The RSTF cumulative fund balance was sufficient to administer the full quarterly distribution. RSTF payments of $6,043,162.04 and interest income of $359,268.73, for a total of $6,402,430.77, was deposited into the RSTF for the quarterly period ended September 30, 2020. A portion of the interest income is allocated to previously approved distributions held in the RSTF on behalf of one (1) Tribe in the amount of $29,773.93. Staff continues to recommend that the distribution to the California Valley Miwok Tribe be allocated but withheld. On December 30, 2015, Kevin Washburn, the Assistant Secretary (of the Department of the Interior) for Indian Affairs (AS-IA), issued a final agency decision that unequivocally states that the United States does not recognize leadership for the California Valley Miwok government. A decision by AS-IA is final for the Department, effective immediately, and unlike decisions rendered by subordinate Bureau of Indian Affairs (BIA) officials, is not automatically stayed upon appeal.

    Vice-Chairman Denver Report and Updates Since the COVID-19 crisis I have been engaged with several Federal, State and Tribal teleconference meetings. Due to travel restrictions, many of my meetings have been via teleconference calls. These calls vary from 1 – 4 hours with important information being discussed. Indian Country COVID-19 – White House The Indian Country COVID-19 meetings are facilitated by Tyler Fish who is the Executive Director for the White House Council on Native American Affairs. The teleconference calls have been every Friday with tribal leaders throughout the nation. COVID-19 Funding Information– CARES Act On March 27, 2020, the president signed into the law the Coronavirus Aid, Relief, and Economic Security Act (CARES Act). The new law contains almost $2 trillion of funding to provide support to individuals, governments, and businesses impacted by COVID-19. The legislation also provides approximately $10 billion of funding for tribal citizens, governments, urban Indian organizations, and tribal businesses impacted by COVID-19 through different programs and funding mechanisms. The biggest source of funding in the legislation for tribal and state governments comes from the Coronavirus Relief Fund at $150 billion, which has $8 billion reserved for tribes. The money under this funding can be used for allowable costs that are necessary to address COVID-19. The CARES Act is the third bill that Congress has passed since early March to address impacts by from the COVID-19 pandemic. Highlights of the legislation include funding for individual payments to taxpayers, expansion of unemployment benefits, student loan forbearance, food for food banks, loans and grants to small and large businesses, funding for hospitals and health providers, and funding to stabilize state, tribal, and local governments.

Salazar Dear Mr. President Stop the Casino 101 Coalition is a non-sectarian, multi-cultural group founded in August, 2003, by thousands of concerned Sonoma County, CA citizens in response to plans by the Federated Indians of Graton Rancheria to build a massive, 760,000 square foot Las Vegas-style urban casino on the outskirts of the City of Rohnert Park. We are writing to urge you to reconsider your position on a so-called “Carcieri Fix”. We believe that federal Indian policy has in many respects supplanted Constitutional law, and that with its three landmark decisions, City of Sherrill v. Oneida Nation (2005), Carcieri v. Salazar (2008) and Hawaii v. Office of Hawaiian Affairs (2008), the Supreme Court has correctly begun to assert the law of the land with regard to what often amount to federal land grabs. One thing we all must do when we continuously hear federal and state agency administrators referring to a "government-to-government" relationship with Indian tribes is to add a strong dose of reality. The federal government has a government-to- government relationship with all states, and states have this same relationship with its counties and other municipal subdivisions. The pattern that always confronts us is a tendency to assume that a "government-to- government" relationship with an Indian tribe supplants the same and existing government-to-government relationship between the federal government and the states, and with affected states and their subdivisions.
