Community Development Tour in Canadian Badlands - Roger Brooks CC 2018-09-05-16 MOVED BY COUNCILLOR DONOVAN that Council authorize Councillor Lyckman to attend the Community Development Tour in the Canadian Badlands with Roger Brooks on September 18, 2018 in Coaldale for a cost of approximately $384 (registration, per diem & travel), to be drawn from the Council Contingency Fund. CARRIED UNANIMOUSLY.

Councillor Representation on SAEWA CC 2018-09-05-17 MOVED BY DEPUTY REEVE COCKWILL that Council support Councillor Monner's initiative to pursue a Director position on Energy from Waste Association (SAEWA). CARRIED UNANIMOUSLY.

Council Reports Division 1: • attended CF Highwood meeting; they've completed the hiring process for Executive Director; • attended the G3 open house in ; • dealt with ratepayer inquiries about development in flood plain area and road chip coating; • met with EDO and CF Highwood regarding youth entrepreneurship programs; • attended NW Recreation meeting; budget prepared and review of upcoming projects.

Division 3: • meetings cancelled due to lack of quorum • attended a Vulcan & District Tourism meeting, the last 2 months have been busy at the Tourism Centre with increased sales and increased visitors; staff are doing a great job.

CC 2018-09-05-20 MOVED BY REEVE SCHNEIDER that the Division 3 report be accepted for information as presented. CARRIED UNANIMOUSLY.

Division 4: • attended the G3 open house in Carmangay • attended an Elder Abuse Committee meeting; the committee is moving along fast; vision & mission statements and terms of reference have been established; • attended the Taber parade on behalf of SouthGrow; • will be attending meetings with SouthGrow Director to our regional urban municipalities, SouthGrow is looking to increase membership; • will be sitting on a Economic Summit committee with SouthGrow coming up.

CC 2018-09-05-21 MOVED BY COUNCILLOR LYCKMAN that the Division 4 report be accepted for information as presented. CARRIED UNANIMOUSLY.

Division 5: • met with Queenstown residents about a community standards bylaw; • also dealt with ratepayers concerns over dust in Queenstown, have discussed with Operations Director; • attended the Milo Recreation Board meeting, budget has been submitted to the County; • attended the Milo Fire Association meeting where a loan was discussed to fund the future fire hall; • received calls from people wanting to tour acreages and asked why the County is not doing anything to attract people to our area; • discussed the interest free loan the Milo Fire Association has been offered.

CC 2018-09-05-22 MOVED BY COUNCILLOR SMITH that Council direct Administration to draft a letter to the Milo Fire Association regarding the interest free loan that has been offered, the impacts

Division 6: • attended a Village of Champion Council meeting, they're wondering how to requisition services from the County and what the cost would be; Administration stated they can contact our Operations Director and the costs are outlined in our Fees for Service Bylaw; • also inquired about a minimum requisition or contribution to the local community halls, for maintenance and operations.

CC 2018-09-05-24 MOVED BY COUNCILLOR SMITH that the Division 6 report be accepted for information as presented. CARRIED UNANIMOUSLY.

Division 7: • attended the Lomond Fire Association meeting; • took a road trip to County of Newell to see development around Lake Newell; • attended the G3 open house; • still dealing with calls from ratepayers about the Spring flood; • dealt with ratepayer calls about deer on the highway, can the County put pressure on Alberta Transportation to mow ditches; • gave an update on the Lomond rink; • spoke to the Youth Entrepreneurship Camp hosted by Rotary Alberta, sponsored by the Community Futures groups and supporting municipalities; perhaps this is something Vulcan County can be involved with.

Urban Fowl Bylaw

Recommended Action: That Council offer comment on the Urban Fowl Bylaw and consider first reading.

Proposal & Background At the August 15, 2018 meeting of Council, Administration was directed to draft an Urban Fowl Bylaw. The Urban Fowl Bylaw has been researched through investigating what other municipalities within the Province have done to addresses this matter. Many bylaws were found to be similar in nature and address the same items as the bylaw before you today.

Administration has attempted to have a realistic number of fowl that could be allowed under the proposed bylaw. Attempt has also been made to limit the number of licenses which could be issued within an area.

Strategic Plan Alignment n/a

Financial/Policy Consideration Should this bylaw be passed, other bylaws will need to be amended to reflect this change. The Fee for Service Bylaw will require amendment to capture the licencing fee. The Animal Control Bylaw will require Schedule “B” to be updated to reflect the number of fowl allowed within an urban area.

Implementation/Communication Administration will proceed with the Urban Fowl Bylaw as directed by Council. Should first reading be given, advertising will take place and a Public Hearing scheduled prior to second and third readings.

BYLAW 2017-033

Being a bylaw of Vulcan County in the Province of Alberta to regulate the keeping of fowl in urban areas within Vulcan County.

WHEREAS pursuant to section 7 of the Municipal Government Act the council of a municipality may pass bylaws for municipal purposes respecting: the safety, health and welfare of people and the protection of people and property; wild and domestic animals, and activities in relation to them; and the enforcement of bylaws; and

AND WHEREAS pursuant to section 8 of the Municipal Government Act the council of a municipality may, in a bylaw, regulate or prohibit and to provide for a system of licenses, permits and approvals.

NOW THEREFORE the Council of Vulcan County, in the Province of Alberta, duly assembled enacts as follows:

1. This bylaw may be called the “Urban Fowl Bylaw”.

2. Definitions

2.1. “CAO” – means the Chief Administrative Officer or designate of Vulcan County as appointed by council; 2.2. “Coop” - means a fully enclosed weather proof structure and attached outdoor enclosure used for keeping of urban fowl that is no larger than 10m2 in floor area, and no more than 1.82m (6ft.) meters in height; 2.3. “Council” – means the Council of Vulcan County; 2.4. “Outdoor Enclosure” – means a securely enclosed, roofed outdoor area attached to and forming part of a coop having a bare earth or vegetated floor for urban fowl to roam; 2.5. “Peace Officer” means: a) A member of the Royal Canadian Mounted Police b) A Community Peace Officer as appointed by the Province of Alberta c) A Bylaw Enforcement Officer as appointed by Vulcan County to enforce bylaws of the County. 2.6. “Sell” – means to exchange or deliver for money or its equivalent;

2.7. “Urban Area” – means any hamlet, grouped country residential, rural recreational land use districts, or urban recreational area; 2.8. “Urban Fowl” – means a domesticated chicken, hen, duck, turkey or goose for the purpose of this bylaw and no other fowl shall fall under this definition. 2.9. “Urban Fowl License” – means a license issued pursuant to this bylaw which authorizes the license holder to keep urban fowl on a specific property within any hamlet, grouped country residential or urban recreational area within Vulcan County. 2.10. “Violation Ticket” – means a ticket issued pursuant to the Provincial Offence Procedures Act and any amendments or regulations thereto.

3. Livestock Operations

3.1. This bylaw shall not prohibit or impede livestock operations within the rural areas of Vulcan County. 3.2. Subsection 3.1 does not apply to any hamlet, land in grouped country residential, or rural recreational land use districts.

4. Provisioning

4.1. It is the intention of Council that each separate provision of this bylaw shall be deemed independent of all other provisions herein and it is the further intention of Council that if any provision of this bylaw be declared invalid, all other provisions hereof shall remain valid and enforceable.

5. Prohibitions

5.1. No person in an urban area shall keep a fowl other than that which the person has been issued a license under this bylaw and maintain that fowl on property owned or controlled by that person. 5.2. No more than one (1) urban fowl license may be issued for every eight (8) hectares of urban development.

6. Urban Fowl License

6.1. A person may keep up to six (6) six urban fowl by:

a) Submitting a completed urban fowl license application on forms approved by the CAO to a Vulcan County representative authorized by the CAO to accept and approve such applications; and

b) Paying an annual urban fowl license fee as set out in Vulcan County’s Fees for Service Bylaw. 6.2. Urban Fowl licenses are valid for the period of January 1 to December 31 of the year in which it is issued and must be renewed annually prior to January 31 of each subsequent year. 6.3. Urban Fowl license fee shall not be reduced or prorated no matter the month of purchase. 6.4. Urban Fowl license fees shall not be refunded or rebated. 6.5. An urban fowl license is not transferable from one person to another. 6.6. An urban fowl license is not transferable from one property to another except: a) when a license holder has moved to a new property within the County in which an Urban Fowl license would be required to keep fowl on his/her property, and that the transfer does not allow for the total number of licenses issued to exceed the area maximum. b) A person to whom an urban fowl license has been issued shall produce the license upon demand of a Peace Officer. 6.7. An Urban Fowl License may be issued or renewed if the CAO or his designate is satisfied that: a) The applicant is the owner of the property on which the urban fowls will be kept; or that the owner of the property has provided written consent to the applicant. b) The property in which urban fowl are to be kept is of sufficient size to accommodate urban fowl as requested by the land owner. c) The applicant resides on the property on which the urban fowl will be kept; d) All required information has been provided; e) The applicant has taken a course on the safe handling of urban fowl; f) The applicable license fee has been paid; and g) The applicant has complied with all other Provincial and Federal Regulations for the keeping of urban fowl. 6.8. An urban fowl license may be revoked or not be renewed by the CAO or his designate if:

a) the applicant or license holder does not meet or no longer meets the requirements for an urban fowl license as set out in this bylaw. b) the applicant or license holder furnishes false information or misrepresents any fact or circumstance required pursuant to this bylaw. c) the applicant or license holder has, in the opinion of the CAO or his designate, based on reasonable grounds, contravened any part of this bylaw whether or not the contravention has been prosecuted; d) the applicant or license holder fails to pay a fine imposed by the court for a contravention of this bylaw or any other applicable bylaw related to the keeping of livestock; e) the applicant or license holder fails to pay any fee required by this bylaw or any other applicable legislation; or f) in the opinion of the CAO or his designate, based on reasonable grounds, it is in the public interest to do so. 6.9. If a license is revoked or issuance of a license is refused the affected parties may appeal the decision to Council.

7. Keeping of Urban Fowl

7.1. A person who keeps an urban fowl must: a) provide each urban fowl with at least 0.37m2 (3.98 ft2) of interior floor area and at least 0.92m2 (9.9ft2) of outdoor enclosure within the outdoor enclosure; b) ensure that each outdoor enclosure is: i) located in the rear yard of the property ii) a minimum of 3.0 meters (9.84 ft) from a dwelling; iii) a minimum 1m (3.28 ft.) from any utility iv) a minimum 3.6m (11.81) ft. from any street adjacent to the property; and v) at grade level, no more than 1.82m (6.0ft) in height c) provide and maintain, in the outdoor enclosure, at least one nest box per outdoor enclosure and one perch per urban fowl that is at least 15cm (5.90 in ) long; d) keep each urban fowl in the outdoor enclosure at all times;

e) provide each urban fowl with food, water, shelter, light, ventilation, care, and opportunities for essential behaviors, all sufficient to maintain good health. f) maintain the outdoor enclosure in good repair and sanitary condition, and free from vermin and noxious or offensive smells and substances. g) construct and maintain the coop to prevent any rodents from harboring underneath, within, or within its walls, and to prevent entrance by any other animal; h) keep food container and water container in the outdoor enclosure and/or coop; i) keep outdoor enclosure secured at all times; j) remove leftover feed, trash, and manure in a timely manner; k) store feed within fully enclosed container; l) store manure within a fully enclosed container, and store no more than 85 liters (3 cubic feet) of manure at any time; m) remove all other manure not used for composting or fertilizing and dispose of such in accordance with any municipal, provincial or federal law; n) follow biosecurity procedures outlined by the Canadian Food Inspection Agency to reduce potential for disease outbreak; and o) Keep urban fowl for personal use only.

7.2. No person who keeps urban fowl shall: a) sell eggs, manure, meat, or other products derived from an urban fowl; b) slaughter any urban fowl on the property; c) dispose of an urban fowl except by delivering it to a farm, abattoir, veterinarian, or other operation that is lawfully permitted to dispose of such; and d) keep an urban fowl in a cage, kennel, or any other form of shelter other than an outdoor enclosure.

8. Authority of Chief Administrative Officer

8.1. Without restricting any other power, duty, or function granted by the urban fowl bylaw, the Chief Administrative Officer may: a) carry out any inspections to determine compliance with the urban fowl bylaw; b) take any steps or carry out any actions required to enforce the Urban Fowl Bylaw;

c) take any steps or carry out any actions required to remedy a contravention of the Urban Fowl Bylaw. d) establish forms for the purposes of the Urban Fowl Bylaw; and e) delegate any powers, duties, or functions under the Urban Fowl Bylaw to a county employee.

9. Penalties and Enforcement

9.1. No person shall willfully obstruct, hinder, or interfere with a Peace Officer or any other person authorized to enforce and engaged in the enforcement of the provisions of this bylaw. 9.2. Where there is a specified penalty listed for an offence in Schedule “A” to this bylaw, that amount is the minimum specified penalty for the offence. 9.3. Where a person contravenes the same provision of this bylaw two (2) or more times within one twelve (12) month period, the specified penalty payable in respect of a second or subsequent contravention shall be the amount stated in Schedule “A” for such offences. 9.4. In the case of an offence that is of a continuing nature, a contravention constitutes a separate offense in respect of each day or part of a day on which it continues. 9.5. The levying and payment of any fine or the imprisonment for any period provided in this bylaw shall not relieve a person from the necessity of paying any fees, charges or costs from which that person is liable under the provisions of this bylaw or any other bylaw. 9.6. Any Peace Officer who has reasonable and probable grounds to believe that any person has contravened any provision of this bylaw may issue and serve: a) a violation ticket allowing payment according to the provisions of the Provincial Offences Procedure Act and any amendments thereto. 9.7. If a violation ticket is issued in respect to an offence, the violation ticket may: a) specify the fine amount established by this bylaw for the offence; or b) require a person to appear in court without the alternative of making a voluntary payment.

9.8. A person who commits an offence may: a) if a violation ticket is issued in respect of the offence; and b) if the violation ticket specified the fine amount established by this bylaw for the offence;

9.9. Make a voluntary payment equal to the specified fine by delivering the violation ticket and the specified fine to the provincial courthouse specified on the violation ticket.

10. General

10.1. Any person who contravenes any provision of this bylaw by: a) Doing any act or thing which the person is prohibited from doing; or b) Failing to do any act or thing the person is required to do; c) is guilty of an offence and any offence created pursuant to this bylaw is a strict liability offence for the purposes of prosecution under the bylaw. 10.2. Nothing in this bylaw relieves a person from complying with any provision of any federal or provincial law or regulation, other bylaw(s), or any requirement of any lawful permit, order or license. Words in the singular include the plural and words in the plural include the singular. 10.3. This bylaw is gender-neutral and, accordingly, any reference to one gender includes the others. 10.4. Schedule “A” shall form a part of this bylaw and may, from time to time, be amended. 10.5. No provision of this bylaw or any action taken pursuant to any provision of this bylaw shall restrict, limit, prevent or preclude Vulcan County from pursuing any other remedy in relation to a premises as provided by the Municipal Government Act, or any other law of the Province of Alberta.

Bylaw 2018-034 Governance Priorities Committee

Recommended Action: 1) That Council give first reading to Bylaw 2018-034, being a bylaw creating the Governance Priorities Committee of Council. Should Council vote unanimously, the option to have three readings in one meeting is available.

2) If Bylaw 2018-034 receives three readings, that meeting dates for 2018 be set.

Proposal & Background Since the Municipal Election in 2017 in which four (4) new councillors were elected, some have addressed the need for more time to discuss important issues of the County prior to making a formal decision at a Council meeting.

During the past year, several matters have come to Council for decision with limited time to gain an understanding of the issue. Often, the first time Council hears about an issue is in the agenda package that is sent out prior to the meeting. This can lead to rushed decision making or requiring staff to bring the item back at a later date with additional requested information. This is particularly relevant as it relates to ongoing legal matters. If Council were to have meetings as a collective unit where this information can be discussed in advance of the time to make a decision, meeting efficiencies can be gained. A solution to this dilemma is for Council to establish a Committee of the Whole where business items can be discussed without the requirement for a Council motion, which would be make at the next Regular Council meeting.

A Committee of the Whole (COW) is a committee that includes all elected officials, sitting in a deliberative rather than legislative capacity, for informal debate and preliminary consideration of matters. The Committee does not have the authority to initiate an action (aside from providing direction to the CAO), but can recommend matters be brought back to a subsequent Council meeting for action. The main benefits of a COW meeting are to alleviate some of the pressure in making decisions on the spot with little time to review, to reduce staff time in meetings, and gain efficiency in Regular Council meetings.

Many other municipalities have established a Committee of the Whole for the reasons noted above. Meeting frequency ranges from once a month, to every two months, to every quarter or on an as needed basis. The summary attached to this report outlines the COW structure of a few municipalities within Alberta. If Council is in favour of a meeting of this sort, it is recommended that a monthly meeting be set for planning purposes; and if a meeting is not required in a given month, that it be cancelled. To note: some municipalities keep minutes of their Committee of the Whole meetings and some have chosen not too. From a public transparency perspective, it is recommended that Council keep minutes of committee meetings, in a detailed manner, and that they be available to the public.

Financial/Policy Consideration Financial Impact: additional per diem would be required, but to what extent is undetermined at this time. Per diems would likely be reduced for Regular Council meetings, but offset by the COW meetings.

Policy Impact: As per MGA Section 145 & 146, if a Council determines the need to establish a committee, it is to be done through bylaw, which must state the functions and procedures for the committee.

Implementation/Communication If Council does establish a Committee of the Whole, meeting dates for 2018 will be advertised accordingly.

Being a bylaw of Vulcan County in the Province of Alberta to establish a Committee of Council to review and discuss upcoming and important issues and opportunities that may be brought back to a subsequent Council meeting for action.

WHEREAS pursuant to section 145 of the Municipal Government Act, R.S.A. 2000, c.M-26, Council may pass bylaws in relation to the establishment, functions, procedure and conduct of council committees;

NOW THEREFORE, the Council of Vulcan County enacts as follows:

SHORT TITLE 1.0 This bylaw is called “Governance Priorities Committee”.

ESTABLISHMENT 3.0 The Council of Vulcan County hereby establishes the Governance Priorities Committee.

GOVERNANCE & PRIORITIES COMMITTEE TERMS OF REFERENCE

PURPOSE The Governance and Priorities Committee enables Committee members to review upcoming and important issues and opportunities with members of Administration where deemed appropriate, where the focus is on understanding the broader policy implications of the items being considered. The purpose of the committee is to:  Receive updates on emerging and ongoing projects and initiatives.  Meet principally as a forum for discussion rather than as a decision-making arena, enabling all Committee members to discuss key items without the requirement to make a decision.

The key for the Committee is to keep the focus on the broader and more strategic items. The operation of the Committee is purposely kept informal to encourage deliberation of information and ideas. The Committee has no power to direct work or commit funds. The power to do those types of things rests with Council. Matters requiring further action will be forwarded as a recommendation to Council.

LEGISLATIVE AUTHORITY Municipal Government Act, Section 145 & 146

MEMBERSHIP All Vulcan County elected officials.

The Chief Administrative Officer, directors, managers and administrative staff will be in attendance at committee meetings to make presentations and answer questions.

CHAIR The Reeve is the chairperson for all meetings, unless this responsibility is delegated by the Reeve to another committee member. In the absence of the Reeve, and no pending prior delegation, the Deputy Reeve shall act as Chair.

LOCATION, DATE AND TIME OF MEETING Meetings will be held in Vulcan County Council Chambers, or may be changed to another location by the Chair by giving at least 48 hours’ notice to all committee members.

Meetings will be held on a monthly basis, as determined by the Chair. A meeting date can be changed by the Chair with the approval of 2/3 of members.

Committee agendas will be distributed to the Committee members four (4) days prior to a Committee meeting; and will be available to the public two (2) days prior to a Committee meeting.

Minutes will be taken in an anecdotal minute taking style, which will contain objective and concise point-form summaries of discussions. They will be made available to the public and approved at the next Committee meeting.

No formal minutes are kept of the proceedings; however, a Record of Deliberations (providing date, time, location, attendees, recommendations, etc.) is kept for reference purposes only. Prior to the adjournment of the meeting, the Committee will approve the recommendations that would be made to Council by consensus. If consensus cannot be achieved, the direction supported by the majority of committee members will be acted upon.

CONDUCT OF MEETING Pursuant to Section 197(1) of the Municipal Government Act, the Committee will conduct its meetings in public, unless the matter is within one of the exceptions to disclosure as per the Freedom of Information and Protection of Privacy Act, in which the Committee may close all or part of its meeting to the public.

Being a Bylaw of Vulcan County in the Province of Alberta to establish a Committee of Council to provide recommendations to Council on policies, strategic initiatives, and budget items related to economic development in Vulcan County.

WHEREAS pursuant to section 145 of the Municipal Government Act, R.S.A. 2000, c.M-26, Council may pass bylaws in relation to the establishment, functions, procedure and conduct of council committees;

WHEREAS Vulcan County Council deems it necessary create a committee whom advises Council on policies, bylaws, budgets, initiatives, and opportunities related to economic development;

NOW THEREFORE, the Council of Vulcan County enacts as follows:

SHORT TITLE 1.0 This bylaw is called “Economic Development Committee Bylaw”.

DEFINITIONS 2.0 In this bylaw, unless the context otherwise requires: (1) “County” means Vulcan County (2) “Committee” means Economic Development Committee (3) “Council” means the Municipal Council of Vulcan County

ESTABLISHMENT 3.0 The Council of Vulcan County hereby establishes the Economic Development Committee.

PURPOSE & FUNCTION 4.0 The Committee shall be governed in accordance with the Terms of Reference as presented in “Schedule A”, attached hereto and forming part of this bylaw.

GENERAL 5.0 This Bylaw shall come into effect on the date of the third and final reading.

Economic Development Committee

TERMS OF REFERENCE

Mandate

The mandate of the Economic Development Committee is to provide recommendations to Council on policies, strategic initiatives, and budget items related to economic development in Vulcan County.

Purpose

1. On an annual basis, review and provide input into the detailed annual economic development work plan and related budget. 2. To advise council on strategic economic development initiatives and opportunities. 3. To advise council on policies and bylaws related to doing business within Vulcan County.

4. To advise and support council on international opportunities (in particular related to investment and trade) which may be beneficial to Vulcan County and its agricultural/business community.

Membership

1. The Economic Development Committee shall consist of four appointed members of Vulcan County Council

2. Initial formation and appointment of members by council resolution; subsequent appointments will be done on an annual basis during the Vulcan County’s Organizational meeting.

Term of Membership

1. Term of membership shall not extend past the annual Organizational meeting of Council. Members may be reappointed at the Organizational meeting.

2. In the event that a member of the Economic Development Committee ceases to hold office, they shall also cease to be a member of the Committee.

Chair

1. A Chairperson will be agreed upon by consensus amongst the committee members and will maintain this position for the duration of the yearly appointment.

Quorum

1. A majority of committee members shall constitute a quorum.

Meeting Arrangements and Frequency

Meetings will be held quarterly at the County Administration building.

1. In addition to the regularly scheduled meetings, if a meeting is required it will be called by the Chairperson or the Economic Development Officer.

2. Agendas for the meeting will be provided by the Economic Development Officer three days in advance of the meeting.

3. Agenda items must be provided to the Economic Development Officer no later than five days in advance of the meeting date. Last minute items may be added to the agenda at the start of the meeting at the Chairperson’s discretion.

4. Minutes from all meetings will be provided to the Committee Members at the following meeting for review and amendment/approval.

5. Meetings shall not exceed four hours.

Reporting to Council

1. Recommendations of the Committee must be adopted by the Committee prior to presentation to Council.

2. Recommendations of the Committee will be submitted to Council in the form of a Request for Decision report containing the proposed recommendation.

3. The Chairperson will present the report and recommendation to Council, supported by the Economic Development Officer and/or the Manager of Development Services (as required).

4. The Committee shall report to Council 2-3 times per year (or as decided by the Committee) to update Council and the public as to its projects and other relevant issues with the exception of any ongoing projects that are confidential in nature.

Funding - Per Diem & Expenses

1. Payment of a per diem and expenses as per Vulcan County’s set rates.

2. The Economic Development Committee shall not enter into agreements, spend funds or obligate the County in any fashion without approval of County Council.

Administrative Support

1. The County’s Economic Development Officer and Department of Development Services will provide administrative support.

Participation by Others

1. The Chair may authorize the attendance and participation of resource staff and other persons who may have information or other resources that may be of interest to the Economic Development Committee.

Confidentiality

1. Economic Development Committee members shall be sworn to confidentiality respecting all closed meeting matters discussed by Vulcan County Council.

Proposal & Background To provide information to Council relating to the operating transactions of the County, Administration provides the following:

1st Council Meeting:  Investment Report – reporting on investment transactions within two months of the month end, due to the timing of receiving the investment statements (i.e. January transactions reported on the 1st Council meeting of March – received mid-late February).

2nd Council Meeting:  Cheque Listing – reporting of cheques paid from the prior month (all cheques approved by the Reeve prior to disbursement).  EFT Summary – reporting EFT transactions from the prior month.

If a Council meeting is not scheduled (i.e. 2nd meeting in March for the RMA convention), the financial reports are provided on the subsequent Council meeting. Note that due to the timing of receipt of investment statements, all reports will be provided at this meeting.

FORWARD

Vulcan County and the Municipal District of Taber share a common history. Both have distinct and similar municipal characteristics, and both are rural municipalities based upon building and maintaining core services including roads, bridges and airports which are designed to service an agricultural and resource based economy. Together these same individual characteristics link them into a healthy and viable regional municipality.

Most people understand increasing the level of collaboration as an ability to provide more efficient and better service levels to municipal ratepayers in the region. However, while some services can possibly be provided solely in a single municipality the increased opportunity in working together is also recognized in increased economies of scale, sustainability of some services, quality of services and efficiency in delivery. In other words, dovetailing the individual characteristics of the municipalities creates expanded resources and advances quality of life opportunities to the people in the region. The image of “two municipalities – one purpose” describes the philosophy of the two Councils.

The two municipalities are committed to identify current and future issues where joint benefits may be realized through more formalized and rigorous processes and cooperation. Examples are evident in servicing areas such as planning, economic development and creating a complete region that is attractive for people to live, work and play.

As the Provincial Government seeks to encourage regional thinking, the Municipal District of Taber and Vulcan County are well placed to lead proactively through the creation of this Intermunicipal Collaboration Framework Agreement.

The Municipal District of Taber and Vulcan County share a common history and foundation based upon irrigated agriculture and the oil and gas industry

Goals of the Intermunicipal Collaboration Framework Agreement The Intermunicipal Collaboration Framework has five main purposes:

1. To meet the requirements of provincial legislation. 2. To promote the principles of collaboration between neighboring municipalities with a common border. 3. To ensure municipalities consult and communicate on intermunicipal matters. 4. To clearly lay out a process that the partners to this agreement can review service levels and decide if the service would benefit from being regionally operated & funded. 5. To consider appropriate fair funding mechanisms and deal with differences which may occur from time to time.

The ICF Agreement between Vulcan County and the Municipal District of Taber will:

Recognize and share the vision and priorities of the two municipalities toward providing effective and efficient service levels to their ratepayers: Where feasible and practical – each municipality will work together to assess how commonly utilized services will be provided and funded for the benefit of ratepayers.

Strengthening the region while maintaining local autonomy: Each Council maintains the right to make individual decisions for their ratepayers, but each agree that they will always consider the bigger regional municipality in the decision- making process.

Promote networks and linkages: Developing positive joint approaches where practical to create efficiencies by sharing opportunities, connections, goals, knowledge and experience to promote the greater good between both municipalities.

Embrace differences in respective municipalities: The distinct characteristics of the individual municipalities is advantageous in providing choice and diversity.

Cooperation not Competition: Although each municipality is responsible to its citizens there is recognition that the citizens and businesses of the region share similar needs and interests and as such each Council will emphasize cooperation and therefore not direct competition with respect to setting municipal policy.

Foster an environment of openness and trust: Cooperation and collaboration requires communication that in turn encourages understanding and better results in reaching common goals.

Commitment to Consultation and Cooperation – Consultation Protocol: The fundamental basis of this agreement is communication and consultation and as such the two municipalities agree to consult on projects which have a regional impact. By recognizing the requirement to consult, each municipality will include the other in their project circulations and both agree to meet and work through matters as they arise. Where notification has been provided that a meeting is required it shall be first handled by the respective CAO’s or their designate and if that does not resolve the concerns at hand it shall be dealt with by a committee from each council recognizing time may be of essence. The purpose of this consultation protocol is to ensure that the municipalities leverage opportunities and develop common solutions to any challenges that affect the region.

It is understood that this agreement will encourage communication at all levels of the organization to ensure opportunities are recognized, information is passed through the respective organization and decision makers are informed not just about their own municipality but about regional issues and concerns. Cooperation, collaboration and commitment to consult are not meant to constrain or restrict the authority or the ability of individual Councils or to homogenize the unique culture and identity of each municipality. It is likely that there will be instances of differences in values, goals, beliefs, perspectives and decisions which are not common to both communities. In these instances, where differences remain, the commitment to communicate will enable the communities to develop proactive and positive solutions to issues that may arise.

Roles in Managing the Intermunicipal Collaboration Framework Agreement:

The Role of both Councils:

Each Council retains the ability and responsibility to make decisions on behalf of their residents. As the public is at the center of any governance initiative their voice needs to be taken into account to insure the impacts of services and actions taken in the region have the desired results and support the sustainability of the region. By signing onto the agreement each Council affirms the commitment to increased cooperation at both the council and administration levels.

This agreement signals a shift towards maximizing regional benefit through collaborative decision making. Each Council member will demonstrate leadership to act strategically as they formulate plans for each of their organizations which will bring value to the citizens of both communities.

The Role of the CAOs and Administration:

The CAOs have been identified as the principals responsible for maintaining the agreement, its delivery and dealing with intermunicipal issues that surface from time to time during the term of this agreement. Administration brings continuity to the relationship between the municipalities and they each have the ability to initiate communication on an as needed basis to ensure that each municipality adheres to the principles of the agreement. The CAO’s will foster increased communication and will act as conduits for facilitating the sharing of information, identifying opportunities and prioritizing municipal actions for the consideration of each Council. Disputes or disagreements between CAOs will be dealt with by a dispute resolution committee set up with members from each council.

The Role of Staff:

Staff at all levels will be responsible to ensure the principles of the agreement are carried out operationally. This means that staff will work cooperatively with their municipal counterparts to address issues that arise within the scope of their authority and mandate. Staff will also bring to the attention of their respective CAO any issues that arise which require their attention with respect to meeting the commitment and intent of this agreement. Disputes among staff or municipal contractors between the municipalities will be dealt with by the CAOs.

The Framework Protocols Development of an Intermunicipal Communication Protocol

Understanding that the success of this agreement is based upon respectful dialogue that both municipalities must be committed to ensuring the provision of information is handled in a transparent and honest manner. To foster

the longevity and durability of this agreement both municipalities should jointly develop and abide by the principles of a communication protocol which should include the following principles:

1. The protocol should recognize that cooperative communication is the key to a successful relationship. At all times and through all levels of each organization the following principles should apply: a. Seek to understand b. Avoid personal attacks either privately or publicly c. Asking for clarification on policies adopted by the other municipality to ensure understanding d. Address issues as being of a joint nature meant to be resolved together e. Seek to maximize the benefits for both parties

2. The Protocol should seek to ingrain collaboration and cooperation in each municipal organization a. Both organizations agree to ensure proper training takes place on intermunicipal collaboration following a municipal election b. Both organizations agree to provide additional training as required following any change in elected officials or senior administration

3. The protocol should ensure that each municipality provides to the other information pertaining to: a. Major capital projects which may impact the other municipality b. Lobby efforts to higher levels of government with respect to an issue which may impact regional services c. Adopted strategic plans d. Funding, aid or support to other organizations within the other municipality when requested e. Ceremonies, celebrations, events of regional impact f. Promotion of collaborative successes

Conflict Resolution The municipalities recognized that the development of this agreement is the start – not the end of the process. Recognizing that not all issues may be agreed upon the municipalities recognize the need to establish a conflict resolution process based upon the following principles:

1. At the earliest opportunity and at the point closest to where the problems initiated the Chief Administrative Officers will seek to address matters of conflict. 2. All matters of conflict should be sought to be resolved swiftly, inexpensively and in an uncomplicated way. 3. All matters of conflict should be resolved using a clear procedural pathway. 4. Maintain at all times, the essence of collaboration on the majority of issues even though conflict may exist on some issues.

Process If a municipality believes an obligation under the agreement has been breached the matter should be immediately brought to the attention of their CAO. The CAO will investigate and if it appears as if a ‘breach’ of

the agreement has occurred the matter will be immediately brought to the attention of the other municipalities CAO. Once that has occurred an effort to resolve the matter through informal problem-solving discussions is to be initiated.

If differences occur outside of an outright ‘breach’ of an agreement, which may include divergent expectations in the delivery of a joint service, variance on how the committee wishes to proceed on an issue or any circumstance which may impact or disrupt service delivery or relationships, an informal discussion between CAO’s will be conducted.

If this does not resolve the issue an Intermunicipal Dispute Committee shall be appointed by both councils who will decide on and negotiate an effective solution.

If the subcommittee negotiation process is unsuccessful a mediated process is initiated using the services of a jointly agreed upon mediator with costs shared equally between municipalities. The mediator will be solely responsible for the governance of the mediation process.

If the process cannot be resolved through mediation the municipalities will select an arbitrator, sharing all costs in doing so, and will have the matter resolved through the process defined by Section 708.35 of the Municipal Government Act. The arbitrator is governed by the principles of natural justice and fairness.

This Agreement encourages the municipalities to consult with each other and develop opportunities for collaboration for the benefit of both

communities for things like flood management.

Inventory of Municipality Services The following chart illustrates an inventory of municipal services available to ratepayers in each municipality. The

ICF Agreement – Statutory Provisions Amendments to the Municipal Government have amended the purpose of municipalities. The new act requires municipalities to work collaboratively with neighboring municipalities to plan, deliver and fund intermunicipal services. The act requires municipalities with common borders to develop an Intermunicipal Collaborative Framework Agreement. This agreement must address services related to transportation, water, wastewater, solid waste, emergency services and recreation. The discussion on the aforementioned topics is prescribed by the act, however the outcomes are not.

Emergency Services

The Municipal District of Taber and Vulcan County have jointly entered into a mutual aid fire agreement, with no billing to occur between the two Municipalities for Fire Service support.

Solid Waste

No agreements exist or are currently required between Vulcan County and the Municipal District of Taber in the area of solid waste.

Transportation

No agreements exist or are currently required between Vulcan County and the Municipal District of Taber in the area of transportation. Coordination of construction of transportation corridors that connect the two municipalities will be undertaken at the administrative level to ensure that both municipalities’ strategic transportation goals are in alignment. Should projects come forward where mutual benefit is recognized by both Municipalities, funding options will be discussed and brought forward to both Councils respectively.

Recreation

No agreements exist or are currently required between Vulcan County and the Municipal District of Taber in the area of recreation.

Water

No agreements exist or are currently required between Vulcan County and the Municipal District of Taber in the area of water.

A Disposal of County Lands Policy

PURPOSE

The purpose of this policy is to administer a fair and consistent formal process in the disposition of municipal owned lands in Vulcan County, while ensuring the fulfillment of our legislative mandate by meeting legal and statutory requirements. This policy is designed to address land sales where parcels are in excess of 30 acres.

DEFINITIONS

“Administration”: an employee of Vulcan County as directed by the Chief Administrative Officer; “Appraisal”: an official valuation of property by an authorized person; “Council”: the elected official Council of Vulcan County, in the Province of Alberta; “County”: Vulcan County, in the Province of Alberta; “Disposal”: the act of selling Reserve Land, Former Reserve Lands, and Fee Simple Lands. “Fee Simple Lands”: any lands which are held in freehold title by Vulcan County or County of Vulcan #2 and are not encumbered by a reserve designation. “Former Reserve Lands”: lands which are owned by Vulcan County and were previously encumbered with a reserve designation. “Lands”: any lands which are classified as Fee Simple Land, Former Reserve Lands, or Reserve Lands. “Lease”: the contract by which one conveys the property for a specified term and specified rent. “Lessee”: the person who holds the lease of the property. “MGA” Municipal Government Act, Revised Statutes of Alberta, Chapter M-26, as amended; “Municipal Purpose”: the purposes set out in Part 1, Section 3 of the Municipal Government Act; “Municipal Owned Lands”: any lands which are registered with Alberta Land Titles in the name of Vulcan County or County of Vulcan #2. “Public Sales”: the sale of lands that Vulcan County is actively trying to dispose of; “Removal of Reserve Designation Procedure”: the procedure established from time to time by Administration, for the purposes of carrying out the removal of reserve designations; “Reserve Lands”: any lands which have been provided by a registered owner as Municipal Reserve (MR), (in each shall not include lands held as Environmental Reserve) under the provisions of the Municipal Government Act; “Tangible Capital Asset Policy”: Vulcan County’s Tangible Capital Asset Policy 12-2214. “Tender”: is an offer to do or perform an act which the party offering, is bound to perform to the party to whom the offer is made.

GENERAL

1. The disposal of County lands will be considered in the context of the overall policies of the municipality, including the Municipal Development Plan, Land Use Bylaw, and adopted Strategic Plan. 2. The sale of land may be initiated by either the municipality or by an individual, company or organization that is interested in acquiring the land. 3. If lands are required for municipal purposes, the County shall have the right to use and or/ subdivide and/or dispose the lands as it requires to meet that municipal purpose. No compensation for municipally used or disposed lands for municipal purposes will be provided to the lessee other than adjustments to lease rates. 4. The County shall not dispose of Reserve Lands and Former Reserve Lands in an Inter- Municipal Development Plan area without prior consultation with the appropriate municipalities. 5. The County shall dispose of Reserve Lands, Former Reserve Lands and Fee Simple Lands in accordance with the Municipal Government Act. 6. Disposal of lands which is initiated by the County shall be done through motion of Council. 7. If Fee Simple Lands are sold for less than market value the proposal must be advertised in accordance with section 70(1) of the MGA. 8. The County shall not trigger the disposal of more than 8.5% of the total lands owned by the Municipality in a single calendar year.

SALES PROCEDURE

1. Reference will be made to statutory documents including the Land Use Bylaw, Municipal Development Plan and Intermunicipal Development Plans prior to consideration of, and advertising the sale of municipal property. 2. The Chief Administrative Officer, or designate, shall a) have an appraisal done on the subject property to assist in establishing a market value, or b) Council will establish a reserve price for the Lands, which shall be a minimum of ten (10) times the assessed value of the Lands 3. The Chief Administrative Officer, or designate, shall have prepared an information package on the subject land(s) that includes the following: a) A brief description of the subject land(s) (including the location, minimum sale price, zoning and any other relevant information); b) Copy of the title and plan; c) Copy of relevant zoning and development permit guidelines, if applicable; d) Copy of any covenants registered on the property; e) Land Purchase Application form that is to be completed by the prospective purchaser. 4. The County website will be utilized to list municipal owned lands that are being offered up for sale to the public. 5. The lands will be sold pursuant to the following tender process:

a) The lands will be publicly advertised for sale for a minimum of two (2) weeks. The advertisement will include: i. The legal land description of the lands for which tenders will be accepted; ii. The date and time the tender for the property closes, which shall be no less than thirty (30) days after the last advertisement date; iii. The date in which lands can be viewed by potential buyers; iv. The street address and mailing address of the County’s Administration Office; v. That the current Lessee will have a maximum of five (5) business days, excluding Saturday, Sunday, and named holidays, to match plus one (1) dollar the highest tender received for the lands; vi. Penalty amount for not completing the purchase of a successful tender; vii. Any other conditions or requirements of the County. b) Bids will be accompanied by: i. The name, address and phone number of the purchaser; ii. A certified cheque in the amount of 10% of the bid price. c) Bids will be awarded on a cash basis only. The County will not finance the lands. d) Leasehold improvements of fences, dams, dugouts and re-seeded lands remain and will be sold with the lands and no compensation will be available to lessee. Other leasehold improvements such as buildings and structures can be removed at the discretion of the current lessee. e) The possession date shall be determined by Council. f) The tender opening will be open to the public. g) Once all the tenders have been opened and the tenders recorded, the current lessee shall have, immediately following the opening of the last tender, a maximum of five (5) business days, the option of matching the highest tender plus one (1) dollar. h) If the current lessee does not exercise the option to purchase the lands, the lands shall be sold to the highest tender. i) The balance of the funds required for the sale shall be paid to the County within thirty (30) days following the date of the tender opening. j) Both successful and unsuccessful tenders will be notified of the results of the tender. k) Should a successful tender not complete the purchase of the Lands, the ten (10) percent deposit shall be forfeited to the County and the sale process shall be repeated anew. 6. A report of the tenders received and the successful proponent shall be compiled by the Chief Administrative Officer or designate and be made available to Council at the next Council meeting. 7. The Chief Administrative Officer, or designate shall complete the sale agreement process upon satisfaction of matters related to conditions.

USE AND MANAGEMENT OF SALE PROCEEDS

1. Fee Simple land sales generating more than $100,000 in proceeds shall have: a) 25/26ths of the sale proceeds shall be placed in the Land Sales Capital Reserve.

b) 1/26th of the sale proceeds shall be placed into the General Municipal Operating Contingency Reserve. 2. The Lands Sales Capital Reserve shall be utilized to fund capital projects with an expected useful life of 26 years or greater, as defined in the Tangible Capital Asset Policy.
