NOTICE OF POSTPONEMENT OF PROCEDURAL MATTERS HEARING

HEARING NO. DP 03-2020

This is to notify you that the Vulcan County Subdivision and Development Appeal Board (Board) has recessed Hearing No. DP 03-2020. The Board has agreed to convene an additional preliminary hearing using electronic means to review and determine if an in-person hearing can be conducted. The preliminary hearing will reconvene:

June 30, 2020 at 4:00 p.m. Via Go To Webinar Platform

NOTE: This will be a reconvening of the procedural matters hearing to review public health orders regarding gathering restrictions and social distancing due to COVID- 19. The Board will determine if an “in-person” hearing can be held.

If an “in-person” hearing can proceed after June 30, 2020, all affected parties will be notified in writing of the rescheduled hearing date and provided with information on how to submit written briefs and presentations to the Clerk of the SDAB for the rescheduled hearing date.

Dear Ms. Horvath,

On April 30th, 2020, I received a letter from the Minister of Municipal Affairs, Kaycee Madu with regards to the Hutterian Brethren of Summerland mafter.

As the letter references the Subdivision and Development Appeal Board (SDAB), and in an effort to be transparent, Vulcan County Council felt it prudent to forward the letter to the SDAB.

I trust the attached correspondence will be included in the appeals exhibit package for Hearing 03-2020.

Dear Mayor Schneider,

Over the past several months, my oflice has received correspondence from the Hutterite Brethren of Summerland expressing concems with Vulcan County's development and appeal decisions related to municipal approval ofthe buildings associated with the Colony's proposed confined feeding operation (CFO). I understand the CFO received approval from the Natural Resources Conservation Board; however, municipal approval of the buildings required by the Colony to operate the CFO remain outstanding. I am disappointed the county and the Hutterite Brethren of Summerland have not been able to resolve this matter.

Agriculture is our province's largest renewable resource and contributes to a safe and secure local and international food supply. Development of critical agriculture infrastructure that supports this industry, like.CFOs, is therefore considered a provincial interest. As such, I have aiked my department to explore expanding the scope ofthe Municipal Government Board to hear matlers considered to be in the province's interest. This would include appeals related to CFOs that have received approval from the Natural Resources Conservation Board.

lunderstand the appealto the county's Subdivision and Development Appeal Board has been postponed until social distancing guidelines have been eased. ln the interim, I hope I the county and th€ Hutterite Brethren of Summerland can work collaboratively lo address this matter so development of this critical infrastructure can begin.

Good Morning -

In advance of next Tuesday's (June 30, 2020) reconvening of the Subdivision and Development Appeal Board to discuss preliminary matters regarding Appeal DP 03-2020, specifically the current public health orders, social distancing requirements and limits to gathering as part of Phase II of the COVID-19 reopening, I thought it was necessary to touch base. The Board will be meeting to discuss if an in-person hearing can be conducted on Tuesday via electronic means. It is my current understanding that the following guidelines must be followed if an in person hearing were to be conducted:

1. Maximum of 100 people, if seating is audience style; 2. Social Distancing of 2 m must be maintained between cohort groups - which means family members can sit together closer than 2 m but must be distanced 2 m from the next group or individual; 3. Mask wearing is optional but recommended ; 4. Sanitization of the room is required; 5. Hand Sanitizer should be available.

I would like to know if you are comfortable under these conditions to proceed with a hearing.

If No, could you please respond in writing to the Board with your concerns so that it may discussed on June 30, 2020.

If yes, could you please respond in writing to the Board and if there any dates that you would not be available to attend a hearing between July 1 and August 31, 2020.

I think that given the recent outbreaks in the community and in the Colonies reported over the last several weeks we would be more comfortable holding the meetings in October when further health precautions have been undertaken. Given the number of people from across county and that may be interested in participating we would like to hold the hearing in person when greater distance from the public health crisis can be maintained.
