North West Essex CAMRA Branch By Chris Rouse The North West Essex branch of CAMRA covers the area of Essex north of the A120 and west of the old A131, including Saffron Walden, Stansted Mountfitchet, Great Dunmow, Great Yeldham, and the north west of Braintree, with Thaxted in the centre.     Appeal Decision Inquiry held on 18-21 and 25-27 July 2017 Site visit made on 25 July 2017 by Julia Gregory BSc (Hons), BTP, MRTPI, MCMI an Inspector appointed by the Secretary of State for Communities and Local Government Decision date: 06 September 2017 Appeal Ref: APP/Z1510/W/17/3173352 Land off Finchingfield Road, Steeple Bumpstead The appeal is made under section 78 of the Town and Country Planning Act 1990 against a refusal to grant outline planning permission. The appeal is made by Gladman Developments Ltd against the decision of Braintree District Council. The application Ref 16/01665/OUT, dated 30 September 2016, was refused by notice dated 1 February 2017. The development proposed is the resubmission of application 16/0410/OUT-outline planning permission for up to 65 dwellings (including up to 40% affordable housing), introduction of structural planting and landscaping, informal public open space and children’s play area, surface water flood mitigation and attenuation, vehicular access point from Finchingfield Road, pedestrian access to George Gent Close and associated ancillary works. All matters to be reserved with the exception of the main vehicular site access. Decision 1. The appeal is dismissed. Preliminary matters 2. A linked appeal, reference APP/Z1510/W/16/3157939 in respect of a larger scheme on the same site, was withdrawn on 3 May 2017. 3. The application is in outline with all matters apart from the means of access reserved for future determination. Natural England, the Government’s advisor for the natural environment in England identified the need for a strategic approach or RAMS, to understand the likely increased recreational impacts on coastal Sites of Scientific Interest and to identify effective avoidance and mitigation measures. Consequently the 11 Essex Local Planning Authorities (LPAs) who lie wholly or partly within Impact Risk Zones of coastal Sites of Scientific Interest (SSSI), have worked with Natural England in preparing the Essex RAMS Strategy. During this process it was found that the Zone of Influence (ZoI) for the Blackwater Estuary Special Protection Area (SPA) and Ramsar site includes a small part of Uttlesford District in Felsted parish. Uttlesford has therefore joined the other local authorities as a partner for the delivery phase of the Essex Coast RAMS. 2. The purpose of this report is to approve the RAMS Strategy Document (Technical Report and Mitigation Report) (Enc. 1) and to approve the Essex Coast Recreational Disturbance Avoidance & Mitigation Strategy (Essex RAMS) draft Supplementary Planning Document (SPD) (Enc.2) for consultation. 3. Essex County Council Place Services were commissioned to prepare the RAMS and SPD on behalf of the partners. RAMS have been successfully implemented throughout other areas of the country for example, in the Solent, Thames Basin Heaths and North Kent. 4. The RAMS aims to avoid and mitigate bird and habitat disturbance from recreational activities through a series of management measures which encourage visitors to enjoy their visits responsibly.

Where this was the case, rather than selecting one option as the Preferred Approach and rejecting others, the consultation responses received were used to inform the development of the option into a more detailed Preferred Approach. However, other factors also influenced the development of the Preferred Approaches, including the outcomes of the Issues and Options consultation workshops that were held in 2010 and input from Essex and Southend Councils and, and so the Preferred Approaches do not always directly correlate with an option put forward at the Issues and Options stage. In each case, this appendix demonstrates why the options that are reflected in the Preferred Approaches were chosen over other potential approaches, or where the Preferred Approach represents a departure from any of the earlier options, why this was.
