Chairman Inman opened the meeting by inviting the citizens in attendance to join the Board with the Pledge of Allegiance.

Chairman Inman entertained a motion to approve or amend the agenda for the

July 9, 2007 meeting.

County Manager Bryan Steen requested (at the request of Support Services Supervisor

Danny Stovall) to move Item D- (Discussion Agenda)”Sale of Surplus Tax Foreclosed

Property” to the Action Agenda in order to expedite the upset bid process if approved by the

Board. This would eliminate interest and penalties to be incurred in the month of August.

Commissioner Lankford requested to leave the item on the Discussion Agenda in order to discuss other possible options for the property.

The Board unanimously agreed to leave Item D on the Discussion Agenda.

Chairman Inman entertained a motion to approve the July 9th agenda.

Commissioner Lankford moved to approve the July 9th agenda. Vice Chairman Walker seconded and the motion carried unanimously.

PUBLIC COMMENTS

Jack Gibson 345 Springdale Road Walnut Cove, NC 27052 Re: Thank You For Not Raising Property Taxes

Mr. Gibson expressed his appreciation to the Board of Commissioners for a job well done during the recent adoption of the 2007-08 Budget and also commended the Board for their dedication of public service to Stokes County. Mr. Gibson thanked Commissioner Lankford, Vice Chairman Walker, and Chairman Inman for adopting a budget that matches revenue. Mr. Gibson concluded by also thanking dedicated County employees for their efforts to control spending.

This budget amendment is justified as follows: To transfer funds for the appointment of the Tax Administrator and the combination of the GIS/Mapping Department and Tax Administration Department. Per Board of County Commissioners’ approval at the June 25, 2007 regular meeting.

Stokes County Mental Health/Stokes County Emergency Responders Work Group – Proposal - Mental Health Issues in Stokes County

Chairman Keith Merritt – Stokes County Mental Health Association read the following message from Stokes County Mental Health Association and Stokes County

Emergency Responders Work Group to the Board:

In March 2007 the Stokes County Mental Health Association and the Emergency Responders made presentations to the County Commissioners making clear their dedication to and concern for the state of mental health/substance abuse service provision in Stokes County. Representatives from the 2 organizations agreed to create a collaborative work group, the focus of which would be to develop recommendations for the allocation of funds received by the county in February ($200,000.00) from Centerpoint Human Services. This work group had representation from agencies across the county, and met on 3 occasions between April and May. Minutes from each meeting, as well as attendance rosters are included in your agenda packet. Also included are tables and graphs of relevant statistics.

The overwhelming consensus of this work group was that, in order for Stokes county residents to access and obtain Mental Health and Substance Abuse services in the current system, the county must have local coordination with and visibility to the Local Management Entity and to the service providers. This must come from a person, or persons, who have understanding of Stokes County's needs, culture, and citizens. At the County Commissioners' Candidates' Forum last October, a representative from North Carolina Mental Health Association stated that mental health and substance abuse treatment is no longer primarily a state or federal responsibility-rather it is becoming a county, and community responsibility. Since this indeed seems to be the case, local knowledge, local care and concern, and local commitment to our county are the vision that the work group would like to see accomplished.

The Emergency Responders and Stokes County Mental Health Association will continue meeting collaboratively, and stand ready to consult/discuss ways and means for implementation of any or all of these recommendations, or others that may arise. We are committed to an active role in helping Stokes County obtain the best possible services for our residents who have mental health, substance abuse and developmental disability Issues.

Chairman Merritt discussed the following recommendations:

Emergency Responders/Stokes County Mental Health Association Work Group Recommendations

 HIRE a Mental Health Service Coordinator to serve as a local referral source (593#) for consumers, potential consumers, service providers, LME, emergency rooms, EMS, the sheriff and police department and general public

Licensed (LPC, LCSW, LMFT)

Under the County Manager, DSS, or Health Department

Coordinator's Role would include ....

 Grant Writing-conduct grant searches, apply for and obtain grant funding for Mental Health and Substance Abuse Services and sustainability of the Coordinator Position

July 9, 2007 5  Determine the Availability of Mental Health Services and how to access (include insurance issues, state and federal funding issues)

 Review current transportation availability and make recommendations for ongoing transportation services

 Partnership Building with all involved parties to determine service gaps and ongoing need to obtain the services the County needs

 Coordinate public awareness campaign to reduce stigma for those in need of services

 Conduct a needs assessment and maintain Mental Health Statistics for Stokes County

 PURSUE the possibility of Baptist Medical Center and/or Stokes-Reynolds Memorial Hospital providing crisis beds within the county

o Need determined by needs assessment

o Issues--structural facilities requirements, staffing and cost

 ALLOCATE dollars for some adult substance abuse treatment services and/or Mental Health Services

o Possible "scholarships" or direct payment to service provider

o Medication assistance

 FUND a coordinated, comprehensive public awareness campaign, to be developed by the Mental Health Services Coordinator, and the Emergency Responders and Stokes County Mental Health Association Work Group

Chairman Merritt presented information regarding a 45 hour stay at a hospital for a commitment which involved County Deputies having to wait for the commitment and the need to have available beds in Stokes County perhaps using Stokes Reynolds Memorial

Hospital.

Chairman Merritt noted the need for public awareness, letting Stokes County citizens know that there is help if needed – possibly using billboards in the County.

Chairman Merritt noted the number #1 recommendation from both groups:

 Hire a mental health coordinator to serve as a local referral source for consumers, service providers, LME, emergency rooms, EMS, Sheriff and Police Departments, and general public

July 9, 2007 6 The following attendees presented information to the Board:

Doris Hill – Stokes County Mental Health Association

 Fun Day for individuals/families with mental illness issues to be held on September 7th at Central Park in King (10:00am to 3:00pm)  Fun Day is sponsored by Stokes County Mental Health in conjunction with Forsyth, Yadkin, Surry, and Iredell Mental Health Associations  Expressed concerns regarding the 1-800 number at CenterPoint – at times too complicated for the patient  Providers are not getting out to the doctors in the County –informing them of the services that are available  The need for a Coordinator to serve as a local referral source for consumers, LME, emergency services personnel, etc.  Certain mental health services that are desperately needed in the County are not available

Scott Morton – Licensed Therapist (part time in Stokes County)

 No full time therapist in Stokes County  No adult substance services available in Stokes County unless the individual has private insurance  Unless you have private insurance or Medicaid, you can’t obtain any services from Triumph or Daymark  Stokes County needs to make a move for their own people –cannot leave the welfare of the citizens to a LME  Paperwork is ridiculous – first time consumer – numerous pages of paperwork to complete

Angie Cullen – Healthy Carolinians

 Need for a Coordinator who lives and cares about Stokes County and its citizens  Need for a Coordinator to pull all services together  Need for a Coordinator to handle daily issues and emergencies  Need for a survey to determine the mental health needs of Stokes County citizens

The Board expressed their appreciation for the efforts from both groups and for their time and dedication.

Commissioner Carroll reiterated the need for a local referral source in Stokes County and the need for bed space at Stokes Reynolds Memorial Hospital.

July 9, 2007 7 Commissioner Lankford expressed concerns regarding those in need not being able to get assistance from the 1-800 CenterPoint number and also noted the need for public awareness and available beds for Stokes County citizens.

Vice Chairman Walker requested information about where the County is currently at regarding mental health services, the need for mental health services for Stokes County citizens, and the need for a plan to get to where the County needs to be.

Commissioner Smith expressed the need for direction (a plan) in order to better serve the citizens of Stokes County.

Chairman Inman reiterated the need to take care of Stokes County citizens, to provide the best mental health services as possible, and the time to assess the funding being appropriated for mental health services.

Chairman Merritt reiterated the need for Stokes County to make serious changes regarding mental health services with Stokes County dollars and both groups would be happy to continue to work with the Board regarding mental health issues in Stokes County.

Chairman Inman concluded that the Board would consider the recommendations regarding the recent $200,000 allocation from CenterPoint for mental health services in Stokes

County.

Proposed Stokes County Aging Planning Committee – Community Dialogue

Chairman Lou Charland, Stokes County Aging Planning Committee, briefed the

Board regarding the upcoming one day “Community Dialogue” to facilitate formulation of a Stokes County Aging Plan.

July 9, 2007 8 Chairman Charland noted the following:

 Request that the Board of Commissioners sanction and support the one-day “Community Dialogue” which will facilitate formulation of a Stokes County Aging Plan  Event to be facilitated by Chris Howell-UNC Cares-School of Social Work- Chapel Hill, NC  Event scheduled for August 8, 2007 at Quaker Gap Baptist Church- Fellowship Hall  Approximately 80 individuals/providers will be invited to attend  Brainstorming session/breakout session to determine what Stokes County currently has and what Stokes County will need in the future  Selection of the top 5 crucial needs and develop plans to provide those needs  Stokes County Aging Planning Committee will work to accomplish the top 5 crucial needs  Request for one time allocation of $500

The Board discussed the request from the Stokes County Aging Planning Committee regarding support of the “Community Dialogue” and the $500 funding request.

The Board unanimously agreed to fund the one time $500 allocation and requested the

County Manager return to the Board with funding options for the one time $500 allocation.

YVEDDI Grant

County Manager Bryan Steen presented the following information to the Board regarding the Proposed YVEDDI Facility/County Garage:

 Met with Nancy Painter-NCDOT-Financial Management and Mike Kozak- NCDOT-Assistant Director – Public Transportation Division along with Executive Director JoAnn Larkins and Transportation Coordinator Charlie Walker –YVEDDI on Thursday, June 21, 2007 to discuss the proposed facility project  NCDOT noted that the Grant which had been awarded in 2003 had lapsed and funding is no longer available  A needs assessment/feasibility study will have to be completed to meet federal and state planning requirements for any new facility project  Public Transportation Division would participate in this study at a ratio of 90% while requiring YVEDDI and/or Stokes County to participate with a 10% local match  If Stokes County is interested in using part of the building, it would be as a shared or pro-rated cost – any part of the building that would be dedicated and used by the County, would have to be paid for by the County

July 9, 2007 9  Public Transportation Division will only participate in the cost that is determined necessary by the feasibility study for YVEDDI’s transit needs  A joint building project is still possible with YVEDDI as long as the layout clearly delineates the portions of the building and site sets aside for each one’s function  The 2-acre site recently deeded to YVEDDI for in kind match could not be used for in-kind match unless the entire building on the land is dedicated to YVEDDI Transit  If Stokes County shares the site, the land value would have to be pro-rated and not all of it could be applied as in-kind match  NCDOT officials were surprised that part of the proposed facility project was being designed for a Stokes County Garage – NCDOT’s first notification that YVEDDI would be sharing the facility with the County was June 21, 2007  If the County is interested in a joint venture with YVEDDI, the assessment would have to be done first

Manager Steen requested direction from the Board regarding their desire to proceed or not proceed with a new transportation grant.

Chairman Inman expressed interest in having the County Attorney start the legal process regarding transferring the property back to Stokes County. (Deed has a reversion clause that states the property reverts back to the County if there is no YVEDDI facility located on the site).

Vice Chairman Walker noted the following information received at the YVEDDI meeting last week: (Charlie Walker – Transportation Coordinator for YVEDDI was not present at the YVEDDI meeting)

 Everything including the plans are on go, but that there are a few extra hurdles to conquer  Different explanation given by Executive Director JoAnn Larkin at the YVEDDI meeting regarding the status of the grant  Funding is still available  Possibly different guidelines regarding the grant  Per YVEDDI, State officials have changed since funding was awarded in 2003 and YVEDDI thought that everything would proceed with a few extra steps  YVEDDI wants to work with the County on the joint venture

July 9, 2007 10 Vice Chairman Walker requested that Charlie Walker be at the next meeting to discuss the grant.

Commissioner Lankford noted that Charlie Walker –YVEDDI had personally quoted to the Board at a previous meeting that the building would be started and projected to be done by

June 30th. Commissioner Lankford also noted that services had been offered to YVEDDI by the County to help with the proposed project.

Commissioner Carroll noted that the letter from the Nancy Painter-NCDOT clearly states that funding no longer exists. Public Transportation Funding can’t be used for a

County facility, and the need for an assessment of the County’s current maintenance facility.

Commissioner Smith reiterated that the County had provided services and had offered additional county services in order to expedite the project.

Vice Chairman Walker noted the need for additional information regarding the issue before making any further decision regarding any future ventures with YVEDDI.

The Board discussed the information provided by County Manager Steen, possibly meeting with YVEDDI staff to discuss the issue, reversion clause in the Deed, and the direction the Board needs to take from this point.

Chairman Inman requested information from Clerk to the Board Darlene Bullins (who worked on the project while serving as Interim County Manager) regarding a request to Charlie

Walker for County staff to speak to NCDOT Transportation Officials in Raleigh.

Clerk to the Board Bullins noted that the County had offered several times to contact

NCDOT officials by phone or to go to Raleigh with Charlie Walker to discuss the hold up of the project and if there was anything the County could do to assist Mr. Walker pertaining to the proposed project.

July 9, 2007 11 Charlie Walker –YVEDDI - told County staff that the County should not call

Raleigh regarding the YVEDDI project, it could cause issues.

Consensus of the Board directed the County Manager to talk with YVEDDI regarding the current proposal, and to see if YVEDDI had an alternate plan.

Vice Chairman Walker volunteered to speak to YVEDDI officials regarding the information received by the County, the status of current grant, and any information regarding future grants.

The Board unanimously agreed for Vice Chairman Walker to speak with YVEDDI regarding the noted concerns and report back to the Board.

Chairman Inman directed the Clerk to place the item on the Action Agenda.

Sale of Surplus Tax Foreclosed Property

County Manager Bryan Steen presented the following bids received on July 2, 2007 from William West (Support Services Supervisor Danny Stovall absent) regarding the following surplus tax foreclosed County parcels:

 The above bid amounts are equal to the outstanding amount on each parcel as of July 2, 2007  Sale of these properties will be conducted in accordance with NC General Statutes 105-376, 153A-176 and 160A-269  Additional interest will accrue on each parcel on August 1, 2007

Commissioner Lankford expressed concerns regarding the value of the land versus the bid received for the parcel. Commissioner Lankford questioned if the County had any other options to sell or obtain the parcels.

July 9, 2007 12 County Attorney Edward Powell noted further investigation would need to be done to determine the legal issues.

The Board discussed the bids received from William West.

Chairman Inman entertained a motion to table the Item until the next meeting for further discussion.

Commissioner Lankford moved to table the Item until the next meeting (July 23rd) to discuss options with Attorney Powell and Mr. Stovall. Commissioner Carroll seconded and the motion carried unanimously.

Chairman Inman directed the Clerk to place the item on the Action Agenda for the next meeting.

District Committee Discussion

County Attorney Edward Powell presented the following information (as requested by the Board) regarding the options for a District System in Stokes County:

With regard to the discussion of whether the County may be divided into electoral districts for purposes of nominating and/or electing members of the Board of Commissioners, there are several statutes that govern the method of implementation of districts.

G. S. 153A-58 states that the Board may use several options for nominating and electing the members:

a. The qualified voters of the entire county shall nominate and elect all candidates for the board.

Or the county can be divided into electoral districts, and board members apportioned to the districts so that the quotients obtained by dividing the population of each district by the number of commissioners apportioned to the district are as nearly equal as possible, and the following three options are available:

b. The qualified voters of each district shall nominate candidates an elect members who reside in the district for seats apportioned to the district, and the qualified voters of the county shall nominate

July 9, 2007 13 candidates and elect members apportioned to the county at large, if any.

c. The qualified voters of each district shall nominate candidates who reside in the district for seats apportioned to that district, and the qualified voters of the entire county shall nominate candidates for seats apportioned to the county at large, if any, and the qualified voters of the entire county shall elect all members of the board.

d. Members shall reside in and represent the districts according to the apportionment plan adopted, but the qualified voters of the entire county shall nominate all candidates for and elect all members of the board.

If options b, c, or d are adopted, the board shall divide the county into the requisite number of electoral districts according to the apportionment plan adopted, and cause a delineation of the districts so laid out to be drawn up and filed as required by G. S. 153A-20, and no more than half of the board may be apportioned to the county at large.

Also, the statute provides that the Chairman of the Board may be selected from the membership of the Board by the members for a one year term, or the chairmanship may be a separate office where the qualified voters of the entire county nominate candidates for and elect the chairman for a two or four year term.

G. S. 153A-60 provides that the Board of Commissioners shall initiate any alteration in the structure of the board by adopting a resolution that shall state the following:

1. The proposed alterations.

2. Prescribe the manner of transition from the existing structure to the altered structure.

3. Define the electoral districts, if any, and apportion the members among the districts.

4. Call a special referendum on the question of adoption of the alterations, which may be held at the same time of other primary, general or special elections.

Upon adoption, the resolution shall be published in full.

G. S. 153A-61 provides for the method of submission of the proposition to the voters, and G. S. 153A-62 provides for the effective date for the alteration. G. S. 153A63 provides that a copy of the resolution must be filed in the County ordinance book. G. S. 153A-22 provides that the Board of Commissioners may redefine the

July 9, 2007 14 electoral district boundaries by resolution if they find as a fact there is a substantial inequality of population among the districts. This statute also provides that it does not apply to counties where the electoral districts are for residence purposes only such as in G. S. 153A-58 (3)(d) where the members must reside in the district, but are nominated and elected by all the voters of the county.

There have been numerous decisions by the state and federal courts that require that all electoral districts be substantially equal in population, and the Board must comply with these in deciding on any electoral districts they may want to create.

The Board discussed the information provided by Attorney Powell.

The Board agreed to invite District Committee Members to the July 23rd meeting to discuss the Committee’s responsibilities – Discussion Agenda.

GENERAL GOVERNMENT – GOVERNING BODY – ACTION AGENDA

Resolution Authorizing Incentives Contract with KobeWieland Copper Products, LLC:

Chairman Inman presented the proposed Resolution Authorizing Incentives Contract with KobeWieland Copper Products, LLC:

Resolution Authorizing Incentives Contract with KobeWieland Copper Products, LLC

WHEREAS, North Carolina General Statute 158-7.1 authorizes a county to undertake an economic development project by extending assistance to a company in order to cause the company to locate or expand its operations within the county; and

WHEREAS, the Board of Commissioners of Stokes County has held a public hearing to consider whether to participate in an economic development project with KobeWieland Copper Products, LLC, by reimbursing KobeWieland Copper Products, LLC for the cost of machinery and equipment to be installed at its facility in Stokes County; and

WHEREAS, KobeWieland Copper Products, LLC, will purchase and install machinery and equipment, making an investment of at least $71,000,000.00 and creating at least 65 new, permanent jobs in Stokes County; and

WHEREAS, the Board of Commissioners of Stokes County has adopted an amendment to the County's budget ordinance appropriating the funds necessary to the project;

July 9, 2007 15 THE BOARD OF COMMISSIONERS OF STOKES COUNTY THEREFORE RESOLVES THAT:

1. The County is authorized to expend up to $1,600,000.00 ($320,000.00 per year for 5 years) of county funds for the KobeWieland Copper Products, LLC project.

2. The attached contract between the County and KobeWieland Copper Products, LLC is approved.

3. The Chairman of the Board of Commissioners is authorized to execute the contract and any other documents necessary to the project on behalf of the County.

Chairman Inman entertained a motion regarding the proposed Resolution Authorizing

Incentives Contract with KobeWieland Copper Products, LLC:

Commissioner Lankford moved to approve the submitted proposed Resolution

Authorizing Incentives Contract with KobeWieland Copper Products, LLC. Commissioner

Smith seconded and the motion carried unanimously.

Commissioner Carroll noted that this funding is not funding that will be taken away from other projects, this is an actual partial rebate of the additional taxes being paid by

KobeWieland Copper regarding the renovations for only 5 years.

July 9, 2007 16 Tax Administration Procedures – Fiscal Year 2006-07 and Fiscal Year 2007-08

Tax Administrator Jake Oakley submitted the Tax Collection Status Report for fiscal year 2006-07.

Vice Chairman Walker requested information regarding procedures currently being performed by the Tax Administration Office for the collection of delinquent EMS bills.

Vice Chairman Walker noted that there had been concerns previously expressed by Board members regarding delinquent EMS bills being turned over to the Tax Department for collection.

July 9, 2007 18 County Manager Steen noted the following information from the County Attorney:

 The County can stop the current procedure of delinquent EMS bills being turned over the Tax Department for collection, but must have an equal procedure of collection in place  Delinquent EMS bills that have been turned over to the Tax Department must stay with the Tax Department until collected  Majority of the older delinquent EMS bills have been collected  Outside collection agencies would receive a percentage of the collection

Vice Chairman Walker requested the County look into other means for collecting delinquent EMS bills.

The Board discussed liens being placed on real property due to unpaid EMS bills, garnishment of wages due to EMS bills, and other options.

The Board unanimously agreed to direct the County Manager to research other options regarding the collection of delinquent EMS bills other than the bills being turned over to the

Tax Department.

Tax Administrator Oakley noted that no liens have been placed on real property regarding a delinquent EMS bill.

Tax Administrator Oakley reported that the following real property taxes levied for the year 2006, remain uncollected and the Tax Administrator/Collector has made diligent efforts to collect said taxes by use of remedies as provided by law in the Machinery Act of North

Tax Administrator Oakley noted that in every instance in which the Tax

Administrator/Collector has been able to discover through diligent inquiry the existence of property belonging to delinquent taxpayers within other taxing units in NC, the undersigned has proceeded under the provision of G.S. 105-364. Tax Administrator Oakley noted that these unpaid personal property taxes can be advertised in the local paper. Tax Administrator Oakley recommended not advertising the unpaid personal property taxes due to the cost of advertising.

Tax Administrator Oakley requested that the list be settled by the Board as taxes not collected for the 2006 tax year, be added to the Board of Commissioners’ minutes, and be credited to the Tax Administrator.

The Board discussed advertising the unpaid personal property taxes. The Board unanimously agreed to not advertise the unpaid personal property taxes.

Chairman Inman entertained a motion for settlement of 2006 unpaid taxes as presented by the Tax Administrator, the unpaid real and personal taxes be recorded in the Board of

Commissioners’ minutes, and be credited to the Tax Administrator.

Commissioner Carroll moved to approve the settlement of 2006 unpaid taxes as presented by the Tax Administrator, the unpaid real and personal taxes be recorded in the

Board of Commissioners’ minutes, and be credited to the Tax Administrator. Commissioner

Lankford seconded and the motion carried unanimously.

Tax Administrator Jake Oakley presented the following proposed Resolution per

G.S. 105-373 which provides for an annual settlement of the property taxes charged to the

Tax Collector:

WHEREAS, Section 105-373 of the North Carolina General Statutes provides for an annual settlement of the property taxes charged to the Tax Collector; and

WHEREAS, that, in keeping with this requirement, the attached settlement summary was provided to the Stokes County Board of Commissioners by the Stokes County Tax Administrator, Jake M. Oakley;

NOW, THEREFORE, be it resolved that the Stokes County Board of Commissioners:

(1) Orders the insolvent amount for 2006 be entered into the minutes as the accepted insolvent amount, and further, that said insolvent amount be credited to the Stokes County Tax Administrator in his settlement. And;

(2) Orders the tax liens for 2006 property taxes for the purpose of collection to be recharged to the Stokes County Tax Administrator. And further;

(3) Orders that the settlement for delinquent (prior years taxes) be entered into the minutes, and that the uncollected balance of said taxes be recharged to the Stokes County Tax Administrator for the purpose of collection. And finally;

(4) Orders that the 2006 property tax settlement by the Stokes County Tax Administrator be accepted in accordance with Section 105-373(e) of the North Carolina General Statutes.

You are hereby authorized, empowered, and commanded to collect the taxes set forth in the 2007 tax records filed in the Office of the Stokes County Tax Administration, and in the tax bills herewith delivered to you, in the amounts and from the taxpayers likewise set forth. You are further authorized, empowered, and commanded to collect the 2007 taxes charged and assessed as provided by law for adjustments, changes, and additions to the tax records and tax bills delivered to you which are made in accordance with law per G.S. 105-321(b). Such taxes are hereby declared to be a first lien on real property of the respective taxpayers in Stokes County, King Fire District, Rural Hall Fire District, Walnut Cove Fire District, Stokes County Service District, the Town of Walnut Cove, and the Town of Danbury per G.S 105-354. Chairman Inman entertained a motion to approve the Order In Accordance to N.C.G.S.

105-321(b) for the Collection of Fiscal Year 2007-08 Property Taxes.

Commissioner Lankford moved to approve the Order In Accordance to G.S. 105-321(b) for the Collection of Fiscal Year 2007-08 Property Taxes. Commissioner Carroll seconded and the motion carried unanimously.

Tax Administrator Oakley noted that 2007-08 taxes bills are scheduled to be mailed on July 20th in order to allow the taxpayer time to review and take advantage of the

2% discount if paid in August 2007.

Commissioner Lankford requested the appointment of Deputy Tax Collectors follow the closed session. The Board had no issues with holding the agenda item until after closed session.

Chairman Inman entertained a motion to enter into Closed Session for the following:

 To consider the initial employment or appointment of an individual to any office or position, other than a vacancy in the Board of County Commissioners or any other public body, or to consider the qualifications, competence, performance, character, and fitness of any public officer or employee, other than a member of the Board of Commissioners or of some other public body pursuant to G.S. 143-318.11(6)

 To consult with an Attorney employed or retained by the Public Body in Order to preserve the attorney-client privilege between the Attorney and the Public Body, which privilege is hereby acknowledged, and to consider and give instructions to an attorney concerning the handling or settlement of a claim judicial action, mediation, arbitration, or administrative procedure G.S. 143-318.11(3).
