Wiltshire Local Development Framework Wiltshire Core Strategy (partial review) Gap Assessment Paper 1: Saved policies Contents 1.0 Introduction 2.0 Local Development Scheme 3.0 Extant Local Plans and Saved Policy Review 4.0 The National Planning Policy Framework and Planning Practice Guidance 5.0 Analysis and Recommendations Appendix A ‐ Detailed Review of Saved Policies 2 1.0 Introduction 1.1 The purpose of the partial review of the adopted WCS is to assess the need for further detailed development management policies, in effect removing the saved district local plans and to update the WCS to ensure that it addresses any minor gaps in conformity with the NPPF and the supporting NPPG, which were identified and agreed through the WCS Examination In Public (EIP). This was due to the publication of the NPPF / NPPG so soon after submission of the WCS to the Secretary of State. The commitment to a partial review of the WCS was provided through the publication of a revised Local Development Scheme. The outcome of this partial review will be to provide a single consistent and comprehensive planning document with which to assess planning applications in Wiltshire. 1.2 This paper has been prepared to inform the scope of the partial review and summarises the assessment of the existing local plan saved policies, and proposes a series of recommendations for further work in terms of policy development where it is assessed that policies maybe missing, need replacing or further work is required to draw a conclusion. The intention of this paper is solely to focus on the scope of the partial review and the issues that could be addressed. 1.3 It should be noted that it is not the purpose of the review to re‐open discussion about other parts of the WCS and it will effectively be a series of focused amendments to the adopted core strategy. 2.0 Local Development Scheme 2.1 The partial review is programmed in the Local Development Scheme (LDS) for Wiltshire alongside a number of further Development Plan Documents (DPDs) that are proposed to address planning issues across Wiltshire. The latest LDS for Wiltshire was approved in January 2015. Specifically this review is programmed to refine certain policies to assist in the determination of planning applications, a key area being a review of all remaining saved policies from previous district local plans, policies for town centres and recreation. 2.2 The LDS programmes several other DPDs to be prepared: Gypsy and Traveller DPD Wiltshire Housing Site Allocations DPD Chippenham Site Allocations DPD 2.3 The LDS also programmes the preparation of the Wiltshire Community Infrastructure Levy. 3.0 Extant Local Plans and Saved Policy Review 3.1 Wiltshire currently has four extant local plans and a single adopted Development Plan Document1. Paragraphs 214 and 215 of the NPPF set out the approach to existing policies. From March 2013, due weight should be given to relevant policies in existing plans in accordance with their degree of consistency with the NPPF. The more consistent the policies in the plan to the policies in the NPPF, the greater the weight they are afforded. 3.2 All existing local plans have all been prepared under previous planning regimes and 1 Wiltshire also has a suite of Minerals and Waste documents that are jointly produce with Swindon Borough Council. It is not proposed to review these documents. 3 different national policies and it is the intention of this review to enable the local plans to be superseded by incorporating any necessary planning policy areas into the Wiltshire Core Strategy to provide a single comprehensive document covering policy issues across Wiltshire that is fully in accordance with the NPPF. 3.3 The existing plans in Wiltshire plans are: Kennet Local Plan 2011 – Adopted April 2004 North Wiltshire Local Plan 2011 ‐ Adopted June 2006 Salisbury District Local Plan 2011 ‐ Adopted June 2003 West Wiltshire District Plan 2011 First Alteration – Adopted June 2004 West Wiltshire Leisure and Recreation Development Plan Document (DPD) – Adopted February 2009 3.4 Then saved policies have been scoped to determine if existing policy areas should be considered for continued inclusion and this is available at Appendix A. 4.0 The National Planning Policy Framework and Planning Practice Guidance 4.1 The NPPF was published in March 2012, towards the end of the formal stages of preparing the WCS. At submission to the Secretary of State the Council assessed the WCS’s consistency with the new national policy and identified areas where the Plan needed to be amended or where early review would be needed to ensure clearer consistency with national policy. For example, two main areas for immediate review was the WCS’s approach to town centres and open spaces in the County, but overall the exercise concluded that the policies within the WCS is in conformity with national policy and the plan should progress to examination by the Secretary of State. These two policy areas were also discussed at the Examination into the WCS. Due to the nature of the evidence required for these issues evidence work has commenced on these topics. The WCS has now been adopted. Further national level guidance, which clarifies how the policy in the NPPF is to be delivered has since been published in March 2014 within the Planning Practice Guidance (PPG), which also needs to be reflected within the WCS partial review. 4.2 A scoping assessment has also been made as to which policy areas within the NPPF and NPPG the Council should consider for further inclusion within the WCS. This is available in the document entitled ‘Gap Assessment Paper 2: Compliance with NPPF & PPG’. 5.0 Analysis and Recommendations 5.1 The analysis in this paper has therefore involved a review of all saved to assess their continued relevance to planning issues in Wiltshire and their compatibility with the NPPF. The recommendations of areas of further work coming out of this assessment is summarised below. This is provided in more detail in Appendix A: Detailed Review of Saved Policies. 5.2 This paper recommends, based on a high level analysis of the saved policies, what policy areas should be considered by the council in more detail, possibly through more evidence gathering, to determine whether the area should be incorporated into the WCS or not. This should be read in conjunction with the analysis on the NPPF and NPPG. 5.3 The recommendations are listed below and set out in a bit more detail in table 1. These represent the scope of the planning issues that could be addressed by the partial review. For 4 ease of reference the policies are split by theme, with reference to the Community Area Strategies and Strategic Objectives of the Wiltshire Core Strategy. Strategic Objective 1 – delivering a thriving economy 1. Telecommunications especially with respect to the design of larger installations 2. Retail and town centre planning policies to include the defining or redefining of primary and secondary shopping frontages, primary shopping areas and town centre boundaries 3. Retail and town Centre uses site allocations if need is identified 4. Farm Diversification, horse related development and buildings to meet the requirements of agriculture 5. Employment allocations – incorporation of saved policy text into the WCS Strategic Objective 2 – addressing climate change All previously saved policies have already been replaced by the WCS or deleted. Strategic Objective 3 – to provide everyone with access to a decent, affordable home 6. Replacement of existing dwellings in rural areas 7. Temporary Housing for Rural Workers 8. Extensions to dwellings and buildings in the countryside 9. Accommodation for dependent persons 10. Flat Conversions 11. Housing allocations – incorporation of saved policy text into WCS if still required Strategic Objective 4 – helping to build resilient communities 12. Location of / permissive exceptions policy on education and community facilities including playgroups, day nurseries, child‐minding facilities, health,, social services, places of worship, community halls, indoor and outdoor sports and recreation facilities and cemeteries. 13. Community facilities allocations – incorporation of saved policy text into WCS if still required Strategic Objective 5 – protecting and enhancing the natural, historic and built environment 14. Facilities for boat users and control of development along the Kennet and Avon Canal 5.4 Table 1 below summarises the recommendations for further work arising from the analysis set out in the appendices. This includes some discussion about aspects of the further work that is required for either a new policy to be created as part of this update, or for one of the existing Core Strategy policies to be updated to reflect the content of the saved policy.
