Plaintiffs Elvayaris Rosa, individually and on behalf of her daughter L.T., and Gregorio Santos, by and through their attorneys Emery Celli Brinckerhoff & Abady LLP, for their Complaint allege as follows: “WE CAN DO WHATEVER WE WANT, WE’RE THE FEDS” 1. Elva Rosa is a single mother of two small children, an active member of her school’s PTA, and a supermarket cashier. She lives in the Sotomayor Houses, named for Supreme Court Justice Sonia Sotomayor, who grew up in the same public housing complex in the Bronx. 2. On or about March 2, 2018, a group of United States Marshals surrounded Ms. Rosa’s car, handcuffed her, stole her house keys, invaded her apartment without a warrant, punched, kicked and beat her brother, forced him to sit on a hot radiator, threatened to kill him, terrorized her 4- and 9-year old children, and later threatened to take away her benefits, her apartment, her children, and her freedom.
