County Council Minutes SUSSEX COUNTY COUNCIL-GEORGETOWN, DELAWARE-DECEMBER 3, 1974 Call to The regular meeting of the Sussex County Council was held on Order Tuesday, December 3, 1974 at 10:00 A. M. with the following members present: Oliver E. Hill President Ralph E. Benson Vice President John T. Cannon, Sr. Member William B. Chandler, Jr. Member Richard L. Timmons Member The meeting was opened with the repeating of the Lord's Prayer and the Pledge of Allegiance to the flag. M 595 74 A Motion was made by Mr. Cannon, seconded by Mr. Benson, to Minutes approve the minutes of the previous meeting as presented. Approved Motion Adopted by Voice Vote. Corre­ The following correspondence was read by Mr. Betts, County spondence Solicitor: Division of Drug Abuse Control. Re: Meeting of the Technical Coordinating Committee to. be held on December 10, 1974 at 1:30 P. M. in the Conference Room, First Floor, Division of Drug Abuse Control, Building C, Bissell Hospital. Paul E. Ellis, Judge of The Court of Common Pleas. Re: Declining the invitation of the Council to be a member of the Constable Advisory Committee. Department of the Army, Philadelphia District, Corps of En­ gineers. Re: Application by Thomas Martone, 2620 Crossgates Drive, Wilmington, Delaware for a Department of the Army permit to construct a bulkhead, dock and to fill an area in a lagoon in Roy Creek along Maple Lane, Selbyville, Sussex County, Delaware. Russell E. Train, Administrator, United States Environmental Protection Agency. Re: A National Environmental Manpower Planning Conference to be held in Phoenix, Arizona from December 8, 1974 to Decem­ ber 11, 1974 regarding the utilization of CETA and vocational education resources for environmental manpower development. The above correspondence was referred to Mr. Ellingsworth, Personnel, Safety, and Manpower Director. M 596 74 A Motion was made by Mr. Chandler, seconded by Mr. Benson, Controlling that the County Council go on record as supporting the Pitch­ of Litter In Program along with the State Program for the controlling of litter. Vote by Roll Call: Mr. Benson, Yea; Mr. Cannon, Yea; Mr. Chandler, Yea; Mr. Timmons, Yea; Mr. Hill, Yea Harbeson Mr. Henry, County Engineer, reported that the Harbeson Steeet Street Lighting was completed on November 25, 1974 Lighting Heating, Mr. Henry, County Engineer, reported that he will review Ventilating, further the bids received on the Heating, Ventilating, and & Air Con- Air Conditioning Contract and make a recommendation to the ditioning Council at the next meeting. EPA Mr. Henry, County Engineer, reported that he had received a call from EPA and possibly the grants will be made up this week on the Dewey Beach and Lecato projects. Town of Mr. Henry, County Engineer, reported that the County has been Milton working with the town of Milton on a feasibility study to de­ termine whether they should build their own secondary treatment plant or go in with the Lecato system. At this time the town of Milton is doing more detail checking on their costs before a decision is made. Employee Mr. Henry, County Engineer, reported that Frank Timmons, Re­ lief for Landfill No. 6, passed away on December 2, 1974. -2- December 3, 1974 Bid on The following bid was received on the sale and removal of Removal of structures ori property at South Bedford and West Pine Streets: Structures G. Layton Johnson $1. 00 M 597 74 A Motion was made by Mr. Chandler, seconded by Mr. Benson, Removal of that the bid of G. Layton Johnson be accepted in the amount Structures of $1.00 for the sale and removal of structures on property at South Bedford and West Pine Streets with the understanding that a period of one hundred twenty days from this date be allowed for the removal of the structures. Motion Adopted; 5 Yea. Vote by Roll Call: Mr. Benson, Yea; Mr. Cannon, Yea; Mr. Chandler, Yea; Mr. Timmons, Yea; Mr. Hill, Yea M 598 74 A Motion was made by Mr. Cannon, seconded by Mr. Benson, Purchase & that the County purchase property known as the "Georgetown Rental of Inn" and that Mr. Betts, County Solicitor, negotiate the Property price; and that the County rent one half of the building known as the "Food Stamp Building" on Route 113 at a cost of $750.00 per month, with the option to rent a part or all of the other half of the building in July. Motion Adopted; 5 Yea. Vote by Roll Call: Mr. Benson, Yea; Mr. Cannon, Yea; Mr. Chandler, Yea; Mr. Timmons, Yea; Mr. Hill, Yea Management Mr. Conaway, County Administrator, submitted copies of a Study of letter from G. Arno Loessner, Assistant Director for Urban County Services, University of Delaware, to the Council regarding a Management Study of the County. The Council instructed Mr. Conaway to set up a meeting with Robert Lamison, as suggested by Dr. Loessner; also to include any personnel necessary from the University's computing center; also to discuss questions regarding County organization and efficiency with a committee comprised of members of the County Council. Annual Mr. Conaway, County Administrator, submitted to the Council Luncheon copies of the invitation to attend the annual luncheon for for County County employees on December 10, 1974 at Memorial Hall, Employees Grace Methodist Church, King Street, Georgetown, Delaware. All members indicated they are planning to attend. -3- December 3, 1974 Special No action was taken on a request from the Town of Bridgeville Grant for a special grant in the amount of $543.00 for radios for Request the police department. County The Council agreed that the first County f lag that was flown Flag over the Courthouse should be given to William Scott, and Mr. Conaway should write a letter to Mr. Scott thanking him for his efforts in designing the flag. Credit The Council agreed that it would be all right for Mr. Bratton Union to contact employees of the County to discuss the possibility of a Credit Union being started. Proposed Mr. Conaway, County Administrator, reported that the next Building Hearing on the Proposed Building Code will be on December 18, Code 1974 at 8:00 P. M. Tri-County Mr. Conaway, County Administrator, reported that the next Meeting Tri-County meeting will be held at the Seaford Inn on January 15, 1975 with the Solid Waste Seminar starting at 4:00 P. M. Delaware Mr. Conaway, County Administrator, reported that the Delaware Day Cere­ Day Ceremony will be on December 7, 1974 at 11:00 A. M. and mony a news release has been sent out. Motion Adopted by Voice Vote. -4- December 3, 1974 At 1:30 P. M. the Council reconvened. PUBLIC HEARINGS: M 600 74 A Motion was made by Mr. Benson, seconded by Mr. Chandler, C/U #245 to concur with the recommendations of the Planning and Zoning Commission and approve with the stipulations (1) No outside storage or display, (2) Subject to site plan review, and (3) Site Plan be sent to State Highway Department for approval; C/U #245 - An application of Harlan G. York, Sr. to consider the Conditional Use of land in an AR-1 Agricultural Residential District in Lewes and Rehoboth Hundred for an addition to an existing Gift Shop to be located on the north side of Route 18, ~ mile east of Route 290, and containing 1.12 acres more or less. Motion Adopted; 5 Yea. Vote by Roll Call: Mr. Benson, Yea; Mr. Cannon, Yea; Mr. Chandler, Yea; Mr. Timmons, Yea; Mr. Hill, Yea M 601 74 A Motion was made by Mr. Timmons, seconded by Mr. Benson, to C/U #246 concur with the recommendations of the Planning and Zoning Commission and approve C/U #246 - An application of Agnes M. Goff to consider the Conditional Use of land in an AR-1 Agri­ cultural Residential District in Indian River Hundred for the use of a mobile home as a florist shop to be located on the east side of Route 30, ~ mile north of Route 24 and contain­ ing 21,600 square feet more or less.
