drives communicative capitalism is responsible for the player-centric trends that some developers view as an obstacle to their art. Critical game studies has traditionally fallen into two categories: those that emphasize the player as the locus of critique, such as McKenzie Wark’s trifler or Mary Flanagan’s critical play, and those that emphasize design, as in Alexander Galloway’s countergaming, Ian Bogost’s procedural rhetoric, and Gonzalo Frasca’s theory of simulation.

But it may have saved itself some headaches, given the political interference in that situation. After losing that opportunity, the company turned immediately and announced the acquisition of ZeniMax Media, the parent company of Bethesda Softworks. Bethesda develops and publishes video games, including The Elder Scrolls, Doom, and Fallout. The deal expands Microsoft’s game studios from 15 to 23, strengthening its position in the rapidly expanding gaming market. The timing is good as Microsoft is about to launch its eagerly awaited Xbox Series X and Series S in time for the holiday season. In addition, Microsoft bolsters its line-up to attract more users to its Xbox Game Pass. Microsoft is paying $7.5 billion in cash to acquire ZeniMax Media. ZeniMax is privately held, but speculation is that annual revenue was less than $1 billion, implying that EBITDA was less than $300 million. Therefore the deal could be viewed as quite expensive. But Microsoft has such tremendous financial flexibility that it really won’t have much of an impact on the credit profile. The company has close to $14 billion in cash and another $123 billion in short-term investments. In addition, the company generated more than $30 billion of free cash flow in the fiscal year that just ended June 30 th . ♦ Microsoft posted revenue of $143 billion last year, so the acquisition’s financial impact on operations is minimal.

    Press Start Environment at Play The Environment at Play: Confronting Nature in The Elder Scrolls V: Skyrim and the “Frostfall” Ecomod Dennis Jansen Utrecht University – RMA Media, Art, and Performance Studies Abstract In this paper, I argue that the natural environment in the base game of The Elder Scrolls V: Skyrim is devoid of agency and power in the face of the player’s colonialist endeavours to explore, conquer and master that environment. Weaving together insights about spatiality in digital games from (ecocritical and postcolonial) game studies, as well as performance studies, the paper problematizes some of the most basic elements of digital games in general: navigation and movement. It then moves to a discussion of the “Frostfall” mod as one possible option to counteract the destructive and oppositional relationship between the player and nature in Skyrim. “Frostfall” is an ecomod that adds weather survival elements to the game, by which the player can freeze and die from hypothermia if they do not take the appropriate measures to cope with Skyrim’s harsh climate. In this way, the power fantasy set up in the base game becomes somewhat limited, as the player’s agency encounters nature’s newfound agency and must find ways to negotiate the gameworld while taking seriously the environment as an agent in and of that gameworld. The ESA is the U.S. trade association representing the publishers of computer and video games for play on consoles, personal computers, mobile devices, and the Internet. The video game industry is a key economic sector that creates jobs, develops innovative technology, and keeps the United States competitive in the global marketplace. Not only do 75 percent of United States households have at least one gamer in their home, our industry has a footprint that creates jobs in every state. Maryland, for example, is home to more than 40 video game companies, including Bethesda, an ESA member company. We appreciate the opportunity to provide the video game industry’s prospective on “right to repair.” Our member companies share the desire for customers to get their broken game consoles repaired quickly and at a modest cost. Software sales are what drive our industry. Thus, our member companies have a compelling financial incentive to help their customers get their consoles repaired as quickly and affordably as possible because no one buys games for a broken console. It is for that reason that all three major video game console makers—Microsoft, Nintendo, and Sony—are committed to providing consumers with repairs that are quick, reliable, and secure.
