Kern is a prospective non-commercial community broadcaster in Bakersfield, California. Kern is supplying this comment to shed light on the reality of how duplicated- and rebroadcast- programming is an epidemic. Redundant and relayed programming is hollowing-out local radio, vastly reducing programming diversity, and frustrating diverse new broadcast entrants. This reply is being filed as a response to National Association of Broadcasters’ (“NAB”) comment stating that diversity has increased on the dail, advocating the lift of the duplication rule. Kern provides proof in this reply that the program duplication rules need to be expanded to ensure local programming diversity and allow for new entrants. About Kern Community Radio Members of Kern Community Radio had desired to pursue a non-commercial, educational community radio station for Bakersfield in 2006 due to the total absence of any local local secular non-commercial radio. Bakersfield, a metropolitan area of roughly 840,000 people, does not have one local-studio secular, non-commercial radio station. That includes no secular LPFM, no local-content NPR station,1 no community station, or no college station. The entire non-commercial FM band except for one station is all relayed via satellite from chiefly religious broadcasters from Texas, Idaho, and Northern California.

Primary Funders – California Seismic Safety Commission (CSSC) California Emergency Management Agency (CalEMA) 2008 Survey Results • California residents are exposed to numerous ongoing programs and recommended actions designed to increase household earthquake preparedness and mitigation. • Most of the actions Californians have taken are simple preparations; relatively few households have acted to mitigate losses and reduce injuries. • Over 80% of California residents have collected information about earthquake preparedness from TV anchors or reporters and, to a lesser extent, radio hosts or reporters (58.6%), schools (54.1%), and friends and relatives (50.6%). 2008 Survey Results, continued • Intuition has most frequently been used as the basis for developing the content and dissemination of earthquake preparedness and mitigation programs in California; evidence-based knowledge about how to motivate people to get ready has been underutilized. • Messages on earthquake preparedness and mitigation developed specifically for dissemination in California have low market penetration. 2008 Survey Recommendations • Disseminate a standardized message to households about earthquake preparedness and mitigation.

    Other Conditions (continued) Attachment 1 PERSONAL USE FIREWOOD PERMIT 2. Permit becomes effective on April 1st. 3. Permit is valid for gathering conifer softwood, hardwood or combination thereof, regardless of species shown on face of permit. Permit does not authorize the permit holder to access roads that have been closed due to weather and/or risk of resource damage. Permit must be displayed on the dashboard of the permittee’s vechicle. 4. Product Removal Record must be completed each day in ink by Permittee before leaving permit area. Date entry must be completed before harvesting begins and amount must be completed before transporting more than 500 feet from where wood is loaded. Firewood may not be transported in lengths exceeding 10 feet. 5. Cutting and loading of firewood is permitted only during daylight hours. 6. Firewood material must be dead (without green leaves or needles). 7. Standing dead oak trees may NOT be cut on the Hume Lake Ranger District. 8. Standing dead conifer trees (snags, with no green showing in crown), can be cut between JUNE 1 and OCTOBER 15 on the Hume Lake Ranger District, Provided they are no larger than 15 inches in diameter (circumference of 47 in.) at ground level. Leave a stump height of less than 12 inches from the ground on the high side of the tree. Cutting permitted only within 150 feet of road edge. 9. Standing dead trees (snags, with no green showing in crown), can be cut between JUNE 1 and OCTOBER 15 on the Western Divide and Kern River Ranger Districts, Provided they are no larger than 15 inches in diameter (circumference of 47 in.) at ground level.
