Stav: Musical Plagiarism: A True Challenge for the Copyright Law MUSICAL PLAGIARISM: A TRUE CHALLENGE FOR THE COPYRIGHT LAW Iyar Stav* ABSTRACT The interface of law and music has always appearedunnatural. While the law aims to provide certainty and order, music is more often observed as a field which operates in a boundary-less sphere. For that reason, the endeavor to treat purely musical is- sues with clear, conclusive and predeterminedlegal rules has been perceived as a fairly complicated task. Nevertheless, while music has become a prospering business, and musical disputes have been revolving around growing amounts of money, the law was re- quired to step in and provide clear standards according to which these disputes should be settled. The courts in USA and UK have established and developed several doctrines intended to set a uni- fied framework for assessing the extent of similarities between an original work and an allegedly later infringing work.

Heaven Is A Place On Earth artist:Belinda Carlisle , writer:Rick Nowels, Ellen Shipley Chorus: Ooh, baby, do you know what that's worth? Ooh, Heaven is a place on Earth. They say in Heaven love comes first, We'll make Heaven a place on Earth, Ooh, Heaven is a place on Earth. Instrumental Chorus When the night falls down, I wait for you, and you come around, And the world's alive With the sound of kids on the street outside. When you walk into the room You pull me close and we start to move, And we're spinning with the stars above, And you lift me up in a wave of love. Chorus When I feel alone I reach for you, and you bring me home. When I'm lost at sea I hear your voice and it carries me. In this world we're just beginning To understand the miracle of living. Baby, I was afraid before But I'm not afraid anymore. Chorus . In this world we're just beginning To understand the miracle of living. Baby, I was afraid before But I'm not afraid anymore. Ooh, baby, do you know what that's worth? Ooh, Heaven is a place on Earth. They say in Heaven love comes first, We'll make Heaven a place on Earth, Ooh, Heaven is a place on Earth. Ithaca College Theatre presents Songs by The Go-Go's Based on The Arcadia by Sir Philip Sidney Conceived and Original Book by Jeff Whitty Adapted by James Magruder Original Broadway Production produced by Christine Russell Louise Gund Donovan Leitch Rick Ferrari Gwyneth Paltrow Scott Sigman Hunter Arnold Tom Kirdahy Jordan Roth The World Premiere of Head Over Heels took place at Oregon Shakespeare Festival Bill Rauch/Artistic Director; Cynthia Rider/Executive Director Developed with the support of New York Stage and Film & Vassar’s Powerhouse Theater, Summer 2016 Produced by special arrangement with Broadway Licensing. (www.broadwaylicensing.com) Audience Advisory: Head Over Heels contains atmospheric elements including flashing/strobe lights and high-volume sound, as well as mature sexual content. DIRECTOR’S NOTE Let’s address the elephant in the room. The Coronavirus Pandemic has made this past year challenging for each and every one of us. This is probably one of the first times you have witnessed live/semi-live theatre in over a year. For some of you, this is your first time in a theater in too-long of a time. And if you’re like us, you’ve missed it more than words can describe. We are honored that Head Over Heels at Ithaca College is the production that brings you back home. Although this might not be how you pictured your return to the theater, we can assure you that our production is unlike anything you’ve ever seen on stage (in more ways than one). With the pandemic in full swing, we were faced with a variety of different challenges when bringing this show to life.

Stuart Rosen Senior Vice President General Counsel November 20, 2015 Chief, Litigation III Section Antitrust Division U.S. Department of Justice 450 5th Street NW, Suite 4000 Washington, DC 20001 Re: Justice Department Review of the BMI and ASCAP Consent Decrees To the Chief of the Litigation III Section: BMI recently alerted its community of affiliated songwriters, composers and publishers to the profound impact 100% licensing would have on their careers, both creatively and financially, if it were to be mandated by the U.S. Department of Justice. In a call to action, BMI provided a letter, one for songwriters and one for publishers, to which their signatures could be added. The response was overwhelming. BMI received nearly 13,000 signatures from writers, composers and publishers of all genres of music, at all levels in their careers. Some of the industry's most well- known songwriters added their names, including Stephen Stills, Cynthia Weil, Steve Cropper, Ester Dean, Dean Pitchford, Congressman John Hall, Trini Lopez, John Cafferty, Gunnar Nelson, Lori McKenna, Shannon Rubicam and Don Brewer, among many others. Enclosed you will find the letters, with signatures attached. On behalf of BMI, I strongly urge you to consider the voices of thousands of songwriters and copyright owners reflected here before making a decision that will adversely affect both the creators, and the ongoing creation of, one ofAmerica's most important cultural and economic resources.
