The London Borough of Hounslow (No.3) Experimental Order 2018 1. The London Borough of Hounslow hereby gives Notice that on 17 August 2018 it made the above Orders under Section 9 of the Road Traffic Regulation Act 1984.

2. The general effect of the Orders, which come into effect on 6 September 2018, will be to introduce: a) red route parking controls in roads around the school as detailed in Schedules 1, 2, 3 and 4; and b) resident only access restrictions in Gower Road and Oaklands Avenue between the hours of 7.45am and 9.15am, and 2.45pm and 4.15pm.

3. Documents giving detailed information of the Orders can be inspected: a) online at www.hounslow.gov.uk by typing in the term “traffic notices” in the search bar; or b) at the Forms and Documents Counter, Civic Centre, Road, Hounslow TW3 4DN, between 9am and 4.15pm Mondays to Fridays. Documents will be available for inspection until the end of eighteen months from the date on which this Notice is published.

4. The Orders provide that the Head of Traffic, Transport and Environmental Strategy, or a person authorised by him, may, if it appears to him or that person essential in the interests of the expeditious, convenient and safe movement of traffic or for preserving or improving the amenities of the area through which any road affected by the Orders runs, modify or suspend the Orders or any provision thereof.

5. If any person wishes to question the validity of the Orders or any of its provisions on the grounds that it or they are not within the powers conferred by the 1984 Act, or that any requirement of the Act, or of any instrument made under the Act has not been complied with, that person may, within 6 weeks from the date on which the Orders are made, apply for the purpose to the High Court.

6. If the provisions of the Orders continue in operation for a period of at least six months, the Council will consider in due course whether the provisions of the experimental Orders should be continued in force indefinitely by means of permanent Orders. Any person desiring to object to the making of Orders for the purpose of such indefinite continuation may, within six months of the Orders coming into operation, send a statement in writing of the objection and the grounds on which it is made to the Head of Traffic, Transport and Environmental Strategy at the above address quoting the reference TMO/E002/18.

Statement of Reasons

A new school for 4-19 year olds, Nishkam West London, will open in Osterley this September on the site of the old Conquest Club. Concerns have been raised about traffic associated with this development, and the council has been considering all possible options to minimise its impact on local residents.

The council and school are working to develop an effective school travel plan to encourage as many pupils as possible to travel by walking, cycling, or public transport (including a Park & Stride scheme from two nearby car parks). Without effective controls, however, it is considered likely that the school would bring an increase in the number of cars parking on local streets, particularly around the vehicular access to their site on Syon Lane and the pedestrian access on Wood Lane.

Following an informal pubic consultation, the Council has made the decision to implement an experimental traffic order to introduce red route parking controls on main roads around the school, and resident only access restrictions at school drop- off and pick-up times on nearby culs-de-sac to mitigate the impact of the school on local residents.

These measures are initially being introduced experimentally in order to assess their effectiveness before making them permanent or not. Traffic Management Order

2018 No.56 The London Borough of Hounslow (No.2) Experimental Order 2018

The Council of the London Borough of Hounslow, after consulting the Commissioner of Police of the Metropolis, in exercise of the powers conferred by section 9 of the Road Traffic Regulation Act 1984a, as amended, and of all other enabling powers hereby make the following Order: 1. This Order shall come into operation on 6 September 2018 and may be cited as the London Borough of Hounslow (No.2) Experimental Order 2018. 2. Without prejudice to the validity of anything done or to any liability incurred by the coming into operation of this Order, The London Borough of Hounslow (Waiting and Loading) Order 2008b, as amended, shall have effect as though: a) the items numbered 304(a)(i), 304(b)(xlvii), 534(a)(i) 534(b)(iii) to (vii), 534(c)(i) to (iii), 628(b)(v), 628(c)(v), 639(a)(i), 1120(a)(i), 1120(b)(iii), 1326(a)(i), in Schedule 1 to that Order were revoked from that Order; b) the item 1130(a)(i) was amended to “from a point 14 metres south-west of the south- western kerb line of Syon Lane to a point 1.6 metres north-east of the party wall of Nos.52/53 Stags Way”; c) the item 1130(b)(i) was amended to “from a point 14 metres south-west of the south- western kerb line of Syon Lane to the boundary wall of Nos.19/20 Wyke Close”; and d) item 4 of Schedule 4 is revoked from that Order.

3. In this order, except where the context otherwise requires, the following expressions have the meanings hereby assigned to them: “authorised person” means a police community support officer or an accredited person; where: a) “police community support officer” means a person who has been so designated by the Service as provided for by Section 38 of the Police Reform Act 2002c, and b) “accredited person” means a person who has been accredited by the Metropolitan Police Service under the Community Safety Accreditation Scheme as provided for by Section 41 of that Act; and in either case whilst exercising the powers of a police community support officer or an accredited person that person is wearing an approved uniform as provided for by Section 42(2) of that Act;

4. In pursuance of Section 10(2) of the Road Traffic Regulation Act 1984, the Head of Traffic, Transport and Environmental Strategy, or a person authorised by him, may, if it appears to him or that person essential in the interests of the expeditious, convenient and safe movement of traffic or for preserving or improving the amenities of the area through which any road affected by the Order runs, modify or suspend the Order or any provision thereof. 5. No person shall cause any vehicle to stop at any time in the red route described in Schedule 1. 6. No person shall cause any vehicle to stop in the red route described in Schedule 2 during the restricted hours. 7. No person shall cause any vehicle to wait in the red route described in Schedule 3 during the restricted hours: a) for longer than the period specified in column 4; or b) if a period of less than that specified in column 5 has elapsed since the vehicle was last waiting on any part of the same length of red route described in column 2.

8. Nothing is this Order shall apply in respect of a person causing a vehicle to stop if that person is: a) required by law to cause the vehicle to stop or not to proceed; b) prevented from proceeding in the vehicle by circumstances beyond the person's control or it is necessary to stop to avoid injury or damage to persons or property; c) getting or giving help in consequence of an accident or an emergency, or otherwise taking action for public safety; d) opening or closing a gate or other barrier at the entrance to premises to which the vehicle is being driven or from which it has emerged, if it is not reasonably practicable to cause the vehicle to stop elsewhere for the purpose; e) the vehicle is being used for at least one of the following purposes: i) fire and rescue authority ii) ambulance iii) blood service iv) providing a response to an emergency at the request of an NHS ambulance service; v) bomb or explosive disposal; vi) special forces; vii) police; viii) National Crime Agency.

d S.I. 2016/362 e S.I. 2000/683 f 2000 c.26 Page 2 of 7 2018/56 f) the vehicle has stopped for no longer than is necessary for ite to be used for the purposes of: i) the removal of any obstruction to traffic; ii) the maintenance, improvement or reconstruction of any length of highway specified in Schedules 1, 2 or 3; iii) the laying, erection, alteration, repair or cleaning, in any length of highway specified in Schedules 1, 2 or 3, of any sewer, or of any main, pipe or apparatus for the supply of gas, water, or electricity, or of any electronic communications apparatus, but only if it is not reasonably practicable to cause the vehicle to stop elsewhere for those purposes; g) using a taxi to stop for so long only as may be required to enable a passenger to board or alight; h) using a vehicle displaying a disabled person's badge in the relevant position to stop for so long only as may be required to enable a disabled person to get on or off the vehicle; i) using the vehicle for the purpose of collecting refuse by or on behalf of a local authority; j) a marked vehicle which, whilst used by a universal service provider in the course of the provision of a universal postal service, is stationary only for so long as may be reasonably necessary for the purposes providing that service.

9. Nothing is this Order shall apply to anything done with the permission of an authorised person or with the permission or at the direction of a police officer in uniform or of a Civil Enforcement Officer. 10. Nothing is this Order shall do not apply to a person causing a pedal cycle to be parked at a facility specifically provided for the purpose of pedal cycle parking by, or with the consent of the highway authority. 11. Nothing is this Order shall apply in respect of a person causing: a) a local bus to stop at a bus stop for as long as may be required to enable passengers to board or alight; or b) a bus to stop at a bus stop or a bus stand and being used for operational reasons in the provision of a local service or training drivers to allow such a service to be provided. In this article "operational reasons" means: ii) to enable crew changes to take place; or iii) to maintain the scheduled timetable subject, in the case of a bus stop, to a maximum wait of two minutes.

EXPLANATORY NOTE (This Note is not part of the Order, but is intended to indicate its general purport.)

London Borough of Hounslow (Waiting and Loading Restriction) (Civil Enforcement Area) Order 2008, as amended, imposes waiting and loading restrictions in Braybourne Drive, Crowntree Close, Gower Road, Jersey Road, Macfarlane Lane, Oaklands Avenue, Stags Way, Syon Lane Tesco Access Road, Windmill Lane, Wood Lane, and Wyke Close. This Order amends the Order of 2008 by revoking those waiting and loading restrictions and replacing them with red route no stopping restrictions.

1. Citation and Commencement (1) This Order shall come into operation on 6 September 2018 and may be cited as the London Borough of Hounslow (No.3) Experimental Order 2018. (2) In pursuance of Section 10(2) of the Road Traffic Regulation Act 1984, the Head of Traffic, Transport and Environmental Strategy, or a person authorised by him, may, if it appears to him or that person essential in the interests of the expeditious, convenient and safe movement of traffic or for preserving or improving the amenities of the area through which any road affected by the Order runs, modify or suspend the Order or any provision thereof.

2. Interpretation (1) In this order, except where the context otherwise requires, the following expressions have the meanings hereby assigned to them: “authorised person” means a police community support officer or an accredited person; where: a) “police community support officer” means a person who has been so designated by the Metropolitan Police Service as provided for by Section 38 of the Police Reform Act 2002b, and b) “accredited person” means a person who has been accredited by the Metropolitan Police Service under the Community Safety Accreditation Scheme as provided for by Section 41 of that Act; and in either case whilst exercising the powers of a police community support officer or an accredited person that person is wearing an approved uniform as provided for by Section 42(2) of that Act; “authorised road user” means a resident or a visitor to a resident of any street specified in column 2 of Schedule 1. “authorise vehicle list” means the list of authorised road user’s vehicle registration numbers held by the London Borough of Hounslow.

a 1984 c.27 b 2002 c.30 Page 1 of 4 2018/57 “goods” means items of any kind whether animate or inanimate and includes postal packets of any description. “goods vehicle” and “taxi” have the same meanings as the Traffic Signs Regulations and General Directions 2016”c “prohibited hours” means between 7.45am and 9.15am, and between 2.45pm and 4.15pm, on Mondays to Fridays during school term time. “resident” means a person whose usual place of abode is at the premises the postal address of which is any street specified in column 2 of Schedule 1. “school term time” means those days of the year which have been determined as school days by the Council as Local Education Authority in accordance with Section 21 of the Education (No.2) Act 1986d. “universal postal service” and “universal service provider” have the same meanings as the Postal Services Act 2000e “visitor” means a person who is visiting a resident, including visiting for the purposes of: collecting or delivering goods and/or the supply or provision of a service to a resident.

3. Prohibition (1) No person shall cause any motor vehicle to enter the street specified in column 2 of Schedule 1 during the prohibited hours unless otherwise stated in column 3 of the said Schedule.

Exemptions (1) Nothing is this Order shall apply in respect of a person causing a vehicle to enter the prohibited area if: a) required to proceed in any road in accordance with any restriction or requirement indicated by traffic signs placed pursuant to section 67 of the Road Traffic Regulation Act 1984; b) the vehicle is being used for at least one of the following purposes: i) fire and rescue authority ii) ambulance iii) blood service iv) providing a response to an emergency at the request of an NHS ambulance service; v) bomb or explosive disposal; vi) special forces; vii) police; viii) National Crime Agency. c) the vehicle is being used for the purposes of: i) the maintenance, improvement or reconstruction of any length of highway specified in Schedules 1, 2 or 3; or ii) the laying, erection, alteration, repair or cleaning, in any length of highway specified in Schedules 1, 2 or 3, of any sewer, or of any main, pipe or apparatus for the supply of gas, water, or electricity, or of any electronic communications apparatus;

c S.I. 2016/362 d 1986 c.60 e 2000 c.26 Page 2 of 4 2018/57 d) the vehicle is a taxi being used to enable a resident or a visitor to board or alight from the prohibited area; e) the vehicle is a marked vehicle, being used by a universal service provider in the course of the provision of a universal postal service, for the purposes of providing that service. f) the vehicle is a goods vehicle making deliveries to, or collecting goods from, premises that are only accessible from the prohibited area. g) the vehicle is being used to enable a passenger, who is either a resident or a visitor to board or alight from the vehicle. (2) Nothing is this Order shall apply to anything done with the permission of an authorised person or with the permission or at the direction of a police officer in uniform.

5. Authorise Vehicle List (1) Any resident who is the user of a motor vehicle may apply to the Council for the vehicle registration number of that motor vehicle to be added to the authorised vehicle list. (2) Any resident may apply to the Council for the vehicle registration number of a vehicle used by a visitor to be added to the authorised vehicle list. (3) The Council may at any time require a resident to produce to an officer of the Council such evidence they may reasonably call for to verify any information given to them as part of the application to add a vehicle registration number to the authorised vehicle list. (4) On receipt of an application duly made under the foregoing provisions of this Article and upon receipt of the administration charge set by the Council, the Council shall add the vehicle registration number to the authorised vehicle list. (5) A resident’s vehicle registration number shall remain on the authorised vehicle list for as long as the vehicle to which it relates remains either in the ownership of, or used by, a resident. (6) A visitor’s vehicle registration number shall remain on the authorised vehicle list for a maximum of 12-months.

The Council of the London Borough of Hounslow, having consulted the Commissioner of Police of the Metropolis, in exercise of the powers conferred by sections 6 and 124 of the Road Traffic Regulation Act 19841 as amended, and of all other enabling powers hereby make the following Order:

1. This Order may be cited as the London Borough of Hounslow (Waiting and Loading Restriction) (Amendment No.211) Order 2018 and shall come into operation on 19 March 2018.

2. Without prejudice to the validity of anything done or to any liability incurred in respect of any act or omission before the coming into operation of this Order, The Hounslow (Waiting and Loading Restriction) Order 20082 shall have effect as though: (a) the items numbered 628 and 837 in Schedule 1 to that Order were substituted with the item similarly numbered and set out in Schedule 1 to this Order; (b) the item numbered 1382 was added to Schedule 1 to that Order as set out in Schedule 1 to this Order; and (c) the item numbered DDDD was added to Schedule 3 to that Order as set out in Schedule 2 to this Order.
