Town Council Minutes of a meeting held on Thursday 14 May 2020 at 19:00hrs. Meeting held with remote attendance. Present: Chairman: Councillor L Knight. Councillors: E Andrews*, J Buczkowski, M Dale, R Dietrich, G Guest, K Haslett, J Johns, W Jones, J Lochhead, I Morton*, R Murch*, M Rowe and M Smith*.

In attendance: Joy Norris (Town Clerk), Steve Reardon (Assistant Town Clerk) and Maria Weston (Deputy Town Clerk).

* in attendance for only part of the meeting.

No members of the public at tended the meeting.

1. Apologies for Absence An apology for absence was received from Councillor Baldwin; Councillor Smith stated that, due to multiple commitments, he would have to leave the meeting at 19 :30 hrs .

2. Declarations of I nterests The follo wing Declarations of Interest s were made: Following guidance, Councillor Guest declared a personal s interest in item s 6a and 6b and a prejudicial interest in agenda item 6c .

3. Public Participation There were no members of the public present.

4. Minutes : The Minutes of the meeting held on 21 April 2020 were considered. RESOLVED that the Minutes of the me eting held on 21 April 2020 be adopted as a correct record.

5. Resolutions : The previous resolutions made by the Committee and the action tak en to implement those decisions were reported for information . RESOLVED to note previous resolutions made by the Council and the action taken to implement those decisions. 6. Motion made Standing Order No 9 To consider motions submitted by Councillor Gord on Guest , namely: Councillor s L egal Exp enses for Code of Conduct Complaints (a) Cullompton Town Council creates a new Code of Conduct policy which states clearly whether or not the Town Council supports a Councillor in code of conduct complaints and in what circumstances it would not support a Councillor in a code of conduct complaint. Note: 19:17hrs Councillor Morton left the meeting.

RESOLVED that Councillor Gordon Guest is given a dispensation regarding his personal interest in agenda items 6 a and b 6a and 6b but due to his prejudicial (financial) interest will be removed for the debate and resolution of item 6c.

Councillor Gordon Guest stated that he was involved in a Code of Conduct (CoC) complaint an d is aware that other Councillors have similar ex periences; until being part of the complaint process he was unaware of the legal complexities of such complaints and that s taff are covered by Employee Liability Insurance but Councillor s are not by any means . Having explored h is position with his own insu rers stated it became apparent that his own pers onal insurance cover would not cover his legal expenses as a councillor . Cllr Guest said he was putting forward his motions to gain clarity in the matter of legal representation for M embers including those involving Code of Conduct matters. Discussion on the motions included :  The provision of support for Councillor s experiencing CoC complaints and other legal matters directly related to their role as a Councillor .  A report would be helpful detail ing what mat ters can be brought under Code of Conduct complaints , how the matter may be investigated and the possible sanctions .  There could be a conflict if the Town C ouncil policy was to provide legal support for a Councillor in any matter despite the Councillor be ing found to be in b reach of the Code of Conduct.  Predetermina tion by the Town C ouncil must be avoided .  Surprise that support for Councillors is not available through the Association of Local Councils .  Important that any advice for councillors is completely independent of the Town Council  Councillors should be able to access support in a similar way to staff accessin g support through a trade union. Note 19:28hrs Councillor Smith left the meeting.

 At the present time, there is no mechanism to support a Coun cillor who is undergoing a CoC complaint nor is there anywhere else to seek such help. In short, the Councillor experiencing a complaint is left entirely to his or her own devices with no support from any source .  There may need to be a range of options to suit differing circumstances.  At the present time there is no protection or support for Councillors unless they make their own arrangements . RESOLVED that the meeting be adjourned for 5 minutes to enable Councillor Andrews to try and resolve the difficult ies with her phone . Note: (i) the meeting adjourned at 19:35hrs and resumed at 19:40 hrs but Councillor Andrews did not re -join the meeting (ii) Councillor Guest left the meeting upon its resumption

Page 2 of 10  The Town C ouncil has no current information of what other council s do in respect of Councillor legal support.  Councillor Guest had tried to raise this matter with the Policy, Finance and Personnel Committee but unfortunately the meeting was not quorate and thought the matter should be referred to Council for considerati on.  The possibility of reimbursement of support costs when the outcome of a complaint is determined as the Councillor not having broken the CoC .  Councillors may not have the means to fund support if a complaint is made against them.  The possibility that without some sort of support, that there will be difficulty in attracting new Councillor s and that there may be resignations of existing members.  Ideally there needs to be something in place that means the Town Council doesn’t have to make a decision about whether or not to reimburse costs before there is an outcome to a complaint  There was feeling that , whilst an insurance based policy may be the solution at present no such policy has been found and it was felt that the association of Local Councils should have a scheme in place given the sums paid to them for membership of these bodies.  It was suggested that the council’s legal advisors are approached to investigate the cost of having a specific period of legal advice available e.g. 1 hour to a Councillor in the event of a complaint being made against individual members .  It was emphasised that the Town Council is insured for decisions made as a Council – it is individual Code of Conduct complaints that are not covered.

RESOLVED to adjourn the meeting for 10 m inutes in order for meeting attendees to participate in the weekly applause for key workers . Note: the meeting resumed at 20:07hrs

RESOLVED (i) That Cullompton Town Council creates a new Code of C onduct policy which states clearly whether or not the Town Council will support a Councillor in Code of Conduct complaints and in what circumstances it would not support a Councillor in a Code of Conduct complaint. (ii) That Cullompton Town Council create mecha nism (s), either using existing insurance or legal support arrangements or some other means to ensure all Cullompton Town Councillor s have access to legal s upport including for Code of Conduct allegations.

(c) Councillor Guest has had to pay private legal fees to defend his actions as chair of the Cullompton Town Council Planning com mittee. He requested Cullompton Town Council to reimburse all these lega l fees, as quickly as possible a s this action was solely about his role as a Town Councillor .  Councill or Guest stated that MDDC stated that the result of the Monitoring Officer’s investigation would be known in due course. The case is, therefore, still open.  Legal fees run to several hundred pounds at this time.  There was a view expressed that, as the com plaint is still ongoing, there cannot be support for 6c in the possible event that the complaint is upheld.

Page 3 of 10 RESOLVED to exclude the public and press from the meeting to enable the Council to obtain information regarding the complaint made against Councill or Guest on the grounds that publicity would be prejudicial to the public interest by reason of its confidential nature (complaint under investigation)

Councillor Guest explained the circumstances and substance of the complaint made against him and conf irmed he has yet to receive notification of the Monitoring Officer ’s findings.

RESOLVED that the meeting returns to public session.

Note: (i) The meeting went into closed session at 20:17hrs and returned to open session at 20:33hrs (ii) 20: 34hrs Councill or Guest left the meeting having declared a pecuniary interest.

RESOLVED that the matter of reimbursing Councillor Guests legal fees is deferred until such time as the Monitoring Officer has made a determination on the Code of Conduct Complaint. Note: 20: 38hrs Councillor Guest was readmitted to the meeting.

7 Recommendations from the Policy, Finance and Personnel Committee The Policy, Finance and Personnel Committee met on 5 May 2020 and made recommendations to Council regarding the adoption of a Public Participation Policy and the complementary amendments to Standing Orders .  There was a feeling that the council is incredibly generous in giving time to participants in Public Question Time. This matter is at the discretion of the Chair but there may be ci rcumstances when it may be prudent to give a public speaker more than the allocated 3 minutes. Conversely, it may be prudent to limit them to only 3 minutes dependent on the circumstances and the level of business to be debated.  If 3 minutes are to be app lied, there needs to be some sort of indicator to the speaker that the end of their time to speak is approaching.

RESOLVED: (i) That the Public Participation Policy (attached as Annex 1 to these minutes ) is adopted with immediate effect. (ii) That the Standing Order s to comple ment the Pub lic Participation Policy, as recommended by the Policy, Finance and Personnel Committee are adopted with immediate effect.

8. Chair of Planning and Licensing Committee Consider ation was given to Councillor Guest resuming the duties and responsibilities of the Chair of the Planning and Licensing Committee

RESOLVED that Councillor Guest is reinstated as Chair of the Planning and Licensing Committee.

Note 20:50hrs Councillor s Jones and Murch left the meeting.

9. Cha rter Consideration was given to the Town Council’s response to Mid District Counci l’s current consultation on a review of the Parish Charter . Discussion on this agenda topic included: Page 4 of 10  there is specific mention, early in the Charter, that District Councillor s are expected to attend Parish and Town Council meetings to report on District matters. District Officers are also expected to attend to discuss matters of interest.  Length of time given to local councils to respond to consultations  Allocation s ection 106 money  Play park and leisure provision  Towns and taxpayers throughout the district need to be treated equally when it comes to double taxation e.g. cemetery, market, emptying bins, sport & leisure Note: 21:03 Councillor Murch left the meet ing .

RESOLVED that the Town C lerk responds to the consultation and includes the following points in the response :  That District Council treat s all towns and indeed tax payers equally and fairly in respect of double and triple taxation. As examples - Cemeteries , Cullomp ton tax payers pay for Cullompton Cemetery via the Town Council precept but als o for and Tiverton Cemeteries via the MDDC precept; Market s are funded at Tiverton but not at Cullompton  that the charter emphases that District Councillor s are required regularly to attend Par ish and Town Council meetings.  More through consultation with longer time lines is required on the spending of available discretionary funding including s106 monies.  Lack of equality in sport and leisure provision; MDDC transfers Cullompton play area s to the Town Council whilst funding many of Tiverton’s play areas , which again, Cullompton tax payers partially fund through the MDDC precept.

Payments The accounts due for payment were considered. RESOLVED t hat accounts due for payment are approved

10. Audio and Video Recordings of Town Council and Committee Meetings The Town Council has an existing practice of audio recording Town Council and Committee meetings; at the present time with meetings being held by means of remote attendance there is also an opport unity to video record meetings. The Council wa s asked to consider (i) Whether or not Town Council and Committee meetings held by means of remote attendance should be both audio and video recorded (ii) The retention period for any recordings. Legal advice on this m atter has been sought and research is ongoing into the practice of other public authorities but this had not been received at the time of the meeting.

RESOLVED: (i) that this matter is deferred until such time as Legal advice has been received and that bes t practice has been established and (ii) Until such time as l egal advice has been received and best practice has been established, a f ull recording, (video and audio) of formal meetings will be made and retained by the Town Council but not published whilst re cognising that if a Freedom of Information request is received , the Town C ouncil will be obliged to release such recording .

REPLACES POLICY New Policy POLICY AIM This policy sets out the Town Council’s stance regarding public participation at formal meetings and the procedures that are implemented to enable the public to raise matters at meetings of the Town Cou ncil and its committees.

1. Policy Statement The Town Council welcomes the public attending the formal meetings of the Town Council and Its Committees and actively encourages people to raise issues and topics about the town. The Town Council, as part of its approach to community engagement chooses to have an agenda item at its formal meetings called “Public Participation” where members of the public can make representations, ask questions, answer questions and give evidence. 2. Overview Members of t he public have the right to attend, but no legal right to speak, at meetings of the Town Council and its committees, however the Town Council welcomes people’s constructive contributions when they raise issues and topics about the town using the procedures set out in this policy and procedure document. The Town Council’s Standing Orders set the overarching principles for public participation at Town Council and Committee meetings, namely:  Items raised at a full Town Council meeting may be on any topic relev ant to Cullompton  Items raised at a Committee meeting must be relevant to items on the agenda for that meeting  Each member of the public may speak for a maximum of 3 continuous minutes  The overall length of time for the public participation on an agenda i s generally limited to 15 minutes – this includes the time for the members of the public to speak as well as for the responses to be given. The meeting Chairman may extend the time available for the public participation item but this is at their discretion and their decision is final.  At a meeting of the full Town Council the Chairman (usually the Mayor) will decide whether the matter is to be referred to a Committee or if an oral or written response is to be given at a Town Council meeting.  At a committee meeting the Chairman will decide whether an oral or written response is to be given  The Chairman may direct that a response is not given if, in their opinion, the question / statement is defamatory, frivolous, abusive or has been previously raised at a mee ting within the previous 6 months or requires the disclosure of confidential or exempt information. The Chairman’s ruling on this matter is final. Page 7 of 10  Neither questions / statements etc. made by members of the public nor responses given will be the subject of further debate or discussion at the meeting.  The Chairman, or any Committee Member may propose a motion under Standing Order 10 (xii) to not hear further from a member of the public , (xiii) to exclude a member of the public for disorderly conduct or any u se any other appropriate Standing Order. Public participation is not an appropriate time to  complain about general problems such as routine maintenance of facilities  demand information that is already publically available  make complaints about individual members of staff (Please send the details of these direct to the Town Clerk)

PROCEDURE Note: The arrangements may vary at the Town Council’s Planning Committee if a) an applicant wishes to speak about their planning application which is to be considered at the meeting b) if there are large numbers of people wishing to speak about the same planning application Responses will not be given to comments or questions from members of the public on specific planning applications . Before the Meeting 1. Any member of the public wishing to speak at a meeting is asked to contact the Town Council Offices at least 48 hours before the meeting starts to say that they will be attending the meeting and provide an overview of what they wish to speak about 2. Members of the public are encouraged to complete a public participation form which gives their contact details and brief information about what they are intending to say at the meeting. The form is available from the Town Council Offices and the Town Council’s website. Submission of a written question helps with managing the meeting, preparation of a response and minuting the meeting. At the Meeting 1. Members of the public should sign in - an attendance sheet will be provided for this purpose 2. Public Participation will usually be an agenda item listed towards the start of the meeting 3. The meeting Chairman will decide the speaker order and call people to speak; Priority will usually be given to questions / statements submitted in advance and they will usually be taken in the order in which they were received . 4. Members of the public may speak for a maximum of 3 minutes during the public participation agenda item 5. The overall length of time for the public participation item on an agenda is generally limited to 15 minutes – this includes th e time for the members of the public to speak as well as for the responses to be given. The meeting Chairman may extend the time available for the public participation item but this is at their discretion and their decision is final. 6. A member of the public speaking at a meeting must ask their question / address their comments to the meeting Chair. 7. The Chairman of the meeting may:  Direct that no response is required and that there will be no further communication on the matter  Provide a response or ask anoth er present Councillor to do so  Direct that an oral or written response is to be given An oral response will usually be given by an appropriate Town Councillor at the next appropriate meeting Page 8 of 10 A written response will usually be provided within 20 working day s and a summary provided in the supporting papers for the next appropriate meeting 8. At a Town Council meeting the Chairman may refer the question to an appropriate committee. During a meeting members of the public are asked to:  Behave in an orderly and res pectful manner and not heckle or otherwise disrupt the meeting  Respect the rulings of the meeting Chair During a meeting members of the public cannot:  speak during Councillor s debate or at any time other than during public participation unless expressly a sked to do so by the meeting Chair  vote on any proposals After a Town Council Meeting After a Town Council meeting the meeting administrator will notify a Committee Chairman and relevant Committee Administrator if any questions have been referred to it

(a) Standing Order 3e is amended to read (i) Members of the public may make representations, answer questions and give evidence at a full Town Council meeting which they are en titled to attend in respect of any matter relating to Cullompton (ii) Members of the public may make representations, answer questions and give evidence at a Committee meeting which they are entitled to attend in respect of the work of the Committee (iii) Members of the public are encouraged to complete a public participation form stating their question / statement and submit it to the Meeting Administrator at least 48 hours before the meeting, however questions may be asked or statements made without notice at the di scretion of the meeting Chairman. Priority will usually be given to questions / statements submitted in advance and they will usually be taken in the order in which they were received. (b) Standing Order 3h is amended to read In accordance with standing o rder 3(e), a question shall not require a response at the meeting nor start a debate on the question. In the case of a matter raised at a full Town Council meeting the chairman of the meeting may  Facilitate an immediate response  Direct that a written or o ral response be given.  Refer the question to the appropriate Committee for a response. For questions raised at a Committee meeting where it is not possible to give an immediate response the chairman of the meeting may direct that a written or oral respons e be given. In all cases where an immediate response is not given, the response or summary of the action taken shall be given at an appropriate future meeting.

Agenda No 7, Mid Devon P lay ing Pitch Str ategy

Cullompton Town Council Draft response to MDDC playing pitch strategy May 2020.

Background information and introduction to Cullompton Town Council response to the MDDC playing pitch strategy May 2020.

This background information is important as it provides the historical background and current 2020, context for Cullompton Town Council ’s sports, leisure and play parks vision and development.

In 2011 a new Town Council was elected by the public. MDDC had various initiatives occurring within Cullompton, several of which related to large -scale future housing. As a result, Cullompton Town Council joined a MDDC working party to look specifically at improving sports facilities within Cullompton.

Ideas identif ied were; a) Expand and improve the Culm Valley Leisure Centre, particularly to build a large two - storey extension on the rear. b) Use the MDDC land on Meadow lane for two tennis courts and a MUGA c) Expand the Cullompton skate park. d) Look for new extra land for mor e sports facilities as Cullompton expands with new houses.

Cullompton Town Council did a range of public consultations and questioners to the public these included questions on sport leisure, play parks and the swimming pool. These were conducted in 2011, 2013 and 2014 with a play parks survey again in 2015. This information informed the Town Council of the needs of the public and informed the Cullompton Neighbourhood Plan of public need.

MDDC had allocated the land on Meadow lane for housing; it was not prepared to do a land swap with housing developers or grant Cullompton Town Council any sports rights. No other land was forthcoming from MDDC. MDDC closed down the joint working group.

In May 2013, Cullompton Town Council produced a Provision of Leisur e Facilities in Cullompton policy paper. This was agreed and voted on by a l arge majority of the Town Council.

Cullompton Rugby Club rented one of its playing pitches. The owner cancelled the lease and the pitch was lost. Some years later, the pitch was built on as part of the Kingfisher Reach Town Council 28 May 2020 Appendix D Saxon field’s housing development. MDDC did not provide an alternative pitch despite involvement of the local MP Neil Parish and Sports .

Cullompton Town Council began the process of developin g a Neighbourhood Plan. This Neighbourhood Plan had a strong emphasis on sport and leisure due to the ongoing tensions and differences between Cullompton Town Council and MDDC in relation to sports and leisure.

CTC continued ongoing discussions with MDDC ref erence the Cullompton Skate Park. Eventually with support of MDDC and funding from Viridor Cullompton were allowed to expand the Skate Park on Meadow Lane. The new expanded Skate Park was opened by Neil Parish MP on 4 th July 2015.

MDDC (Adrian Cook) p resented a MDDC plan to close a large number of Cullompton Play Parks. In February 2015 Cullompton Town Council produced a further Play Parks and sport and leisure report. This was approved and adopted by the full town council. CTC inspected all play parks and asked local residents their views. CTC presented this report to MDDC who disagreed with the findings and determined to close some of the most popular play parks. Since 2015 Cullompton Town Council has obtained grant funding so that it can sign a lease agreement with MDDC and take on the refurbishment and maintenance of the following play parks; a) Headweir Road b) Tufty Park c) Culm Lea

In addition, they have refurbished Knightswood Play Park and the Upcott field (this needs checking )

During this time, CTC continued discussions in support of the Cullompton Rugby Club, Cullompton Cricket Club and the Swimming Pool Campaign. Both the Rugby Club and Cricket Club were highly successful and needed to gain more pitches either adjacent to their current sports site or a t relocated new sports land.

There were ongoing meetings with Neil Parish MP, Sports England, the Lawn Tennis Association and MDDC. MDDC remained unable to provide any new land for sports development and refused permission for sports development on land MDDC owned such as at Meadow Lane , Clover Drive , Swallow Way , Linear Park and other locations.

In 2015, the MDDC local plan identified a large amount of land (160 hectares) in East Cullompton to come forward for housing development as well as the existing plans for Cullompton NW Extension (95 hectares).

In February 2016 Cullompton Town Council met with Neil parish MP, the Regional Development Agency Devon County Council, Mid Devon District Council and other bodies to discuss housing growth of Cull ompton, the need for strategic development, which included sport and leisure facilities. Town Council 28 May 2020 Appendix D Cullompton Town Council used the Cullompton Neighbourhood Plan to support the Cricket Club and Rugby club plans to relocate in the future to gain extra playing pitches. This meant being able to relocate and find new sites. It also supported the swimming pool campaign in finding a site on which to build the Cullompton Swimming pool, which was privately financed.

Between 2015 and 2020, housing development continu ed in Cullompton. The Culm Valley Leisure centre was at full capacity due to the growth of the town, the Rugby Cricket , Hockey and Football club all expanded their teams due to the increase in population. Cullompton Community College (Secondary School) exp anded its pupil numbers and had extreme pressure put on its sports facilities . The school also needed to expand its sports facilities, but as with the sports clubs no land was available.

In January 2017 MDDC was successful in getting Government support f or the Culm Garden Village, a further 5,000 houses in addition to the several thousand already planned. Cullompton Town Council had further discussions with Sports England and the Lawn Tennis Association about obtaining improved, better and new sports faci lities through the Garden Village initiative .

During 2017 and 2018, Cullompton Town Council had further meetings with Sports England and MDDC, some in Tiverton with MDDC officers . Sports England were emphatic that if MDDC did not have a playing pitch strategy Sports England could not provide funding to help the sports clubs. MDDC rejected this information.

In January 2019, Cullompton Town Council met with MDDC CEO and other officers in Tiverton to discuss Leisure Facilities and a MDDC playing pitch st rategy. Sports England had been emphatic they could not help sports clubs with funding and relocation until MDDC had a playing pitch strategy. MDDC were equally emphatic at this meeting they would not develop a playing pitch strategy.

Cullompton Town Council had grave concerns that this MDDC attitude could block the cricket club relocating which would then block the development of the relief road.

The Planning for the Cullompton North West Extension, Cullompton Garden Village and Cull ompton East continues, as does the growth of Saxon Fields and Kingfisher reach and additional plans for CU21 and further land around Knowle Lane.

All of this expansion brings pressure on all Cullompton’s sport facilities. The table below indicates the con tinued rise in pupil numbers at the Cullompton Secondary School. The Devon County Council pupil formula is that 40 houses create one secondary pupil . So the increase in pupil numbers is directly related to ongoing house building without any increase or imp rovement in sports facilities .

Yes. Playing pitches are not enough to meet demand from community. Cullompton has no Tennis Courts, no MUGA and no swimming pool. No playing pitch for the Hockey Team or the Netball team.

Many sports clubs urgent ly require additional pitches and space.

As you may know, Mid Devon District Council is currently preparing a playing pitch strategy, assessing whether there is sufficient provision throughout the area for the sports of football, cricket, rugby , hockey and other pitch sports (such as rounder’s ) and tennis and bowls into the foreseeable futu re This study will improve planning for and investment in these sports, both with regard to grass and artificial grass pitch provision, and it is being overseen by a small Steering Group of local authority officers and national governing bodies of sport. The consultants carrying out this work were able to complete visits to visually assess as many pitches as possible early in March.

We fully appreciate the demands now being made of your time and the uncertainty and hardship being caused by the corona virus but hope to be able to carry on with this study and complete it later in the year.

There are different types of playing field sites in most and from initial analysis, we know that there may be issues with the quality of pitches and/or cha nging facilities and the cost of maintaining them. We are mainly interested in the pitches you own or manage and/or maintain, although would welcome your views on other provision within your area.

To ensure that we have all the data required to assess w hether there are sufficient facilities in Mid Devon district we would be very grateful if you could either complete the questionnaire link below OR respond to the following questions. We have provided two surveys as some town and parish councils will hav e more sites and/or issues that they wish to highlight than others, and therefore may prefer to give more detail, but we are happy for you to decide which way to respond. Any information you can give will be most helpful , as we are aware of the valuable contribution made by parish and town playing fields to sport in Mid Devon and wish to ensure that all concerns, issues, aspirations and proposals are recorded in the Strategy to help with future funding bids.

Agenda No 8, Public Space Protection Order Relating to Dog Control

Mid Devon District Council are considering making a Public Space Protection Order (PSPO) relating to dog control for the next three years. PSPOs are available to Local Authorities to deal with specific nuisance problems, in particular areas that are having, or are likely to have, a detrimental effect on the quality of life for those who live, work or play within the locality. The consultation is to consider widening enforcement powers, in order to deliver a cleaner and more sustainable environment across the District within the Mid Devon District Council Boundary and to replace current dog control powers which are due to expire in October 2020. The draft order is set out to achieve four main objectives- 1. Dog fouling 2. Dogs on leads in a) Cemeteries, b) Parks, c) When requested by an authorised officer or police constable, 3. Exclusion of dogs from play areas 4. Limiting the number of dogs walked at a time by one person The consultation is to canvas local opinion on the plans to introduce Public Spaces Protection Orders within the areas listed above. Page 24 Introduction Pursuant to Section 59 of the Anti-Social Behaviour, Crime and Policing Act 2014. Mid Devon District Council (in this Order ca lled “the Council”), in exercise of its powers under Section 59 of the Anti- Social Behaviour, Crime and Policing Act 2014 (“the Act”) and of all other enabling powers, after consultation carried out in accordance with the Act, and being satisfied that uncontrolled and irresponsible dog walking in public places has a detrimental effect on the quality of life of the local community and that the conditions set out in Section 59 of the Act are met, hereby makes the following Order. 1. Definitions and Interpretation

1.1 In the following provisions of this Order, the following terms shall have the meanings hereby respectively ascribed to them:- “Authorised Officer” means a person who is authorised in writing by the Council for the purposes of this Order “District of Mid Devon” means the land shown edge red on the plan marked “District” and referred to in Schedule A “Person in Charge” means the person who has the dog in his possession, care or company at the time the offence is committed or otherwise, the owner or person who habitually has the dog in his possession “Police Constable” means any person lawfully designated and authorised by a Chief Officer of Police to exercise the powers and duties of a Police Constable “Public Spaces” means land within the District of Mid Devon, which is open to the air including covered land which is open on at least one side and to which the public are entitled and permitted to have access, with or without payment, with the exception of Forestry Commission Land 1.2 Except when the context otherwise requires, the singular includes the plural and vice- versa; and the masculine includes the feminine and vice-versa. 1.3 Reference to an Act of Parliament, statutory provision or statutory instrument includes a reference to that Act of Parliament, statutory provision or statutory instrument as amended, extended or re-enacted from time to time and to any regulations made under it. 2. Scope This Order applies to the Public Spaces, Parks and Open Spaces cited in this Order within the District of Mid Devon, as indicated on the plans in Schedules A,B,C and D hereto. 3. Duration This Order shall come into effect on [ ] 2020 and shall remain in force for a period of 3 years from this date, unless extended by further orders made under the Council’s statutory powers. 4. Title This Order may be cited as “The Mid Devon (Public Spaces Protection) (Dog Control) Order 2020 ” and imposes the following requirements and prohibitions.

Dog Fouling 5.1 In any Public Spaces - 5.1.1 If a dog defecates at any time, the Person in Charge must remove the faeces from the land forthwith; and 5.1.2 A Person in Charge of a dog must have with them an appropriate means to pick up any faeces deposited by that dog, and must produce this if requested to do so by an Authorised Officer or Police Constable. 5.2 For the purposes of Article 5.1.1 - 5.2.1 Placing the faeces in a receptacle on the land which is provided for the purpose or for the disposal of waste, shall be sufficient removal from the land; and 5.2.2 Being unaware of the defecation (whether by reason of not being in the vicinity or otherwise), or not having a suitable device or means of removing the faeces shall not be a reasonable excuse for failing to remove the faeces. 6. Dogs on Leads 6.1 In any of the public cemeteries listed and shown in Schedule B to this Order, any Person in Charge of a dog, at any time, must put and keep the dog on a lead and under proper control. 6.2 In any of the of public parks listed and shown in Schedule C to this Order, any Person in Charge of a dog, at any time, must put and keep the dog on a lead and under proper control. 6.3 In all other Public Spaces a Person in Charge of a dog, at any time, must put and keep the dog on a lead and keep it under proper control when directed to do so by an Authorised Officer or Police Constable. 6.4 For the purposes of Article 6.3, an Authorised Officer or Police Constable shall only give a direction to put and keep a dog on a lead if such restraint is reasonably necessary to prevent a nuisance or behaviour by the dog likely to cause alarm, distress or disturbance to any other person or animal or bird on the land. 7. Dogs Excluded (Enclosed Children’s Play Areas) A Person in Charge of a dog is prohibited from taking that dog onto, or permitting the dog to enter or remain on any enclosed children’s play area (which are Public Spaces) described or listed in Schedule D to this Order. 8. Limit on number of dogs No person in any Public Spaces shall be in charge of more than 4 dogs at any time. 9. Offences and Penalties 9.1 Any failure to comply with the requirements or prohibitions imposed in Articles 5, 6, 7 or 8 of this Order shall constitute a criminal offence, unless: 9.1.1 The person has a reasonable excuse for failing to do so; 9.1.2 The owner, occupier or other person or authority having control of the land has consented (generally or specifically) to his failing to do so; or

Page 26 9.1.3 The person is exempt under Article 10 of this Order. 9.2 Any person guilty of an offence under this Order shall be liable, on summary conviction, to a fine not exceeding level 3 on the standard scale (on the date of this Order, this is set at £1,000). 9.3 A Fixed Penalty Notice may be issued by an Authorised Officer or Police Constable to anyone believed to have committed an offence under this Order. The Fixed Penalty shall be £100.00. Payment of the Fixed Penalty of £50.00 within 14 days from the date of the Fixed Penalty Notice will discharge the liability for prosecution. 10. Exemptions 10.1 The requirements and prohibitions imposed by this Order shall not apply to any person who: 10.1.1 is registered as blind, sight or hearing impaired under the National Assistance Act 1948, or any other legislation; 10.1.2 has a disability which affects his mobility, manual dexterity, physical coordination, or ability to lift, carry or otherwise move everyday objects, in respect of a dog trained by a registered charity and upon which he relies for assistance; or 10.2.3 is using a working dog for purposes of law enforcement, military duties or statutory emergency services (search and rescue). 11. Appeal Any interested person (defined as an individual who lives in the restricted area or who regularly works in or visits that area) may question the validity of this Order, pursuant to Section 66 of the Act, on application made to the High Court within 6 weeks from the date of the Order. 12. Validity (Severance) If any provision of this Order is held invalid or unenforceable for any reason by a court of competent jurisdiction, such provision shall be severed and the remainder of the provisions of the Order shall continue in full force and effect as if the Order had been executed with the invalid, illegal or unenforceable provision eliminated.
