Introduction In August 2014, EA Sports, a gaming empire, released the fifteenth version of Madden NFL, a video game that allows the player to simulate a professional football game using avatar versions of NFL players.1 The Madden NFL series warrants praise for its immense success—more than 100 million copies sold over the last twenty-five years—and for its realism, as “[t]he NFL superstars definitely look like their real life counterparts would.”2 Consistent with the game’s goal to become more realistic with each release, Madden NFL 15 boasted the new addition of one player’s tattoos, while simultaneously adding in some legal issues concerning copyright law.3 1. REV. 1947 (2015) The copyrightability of tattoos, however, does not just affect the booming video game market.8 The NFL continues to sign multi-billion dollar contracts to broadcast its games, which also display players’ body art.9 Professional athletes and their tattoos pop up everywhere: magazines frequently feature players’ barely clad bodies, and ESPN even dedicates an entire edition of its magazine to include images of unadorned athletes.10 Television networks, magazine publishers, and video game creators all need answers regarding their legal exposure when it comes to featuring athletes’ tattoos, but not a single court has addressed the issue head-on.11 This Note examines the limited and uncertain cases and scholarship discussing tattoos and concludes that the current precedent provides insufficient guidance in applying copyright protection to tattoos. It addresses this lack of supervision by analyzing the existing scholarship suggestions that justify copyright protection for tattoos and subsequently

Fighting and dancing games both emerge from Asia, and they both foreground the body. They strip down bodily movement into elemental actions like stepping, kicking, leaping, and tapping, and make these the form and content of the game. I argue that fighting and dancing games point to a key dynamic in videogame play: the programming of the body into the algorithmic logic of the game, a logic that increasingly organizes the informatic structure of everyday work and leisure in a globally interconnected information economy.

Gosling University of Salford This article considers the social importance of sports-themed video games, and more specifically, discusses their use and role in the construction of gaming and wider social narratives. Here, building on our own and wider sociological and video games studies, we advocate adopting an audience research perspective that allows for con- sideration of not only narratives within games but also how these narratives are used and located within the everyday lives of gamers. In particular, we argue that sports- themed games provide an illustrative example of how media texts are used in identity construction, performances, and social narratives. The other he can never remove; it’s the guise he projects in a futile attempt to feel he’s a part of the world around him, and not the misunderstood man whom life is repeatedly beating down. Fatherless, Arthur has a fragile mother, arguably his best friend, who nicknamed him Happy, a moniker that’s fostered in Arthur a smile that hides the heartache beneath. But, when bullied by teens on the streets, taunted by suits on the subway, or simply teased by his fellow clowns at work, this social outlier only becomes even more out of sync with everyone around him. Directed, co-written and produced by Todd Phillips, “Joker” is the filmmaker’s original vision of the infamous DC villain, an origin story infused with, but distinctly outside, the character’s more traditional mythologies. Phillips’ exploration of Arthur Fleck, who is indelibly portrayed by Joaquin Phoenix, is of a man struggling to find his way in Gotham’s fractured society. Longing for any light to shine on him, he tries his hand as a stand-up comic, but finds the joke always seems to be on him. Caught in a cyclical existence between apathy and cruelty and, ultimately, betrayal, Arthur makes one bad decision after another that brings about a chain reaction of escalating events in this gritty, allegorical character study.

Craig Watkins The University of Texas at Austin, Department of Radio-Television-Film Introduction: Young People, Games, and Learning The growing presence of games in the lives of young people creates perils and possibilities. Games have been a constant source of criticism and alarm among parents, researchers, child advocacy groups, and elected officials. The potential harmful effects of gaming have been linked to society’s understandable concerns about the increasingly sedentary lifestyles of youth and childhood obesity, addiction, gender socialization, poor academic performance, and aggressive behavior.1 An area of growing concern is the role of games in the learning experiences and environments of youth.2 While there is growing consensus that learning takes place in games, the question we ask is: “What kinds of learning?” In this chapter we shift the focus on youth, learning, and video games generally to consider the extremely significant but often overlooked matter of race. Proposed Class Addressed Proposed Class 23: Abandoned Software—video games requiring server communication Literary works in the form of computer programs, where circumvention is undertaken for the purpose of restoring access to single-player or multiplayer video gaming on consoles, personal computers or personal handheld gaming devices when the developer and its agents have ceased to support such gaming. We propose an exemption to 17 U.S.C. § 1201(a)(1) for users who wish to modify lawfully acquired copies of computer programs for the purpose of continuing to play videogames that are no longer supported by the developer, and that require communication with a server.
