JOINT RESOLUTION NO. 202

1 A JOINT RESOLUTION TO AMEND CHAPTER 2234, LAWS OF 2012, TO 2 REVISE THE COMPOSITION OF STATE SENATE DISTRICTS 13 3 AND 22; AND FOR RELATED PURPOSES. 4 WHEREAS, the United States District Court for the Southern 5 District of Mississippi ruled that Mississippi State Senate 6 District 22 as currently configured diluted the voting strength of

7 African-Americans and entered a final judgment to this effect; and 8 WHEREAS, in the case of Joseph Thomas, et al. v. , 9 et al., No. 19-60133 (5th Cir. Mar. 15, 2019), a panel of the 10 United States Court of Appeals for the Fifth Circuit ruled on the 11 defendant's motion for a stay and the motion for a stay was 12 granted in part and denied in part; and 13 WHEREAS, a majority of the panel concluded that the

14 Legislature should be afforded an opportunity to fix the vote 15 dilution found by the district court; and 16 WHEREAS, a stay was entered for that purpose until April 3, 17 2019, and the candidate deadline for any districts whose lines are 18 redrawn was extended to April 12, 2019:

It is also intended that such districts contain all the 492 inhabitants in this state. It is further intended that the

493 redistricting provided for in this resolution result in the 494 creation of districts which are substantially equal in population. 495 It is also intended that no district shall include any of the area 496 included within the description of any other district. 497 BE IT FURTHER RESOLVED, That if the districts described in 498 this resolution do not carry out the purposes thereof, because of 499 unintentional omissions; duplications; overlapping areas;

500 erroneous nomenclature; lack of adequate maps or descriptions of 501 political subdivisions, wards or other divisions thereof, or of 502 their boundary lines, then the Secretary of State, at the request 503 of the Chair of the Senate Elections Committee shall, by order, 504 correct such omissions, overlaps, erroneous nomenclature or other

505 defects in the description of districts so as to accomplish the 506 purposes and objectives of this resolution.

507 BE IT FURTHER RESOLVED, That in promulgating such orders, the 508 Secretary of State, in addition to achieving equality in the 509 population of districts and insuring that all areas of the state 510 are completely and accurately encompassed in such districts, shall 511 be guided by the following standards:

514 resolution and the map of the Senate Districts developed * * * in 515 conjunction with the adopted redistricting plan, the map shall 516 control; however, in instances in which the map is inconclusive, 517 the criteria set out in paragraphs (b) through (f) shall control

518 the resolution of any dispute or issue regarding the composition 519 of any Senate District; 520 (b) Gaps in the description of any district shall be 521 completed in a manner which results in a total description of that 522 district in a manner which is consonant with the description of 523 adjacent districts and results in complete contiguity of 524 districts;

525 (c) Areas of the state included within the descriptions 526 of more than one (1) district shall be allocated to the district 527 having the lowest population; 528 (d) Areas of the state not included within the 529 descriptions of any district shall be allocated to the adjacent

530 district having the lowest population; 531 (e) In the event that the area subject to corrected

532 description or allocation as provided in paragraphs (b), (c) and 533 (d) of this clause is of such size or contains such population 534 that its inclusion as a unit in any district would result in 535 substantial disparity in the size, shape or population of such

542 division of political subdivisions. 543 BE IT FURTHER RESOLVED, That copies of such orders shall be 544 filed by the Secretary of State in his own office and in the 545 offices of the affected commissioners of election and registrars. 546 The Secretary of State may adopt reasonable rules regulating the 547 procedure for applications for orders under this resolution in the 548 manner of serving and filing any notice or copy of orders relating

549 thereto. Upon the filing of such an order, the description of any 550 affected district shall be deemed to have been corrected in the 551 manner provided in such order to the full extent as if such 552 correction had been contained in the original description set 553 forth in this resolution.

554 BE IT FURTHER RESOLVED, That, except as otherwise provided in 555 this resolution, the Standing Joint Legislative Committee on

556 Reapportionment is directed to provide all information necessary 557 to assist the counties in identifying the boundaries of the 558 districts described in this resolution. 559 BE IT FURTHER RESOLVED, That the staff of the Standing Joint 560 Legislative Committee on Reapportionment is directed to provide

567 Joseph Thomas, et al. v. Phil Bryant, et al., No. 19-60133 (5th 568 Cir. Mar. 15, 2019). 569 BE IT FURTHER RESOLVED, That the redistricting contained in 570 this resolution shall supersede any prior redistricting, and any 571 prior redistricting shall be null and void upon the date this 572 resolution is effectuated. 573 BE IT FURTHER RESOLVED, That this resolution shall be placed
