Ni jedan dio mojega rada nije napisan na nedopušten način, odnosno nije prepisan iz necitiranih radova i ne krši bilo čija autorska prava. Sažetak: Razvoj informatičkog društva dovodi do stvaranja novih organizacijskih vrijednosti u kojima informacije postaju neophodne za sve vrste poslova i aktivnosti čovjeka poput trgovine, obrazovanja, znanosti, demokracije, slobode i brojnih drugih. Informacije omogućuju ostvarenje pojedinca kroz niz aktivnosti uz vještine informacijske pismenosti i kritičkog mišljenja. Nadalje, želi se ukazati na ograničenja pri upotrebi informacija kojima se nastoji ograničiti pravo svakog pojedinca na slobodan pristup informacijama te se prikazuju primjeri takvih ishoda. U radu će prikazati na koji se način pojedinac ili grupa može izboriti za informacije koje su im onemogućene, a sastavni su dio njegova prava da im pristupi i da ih koristi. U ovom radu osvijetlit će se problem uskraćivanja informacija u znanosti i visokom obrazovanju te ispitati kakvu ulogu u tome imaju knjižnice. Uvod Informacijske i komunikacijske tehnologije su već dugo implementirane u svakodnevni društveni i ekonomski život čovjeka. One oblikuju naše društvo koje nazivamo globalno, umreženo društvo ili društvo znanja. Kao nova paradigma koja je nastala sredinom 20. stoljeća uvela je brojne promjene u gospodarsko i društvenom kontekstu. Očekivanja nove paradigme vezana su uz bolji pristup informacijama, napredak društva, produktivnosti rada i dobrobiti društva. S obzirom na takva poticajna očekivanja vezana uz informatičku revoluciju i razvoj modernog, umreženog društva središnja tema rada vezana je uz problem informacije kao glavne značajke razvoja takvog društva i globalne informacijske infrastrukture. Na početku rada u poglavljima „Informacijsko društvo“ i „Informacije u umreženom društvu“, osvjetljava se činjenica da takozvano društvo znanja koje je svakodnevno okruženo velikim brojem informacija ne mora nužno biti dobro informirano. Problemi s kojima se svakodnevno susrećemo su pristup i regulacija informacija. Premda razvoj tehnologije uistinu pospješuje svakodnevni život pojedinca i doprinosi društvenom, ekonomskom, političkom, kulturnom i obrazovnom životu ostavlja se pitanje kako će se dalje razvijati današnje društvo ako se ne ostvaruje glavne njegove značajke poput distribucije i korištenja informacija. Također, želi se ukazati na ograničenja pri upotrebi informacija kojima se nastoji ograničiti pravo svakog pojedinca na slobodan pristup informacijama te se prikazuju primjeri takvih ishoda. Više o tome govorit će se u poglavlju „Paradoks prava na slobodan pristup informacijama“ , a u poglavlju „Znanstveno izdavaštvo“ detaljnije će se pojasniti problem nedostupnosti i regulacije informacijama u znanosti. Spomenuti će se knjižnica i njena uloga u zaštiti i pružanju informacija u umreženom društvu uz primjere dobre prakse. Zatim će se govoriti o Otvorenom pristupu u Hrvatskoj i izazovima s kojima se susrećemo. Na kraju teorijskog dijela pojasnit će se na koji način je moguće suprotstavljanje manipuliranju i uskraćivanju informacija, a posljednje poglavlje posvećeno je borcima za slobodu informacija i njihovim doprinosima u društvu. Nakon teorijskog dijela slijedi prikaz istraživanja koje je provedeno putem on-line ankete u kojoj smo ispitali odnos i mišljenje studenata o regulaciji i pristupu informacijama u umreženom društvu. 1 2. Informatička revolucija Posljednja dva desetljeća 20. stoljeća razdoblje je novih radikalnih promjena, nove društvene i tehnološke paradigme. Izuzetno je važno reći kako je ono obilježeno informatičkom revolucijom koja je unijela promjene u gospodarsko i društveno okruženje. Proces kao što je to informatička revolucija počeo se širiti obuhvaćajući tako sva područja ljudskog djelovanja poput industrije, medicine, menadžmenta, medija i drugih. It may have been true in the early years of Google Scholar but is this still through twelve years after? Is this sufficient to ignore it totally either in our information literacy programs or evaluate its value against the values of subscription-based abstracts and indexes? In this era of severe budget constraints that libraries are facing, can we imagine of substituting most or all of our subject databases with the free access of Google Scholar for discoverability? How much overlap between our databases and Google Scholar? How reliable is Google Scholar? How stable is its content over time? Open Access is getting to be the predominant form of getting access to peer reviewed articles. Many new non-traditional tools (institutional repositories, social media and peer to peer sites) are available out there to retrieve the full-text of peer reviewed articles.

    Shadow Libraries and You: Sci-Hub Usage and the Future of ILL Gabriel J. Gardner, Stephen R. McLaughlin, and Andrew D. Asher* Scholars have shared copyrighted material outside official channels for decades, but recent market forces, profes- sional pressure, and novel technical exploits have allowed the large-scale automation of these practices. As a re- sult, millions of scholarly articles, chapters, books, and papers have been aggregated in illicit collections known as “shadow libraries,”1 available for free download by anyone with an Internet connection. The best-known shadow libraries are Library Genesis (LibGen) and the associated website Sci-Hub, which uses pooled university credentials to access articles and add them to LibGen’s repository. AvaxHome and the defunct website Library. nu are two others, with numerous smaller collections scattered across the web. Since Elsevier, in June 2015, filed a civil suit against Sci-Hub, its creator Alexandra Elbakyan, LibGen, and several John Does associated with LibGen,2 many articles and opinion pieces have been published on the role and possible effects of shadow libraries in the scholarly communication ecosystem. Though they clearly violate U.S. copyright law, many scholars are quick to offer praise rather than condemnation for the site. Sci-Hub is easy to use, offering simple and fast access to full-text articles in PDF format in a manner more straightforward than many library or publisher websites. To date, however, only a few scholars have examined the phenomenon em- pirically. There is a dearth of information on questions such as whether shadow libraries will reduce publishers’ revenues and disrupt the scholarly publishing industry, and whether they are affecting academic library usage or decreasing the use of interlibrary loan.

    Walking the Plank: How Scholarly Piracy Affects Publishers, Libraries and Their Users Laurie Morrison, Carol Stephenson, and Elizabeth Yates* Introduction The arrival of technology supporting peer-to-peer (P2P) file sharing in scholarly communication has, until -re cently, had minimal impact on libraries. However, threats posed by pirate sites including Library Genesis Project (LibGen) and Sci-Hub are now impacting both library users and library licensing agreements with publishers. Publishers are nervous as they witness their proprietary content leaking out of paywalled systems—not just hundreds of thousands of articles, but millions. Accordingly, publishers are monitoring activities in licensed products very closely for any behavior that they deem suspicious. When a user’s activities cause a publisher to question whether materials are being pirated, the outcomes can vary. Consequences can range from relatively minor inconvenience for blocked users, who must find workarounds to access scholarly content—to the poten- tial for major disruption of a centuries-old proprietary publishing system. This article uses a case study involving a student at Brock University to highlight significant challenges facing libraries and the rights of their users in the current environment of piracy-wary academic publishers. Case Study: Access Denied “I feel like I’m being penalized for my honesty.” That’s how a graduate student at Brock University felt in January 2016, after her legitimate quest to download several hundred articles for a meta-analysis project turned into a protracted—and ultimately unsuccessful—negotiation with the American Psychological Association. By most accounts, the first digital library was Project Gutenberg, which began making public domain works available in 1971 via the Arpanet, the predecessor of the Internet. As computing and network technolo- gies improved in the 1980s and 1990s, the technical obstacles and cost of building digital libraries declined rapidly. The dream of a universal library (Battles 2004; Borges 1998; Bush 1945; Rieusset-Lemarié 1997) began to seem very real. Legal obstacles were another matter. As projects became larger and more visible, they became more vulner- able to copyright challenges in the poorly charted areas around digitization, archiving, and fair use.     In solidarity with Library Genesis and Sci-Hub In Antoine de Saint Exupéry's tale the Little Prince meets a businessman who accumulates stars with the sole purpose of being able to buy more stars. The Little Prince is perplexed. He owns only a flower, which he waters every day. Three volcanoes, which he cleans every week. "It is of some use to my volcanoes, and it is of some use to my flower, that I own them," he says, "but you are of no use to the stars that you own". There are many businessmen who own knowledge today. Consider Elsevier, the largest scholarly publisher, whose 37% profit margin1 stands in sharp contrast to the rising fees, expanding student loan debt and poverty-level wages for adjunct faculty. Elsevier owns some of the largest databases of academic material, which are licensed at prices so scandalously high that even Harvard, the richest university of the global north, has complained that it cannot afford them any longer. Robert Darnton, the past director of Harvard Library, says "We faculty do the research, write the papers, referee papers by other researchers, serve on editorial boards, all of it for free … and then we buy back the results of our labour at outrageous prices."2 For all the work supported by public money benefiting scholarly publishers, particularly the peer review that grounds their legitimacy, journal articles are priced such that they prohibit access to science to many academics - and all non- academics - across the world, and render it a token of privilege.3 Elsevier has recently filed a copyright infringement suit in New York against Science Hub and Library Genesis claiming millions of dollars in damages.4 This has come as a big blow, not just to the administrators of the websites but also to thousands of researchers around the world for whom these sites are the only viable source of academic materials.

Alongside these controversies the literature on IP's various facets continues to grow and is increasingly multi-disciplinary. At the same time, the decisions that information professionals, R&D personnel and artists have to face in their working lives are increasingly tied to legal concerns. The course is intended to deal with these issues from a number of different perspectives, specifically considering cultural, political, legal, but also economical aspects, including those relevant outside a Western context. It will provide an overview of the legal situation in a national, European, and international setting. Participants will gain an understanding of the various forms of IP (copyright, patent, trademark, etc.) and expanding or antagonistic concepts including the creative commons, open access, open source, and piracy. In this era of severe budget constraints and economic recessions that libraries are facing, can we imagine of substituting some or most of our journal collection funds with the “open and free access” that Sci-Hub and LibGen is giving us? How much overlap between our collections and what is available through Sci-Hub and LibGen? This article reports on preliminary results1 of a one year study with Sci-Hub, LibGen and of Google Scholar (GS) where 2,750 random samples (peer reviewed journal articles) coming from fifty-five different databases covering all disciplines (Arts & Humanities, Law, Music, Social Sciences and STM) were tested against those platforms.
