County Council Minutes SUSSEX COUNTY COUNCIL-GEORGETOWN,DELAWARE-MAY 23 , 1972 Call to The regular meeting of the Sussex County Council was held Order on Tuesday, May 23, 1972, at 10:00 a.m., with the follow­ ing members present: Richard L. Timmons, President William B. Chandl e r, Jr., Vice President John L. Briggs, Councilman The meeting was opened with the Pledge of Allegiance and the repeating of the Lord's Prayer. Murchison, Director Re: Tax Comparison Study of Delaware Taxes On file in the Finance Director's office. Seaford-Blades Chamber of Commerce, Inc. Re: Social gathering, May 25, 1972 at the Flagship Leonard The Sheriff will serve a letter to Lenard Drummond, Con­ Drummond stable for Sussex County, notifying him he is suspended from all rights, duties, and privileges in this capacity. Criminal charges have been filed against Mr. Drummond and a full investigation will be made. ( 70) May 23, 1972 Page 2 Mr. Sherwin Mr. Sherwin, Civil Defense Director reported he attended an Air.force Disaster Seminar in Dover on May 22, at the Kent County E.O.C. in regards to what emergency proceedures v to follow i.f a plain crashes which is armed or unarmed. Swan Keys James Sabo, Esquire appeared before the Council on behalf of his client in regards to a trailer park kn0wn as Swan Keys. The developers o.f this trailer park would like to install a central sewage system. The Council suggested that Mr. Sabo work out an agreement with Mr. Henry, County Engineer and prepare a contract between the County and Swan Keys whereby at a later date the system could be taken over by the County subject to technical approval. M 163 72 Motion by Mr. Briggs, seconded by Mr. Chandler, unanimously Civil carried to concur with the following: Defense Employees In accordance with House Bill 677, dated May 1972, as amended by House amendment # 1, the following salaries, Civil Defense employees, will be effective: June 1, 1972 July 1, 1972 Vivian Adams $4,963.00 Mabel Givens 6,992.00 $7,353.00 Walt Sherwin 9,437.00 9,916.00 Richard Clark of the King Acres area appeared before the Council in regards to weeds on vacant lots in this area which need to be cut. Mr. Lee said the County has no authority to enforce such an issue and suggested Mr. Clar~ consult an attorney to see if there is a state code that covers this problem. M 164 72 Motion by Mr. Chandler, seconded by Mr. Briggs, unanimously Certi.fica te '­ carried to extend the $150,000.00 Certificate of Deposit, o.f Deposit Wilmington Trust Company, until June 27, 1972 at an interest , rate of 4~ % and to reinvest $100,000.00 from the General Fund account Wilmington Trust Company for one year at 5~ %. Land.fills Landfills # 3 and # 6 will be opened on Monday, May 29, #3 & #6 from 8 a.m. untill 5 p.m. for the benefit of the beach areas. All other landfills will be closed all day Monday ' but will reppen at 8 ~.m. Tuesday. M 165 72 Motion by Mr. Chandler, seconded by Mr. Briggs, unanimously Landfill carried to renew the contract of Landfill # 4, Anderson #4 Crossroads, with Paynter Sharp for the sum of $30,917.00. for a periodof one year. (71) May 23, 1972 Page 3 Proposed Mr. Henry presented the following: Ordinance #010-72 Revisions of Ordinance No. 005 71, December 14, 1971, Ordinance No. 010-72 (Proposed) An Ordinance to Regulate the Collection, Transportation and Disposal of Solid Wastes and Establish Certain Fees Therefore ~ Public Hearing on ~roposed Ordinance NO. 010-72 will be held on June 27, 1972, l:JO p.m. M 166 72 Motion by Mr. Briggs, seconded by Mr. Chandler, unanimously carried that the Council recess for lunch. The Council reconvened at approximately 1:15 p.m. PUBLIC HEARINGS: C/Z #67 From AR to C-1 lands of Vaughn and Annie Parker and others in Dagsboro Hundred M 167 72 Motion by Mr. Chandler, seconded by Mr. Briggs, unanimously carried to concur with the recommendation of Planning and Zoning Commission and grant approval of this application. C/Z #68 From AR to MR, being lands of Barn, Inc in Lewes Rehoboth Hundred. M 168 72 Motion by Mr. Briggs, seconded by Mr. Chandler, unanimously carried to concur with the recommendation of the Planning and Zoning Commission and grant approval of this application. C/Z #69 From AR to C-1 being lands of John Williams located in Indian River Hundred. M 169 72 Motion by Mr. Chandler, seconded by Mr. Briggs, unanimously carried to concur with the recommendation of the Planning and Zoning Commission and grant approval of this application. C/Z #70 From AR to MR lands of R.T.R., inc located in Baltimore Hundred. M 170 72 Motion by Mr. Briggs, seconded by Mr. Chandler, unanimously carried to concur with the recommendation of the Planning and Zoning Commission and grant approval of this application. (72) May 23, 1972 Page 4 C/U #51 An application from John M. Mervine to consider Conditional Use of land in- an AR District located in Nanticoke Hundred. The Planning and Zoning Commission recommended denial of this application, therefore, the Council reserved decision until further investigation. C/U # 58 An application from William D. Warrington to consider the Conditional Use of land in an AR District located in Broadkill Hundred. M 171 72 Motion by Mr. Briggs, seconded by Mr. Chandler, unanimously carried to concur with the recommendation of the Planning and Zoning Commission and grant approval of this application with stipula tions as set forth by the Commission. C/U #59 An application from Sylvanus P. Baker to con­ sider the Conditional Use of land in GR and AR Districts, located in Little Creek Hundred M 172 72 Motion by Mr. Chandler, seconded by Mr. Briggs, unanimously carried to concur with the recommendation of the Planning and Zoning Commission and grant approval of this application. C/U #60 An application of Raymond W. Spicer to consider the Conditiona.l Use of land in an AR District located in Cedar Creek Hundred. Action was deferred on this application by the Planning a nd Zoning Commission, therefore, the Council will reserve decision on this application until a decision is reached by the Commission.
