Regulation Best Interest (BI) goes beyond previous “suitability” standards for investment brokers to ban certain practices and address elements of the broker-customer relationship including cost considerations and conflicts in broker compensation. Form CRS is a streamlined disclosure document to provide retail customers with information about fees, costs, services, conflicts of interest, the applicable standards of conduct, and any previous legal or disciplinary history. The Commission also approved an interpretation that updates and clarifies the standards of conduct for investment advisers under the Investment Advisers Act of 1940, and an interpretation of the “solely incidental” aspect of the broker-dealer exclusion under the Investment Advisers Act, intended to offer clearer guidance about when a broker- dealer’s activities cross the threshold to become investment advice.

It is an honor to address you from the fully restored Historic Supreme Court Chamber in our State Capitol. It seems appropriate somehow that I deliver my 2021 State of the State address to you from this room where so much of our history has happened. It was here where our groundbreaking Constitution was ratified. That document begins in the first article by asserting that "All power is inherent in the people and all free governments are founded on their authority and instituted for their peace, safety, and happiness..." Section 2 reads: "In their inherent right to life liberty and the pursuit of happiness, all members of the human race are equal;" a clear echo of the Declaration of Independence. Then, Section 3 contains the text that put this very room on the National Register of Historic Places, "Since equality in the enjoyment of natural and civil rights is only made sure through political equality, the laws of this state affecting the political rights and privileges of its citizens shall be without distinction of race, color, sex, or any circumstance or condition whatsoever other than individual incompetency, or unworthiness duly ascertained by a court of competent jurisdiction." With these words, Wyoming became the first government to permanently recognize the inherent right of women to vote one hundred thirty one years ago.

Moore University of Hawai‘i at Mānoa Introduction Hawai‘i’s slow economic recovery continued throughout 2014. Despite the improving eco- nomic news, voters ousted their brash and combative sitting governor Neil Abercrombie in the Democratic primary. The humble, unassuming state Senator David Ige rolled to a general elec- tion victory. The new governor, an electrical engineer by training and a veteran chair of the Sen- ate Ways and Means Committee, looked to bring less in terms of policy change and more in terms of approach to governance. Governor Ige was inaugurated on December 1, 2014, and his biennial budget was released on December 22. The original request reflected a status-quo budget prepared by the outgoing Aber- crombie administration. In late January 2015, Ige’s administration put together an amended budget that slightly increased budgetary requests based on expected revenue increases. Recalling the previous years’ experience of overestimated revenues, the legislature passed a conservative budget largely similar to the governor’s budget request with few alterations or new programs. State of the Economy Through 2015, economic recovery in Hawai‘i remained slow, with GDP growth since 2010 at or a bit below two percent per year (DBEDT 2015a). Unemployment continued its downward trend since its high of 7.1 percent in September of 2009. As of the end of the legislative session in May of 2015, the rate stood at 3.9 percent, still a bit above its historical average during better times (see Figure 1).

Adams, a Case on Judicial Balance CLIENT HIGHLIGHTS October 9, 2020 On Monday, October 5, 2020, the U.S. Supreme Court began its term with eight justices on the bench, after the passing of Justice Ruth Bader Ginsburg nearly three weeks ago. By teleconference, the Supreme Court heard oral arguments for Carney v. Adams, a timely case on whether Delaware's law to politically balance its own courts is constitutional. At the center of the dispute are two Delaware laws known as the “bare majority” provision and the “major political party” provision. Under the former, state courts are allowed to have only a bare majority of judges from any one political party. Under the latter, the remaining seats on certain courts must be filled by judges from the other major political party. Currently, appointees affiliated with the Democratic Party hold a bar majority of the courts’ seats, with the balance being held by appointees affiliated with the Republican Party. For two branches of the State’s courts system, only the bare majority requirement applies. Michael McConnell, former Tenth Circuit Judge and now of Wilson Sonsini, argued on behalf of Governor Carney and the state that the major political party provision provides a "valuable backstop" to the bare majority provision. McConnell said that without that backstop, governors could simply nominate someone—whether an “independent” or a member of a political party— like the Green or Libertarian parties—whose views align with those of the governor and his party. That would frustrate Delaware’s goal of creating “stable, balanced, and nonpartisan” courts, which have attracted a majority of major companies to incorporate in the state.
